Madam,
Kindly
refer to the minutes drawn against point No. 35 of the meeting held with your
goodself on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of
CBEC. It is submitted with due regards that the
decision on this point has also unfortunately been deviated as usual merely to
divert & dilute the issue referring statutory provisions and approval of
Board. No action has been taken on the issue till date despite of being agreed
in the meeting of 15.03.12. Your goodself was also pleased to agree to
it in the meetings of 02.11.12 and 31.01.13 but nothing has been done till
date.
2. The general impression of the
members is, “whatever powers of adjudication have been granted to the
Superintendents, the same have been granted to merely remove the pendency in
adjudications”. This pendency was actually meant for the Asstt. Commissioners. More number of posts at the level of
Asstt./Deputy Commissioner could have been functionally justified and demanded
on the basis of this pendency for
ongoing cadre restructuring but the same perhaps has not been done.
3. Moreover, no powers of refund
and rebate have been granted to the Superintendents. It has also not been
clarified which Superintendent (Technical, Range, Preventive, Anti-evasion,
Adjudication, Legal, Audit etc.) would exercise these powers of adjudication.
Whatever statutory provisions were created at the time of granting the said
powers of adjudication to the Superintendent, the same may kindly be amended by
the approval of Board/concerned competent authority.
4. In view of the above, it is
requested that the immediate steps may kindly be taken to expedite the matter.

2. It
is further submitted that the Dharmveer
Gupta letter has already been handed over to the concerned
authorities on various occasions but there seems no seriousness on the issue by
the concerned section. It is also well pertinent to mention that the orders
under the signature of Sh. Dharmveer Gupta were issued based on the directions
of the Hon’ble CAT, Jabalpur and the relevant judgement of the Jabalpur CAT had
never been challenged by the government.
3. In view of the above, it is
requested that the immediate steps may kindly be taken to expedite the matter.
