Madam,
With due regards, your kind attention is
invited to DOPT letter vide F.No. 16/18/2008-JCA Dt. 17.04.13 sent to Sh. Ajit
Gambhir, Director, Ad IV of CBEC latestly saying that, “In such of the
Government departments/offices where a different practice (in r/o transfer of
the Association functionaries) is being followed now, the existing practice, if
not less favourable, may continue.”
2. Your kind
attention is also invited to the Ref. No. 11/Assn/12 Dt. 09.08.12, 16/Assn/12 Dt. 13.08.12, 21/Assn/12 Dt. 22.08.12, 32/Assn /12 Dt.
10.09.12, 56/Assn/13 Dt. 11.04.13 etc. of this Association and it is submitted
with due regards that this Association representing the gazetted officers
namely the Superintendents of Central Excise is duly recognised by the Central
Board of Excise & Customs (CBEC) vide F.No. B.
12017/10/2006-Ad.IV A Dt.21.01.08 at central level. It is having its zonal branches
throughout India at Commissionerate levels under different cadre controlling
authorities.

It is further submitted that the letter No. 2/7/88-CS(IV) dt. 19.08.08 of DOPT
says that the Union/Association functionaries including of Branch Units of the
recognized Union/Association should not be shifted to subordinate office
outside the main office of the cadre control authority/ministry/department. But
the CBEC is not giving this benefit to the
Association functionaries under it.
4. Your kind attention is also
invited to the letter No. 9/34/87-JCA dt. 08.03.88 of DOPT saying against S. No. 3 of the clarifications
that 3 office bearers should be given the benefit of staying at headquarters
office. It is further submitted that the said benefit is also not being given
to the Association functionaries by CBEC.
5. Further, your kind attention is
also invited to the fact that our counterpart gazetted officers
namely the Section Officers of CSS are also the members of the JCM. But the Superintendents of Central Excise are not being treated as
the members of the JCM by the department of Revenue as they are not being
called for the anomaly committee meetings for pay and MACPS etc.
6. As far as the staff Associations including
this Association under CBEC are concerned, these were being recognized by CBEC
as per the cadre controlling authorities throughout India constituting an All
India Federation at National level also duly recognized by CBEC prior to 1993.
All the facilities/benefits were being granted to all Association/Federation
functionaries at that time without discrimination. Further as per the new rules
of 1993, the single Association for one cadre is being recognized at central
level having its branches at the levels of different cadre controlling
authorities scattered through India. But now, the Association functionaries
neither at branch level nor at National level are able to get the said
benefits. The branch level Association functionaries are unable to get the
benefits due to the reason as told by CBEC that only the National level
Association functionaries are eligible to get the prescribed benefits. The
National level Association functionaries are also unable to get the said
benefits because of the fact that they may belong to any of the cadre
controlling authorities throughout India instead of Delhi. For example, former
President & Secretary General of this Association belonged to
Chennai/Guntur/Jaipur & Mumbai/Kolkata/Delhi respectively while the current
ones belong to Bhubaneshwar & Delhi respectively. The Association
functionaries from Chennai/Guntur/Jaipur/Mumbai/Kolkata/Bhubaneshwar can never
be transferred to Delhi at National headquarters due to have been serving under
the respective cadre control authority instead of Delhi. The situation with the
Section Officers, the counterparts of the Central Excise Superintendents, is
quite different on account of their all offices including branch units being
situated at Delhi itself instead of being scattered throughout India under
different cadre controlling authorities. Thus, the Association functionaries in CSS even at branch levels are getting the
prescribed benefits while the functionaries of this Association under CBEC are
getting the benefits neither at National level nor at branch level.
7. Very recently, the General Secretary of the
Tirunelveli Unit/branch of the Association has been transferred to another zone
under Madurai Commissionerate where the Association already has its Madurai
Unit/branch with different General Secretary and other office bearers for the
said zone. Likewise, the President of the Daman & Vapi Unit/branch of the
Association has been transferred to another zone under Surat Commissionerate
where the Association already has its Surat Unit/branch with different
President and other office bearers for the said zone. This has jeopardised the
Association activities in the said zones due to the transfer of main office
bearers to another zones having another units/branches of the Association. Such
office bearers of branch units of the Association should be allowed to get
posted to either concerned headquarters or under the jurisdictional area of the
concerned zone/Commissionerate only to make them available to the members of
the concerned unit/branch. The transfer
of the main office bearers of one Association branch to outstation under same
Zone/Commissionerate and also another Commissionerate/Zone having another
Association branch has totally deactivated the EMPLOYEE GRIEVANCE REDRESSAL
MECHANISM in the concerned Commissionerates/Zones.
8. There is a big difference
between the
branch units of this Association and the branch units referred in the letter
No. 2/7/88-CS(IV) dt. 19.08.08 of DOPT. This Association has its branches
throughout the country at Zonal & Commissionerate levels covering more than
one states under various cadre controlling authorities while the branch units
referred in the letter No. 2/7/88-CS(IV) dt. 19.08.08 of DOPT belongs merely to
the different office buildings within the same city of Delhi. Thus, branches of
this Association function at National level while the branch units referred in
the above DOPT communication functions at local level within a city only. The
branches of this Association have their own independent constitution and were
also independently recognised at central level prior to RSA Rules, 93. It is
very unfortunate that the branch Association functionaries of this Association
are being denied the due benefits all of
a sudden despite of being functioned at National level of zones whereas the
branch unit Association functionaries referred in the above DOPT communication
are being granted all the benefits despite of being functioned within city only.
It is also worth to submit that our counterpart gazetted officers namely the
Section Officers of CSS are already being granted all the benefits in this
regard despite of having local branch units of the Association within the city
only.

Moreover, the zonal/branch Association functionaries will also not be able to
collect the DDO certificates of the members statutorily required for the
continuance of the recognition of the Association on being transferred to
isolated offices/places at outstations or other zones/branches. It is nothing
but gross injustice & harassment to the Association functionaries alongwith
members to transfer them to outstations/other Zones & Commissionerates.
10. The DOPT clarification ID No.
16/18/2008-JCA Dt. 01.12.09, OM No. 16/18/2008-JCA
Dt. 03.09.12 & letter F.No. 16/18/2008-JCA Dt. 17.04.13 also say that the existing practice should be
continued in r/o of the transfer of the Association functionaries, if it is not
less favourable in comparison to the DOPT guidelines on the issue. Despite of
the above communications, the branch Association functionaries at zonal level
are being denied the due benefits. The decades long practice of granting the
said benefits to them has been stopped all of a sudden in totally arbitrary and
unjust manner in CBEC paying no heed to the DOPT communications.
11. In view of the above, it is
requested that the consolidated instructions/guidelines may also kindly be
issued at the DOPT level itself in
the case of the Superintendents of Central Excise on
the lines of the letters No. 2/7/88-CS(IV) dt. 19.08.08 and 9/34/87-JCA dt. 08.03.88 of DOPT granting all the
benefits to their Association functionaries (including the President and
Secretary General/General Secretary) covering all Branch Units to revive the
employee grievances redressal mechanism in CBEC. They may also kindly be
allowed to be the members of JCM like Section Officers of CSS.

Madam,
Kindly
refer to the minutes drawn against point No. 17 of the meeting held with your
goodself on 31.01.13 vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of CBEC.
2. It is submitted with due regards that the decision on this point has
also unfortunately been deviated saying that any decision on this matter can be
taken only after examining this proposal in detail while the issue was agreed
in the meeting of 15.03.12. The Association was also assured by your goodself of the
necessary action during the meeting of 02.11.12 but the same is still awaited.
3. As far as the ‘examining this proposal in detail’ as mentioned in the
above referred minutes is concerned, the said examination is also pending even
after expiry of more than 4 months. It is further submitted that the
State Governments like Uttar Pradesh etc. have granted the grade pays of Rs.
6600/- & 7600/- after 14 & 26 years (or even less by others) on IInd
& IIIrd MACP upgradation to their employees without offsetting with time
scale despite of the originating source
(6th CPC) being the same whereas our officers are getting a grade
pay of Rs. 5400/- after 30 years or more under MACPS which they were able to
get after 24 years under ACPS. The IIIrd MACP upgradation is not being granted to our
officers after 30 years of service, if they have become AC. The pay of seniors
is not being stepped up despite of the judgement of Supreme Court, if they are
forced to get less salary than juniors under ACPS/MACPS.
4. Further, offsetting of MACP upgradation with time scale is arbitrary
& unlawful. It was neither resolved by the government in its resolution
based on 6th CPC recommendations nor notified in Memorandum of
MACPS. Time scale and MACPS upgradations are altogether different things by
procedure as well as nature. Time scale is simply part of employee’s pay scale
while MACPS upgradation is granted in lieu of lack of promotions. It is also
worth to mention that MACP upgradation is not being offset with time scale in
CBDT.
5. Furthermore, para 8.1 of MACPS instructions is also totally arbitrary
and unlawful as the grade pays of Rs. 5400/- in PB2 & PB3 not having financial
difference even of a single paisa. It was very clearly resolved in the
resolution of the government that the MACP upgradation would be granted in
higher grade pay while the grade pay of Rs. 5400/- in PB3 is noway higher than
the grade pay of Rs. 5400/- in PB2.
6. In view of the above, it is
again requested that the serious steps may kindly be taken on the immediate
basis to grant at least a
grade pay of Rs. 6,600-/ & 7,600/- on IInd & IIIrd MACP
upgradation without offsetting with time scale to all officers after joining in the grade pay
of Rs. 4600/-.

Madam,
Kindly
refer to the point No. 18 of the minutes of the meeting held with your goodself
on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of CBEC. It
was also decided during the meeting of 15.03.12 that the Association would
bring the specific instances to the notice of the Board.
2. It is submitted with due regards that the office bearers of the
Association are still being harassed in the field formations. Wherever the
office bearers stand for the cause of their members, they are transferred to
other zones or outstations in arbitrary, high-handed & unlawful manner. The
examples of many Zones/Commissionerates were already brought to your kind
notice.
The Association was also forced to bring the recent examples of Bagalore,
Tirunelveli, Vadodara etc. to your kind notice as the concerned Chief
Commissioners are not ready to listen the Associations. The high-handedness in
transfer & postings at Chandigarh, Bombay etc. is also burning example of
harassment. Nothing has been changed despite of the issues being brought to
your kind knowledge.
3. The General Secretary of Association in Tirunelveli Commissionerate, Sh. M. Rajaclimax, has been transferred to Madurai
Commissionerate where the Association already has its another unit with
different officer as General Secretary. No officer has been transferred without
request to Madurai Commissionerate from Tirunelveli Commissionerate in the
history. He has been transferred ignoring all the DOPT guidelines as he is
going to retire within 1 year and also the office bearers of one
Commissionerate were never practiced to be transferred to other
Commissionerates.
4. The President of Association in Daman/Vapi Commissionerate, Sh. Thandilal Meena, has been transferred to Surat
Commissionerate where also the Association already has its another unit with
different officer as President. He has been transferred ignoring all the DOPT
guidelines as the office bearers of one Commissionerate were never practiced to
be transferred to other Commissionerates. His tenure as the President of Daman/Vapi
Unit is yet to be completed and it still remains for more than one year.
5. The examples of the office bearers, members as well as transfer &
postings in Chandigarh Zone have already been discussed with your goodself in
lengths on various occasions.
6. In view of the above, it is
again requested that the serious steps may kindly be taken on the immediate basis
to stop the harassment to the office bearers as well as the members of the
Association and the office bearers may also kindly be retained in concerned
Commissionerates at the office of the Association.

Kindly
refer to the minutes drawn against point No. 25 of the meeting held with your
goodself on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of
CBEC. It is submitted with due regards that the decision on this point has also
unfortunately been deviated as usual merely to divert & dilute the issue
saying, “needs to be examined”. No action has been taken on the issue till date
despite of being agreed in the meeting of 15.03.12. Your goodself was also
pleased to agree to it in the meetings of 02.11.12 and 31.01.13 but nothing has
been done till date.
2. It is further submitted that the
promotion from the post of UDC to DOS is not considered actual promotion for
the purpose of ACP/MACP upgradation and the orders to this effect had already
been issued by the Board. But the promotion from the post of UDC to Inspector
is being considered actual promotion for this purpose and no orders have been
issued by the Board not to consider it actual promotion for the purpose of
ACP/MACP upgradation on the lines of promotion from the post of UDC to DOS
despite of the repeated requests of the Association.
3. In view of the above, it is
requested that the promotion of UDC to Inspector may also kindly not be
considered as actual promotion for the purpose of ACP/MACP upgradation and the
necessary orders to this effect may kindly be issued on immediate basis for the
sake of justice to the affected officers.

Madam,
Kindly
refer to the minutes drawn against point No. 26 of the meeting held with your
goodself on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of
CBEC. No action has been taken on the issue till date
despite of being agreed in the meeting of 15.03.12. Your goodself was also
pleased to agree to it in the meetings of 02.11.12 and 31.01.13 but nothing has
been done till date.
2. It is further submitted that the
staff is forced to wear the uniform for the pleasure
of the authorities. It serves the only purpose to please such authorities in some
official or the most of the time unofficial protocols.
3. It is requested
that the matter may kindly be expedited and due statutory provisions may kindly
be formulated to wear the uniform from bottom to top level for the sake of its
grace and respect. No officer may kindly be harassed in the name of wearing of
the uniform. The wearing of the uniform may be undone at the seats where it is
not required et al.
