Kindly refer to the minutes drawn against point No. 43 of the meeting held with your goodself on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of CBEC. Your goodself was pleased to agree to the point in the meetings of 02.11.12 and 31.01.13 but there is no change in the scenario as the training to the first batch 25 SSB officials has already been imparted at NACEN in the month of March, 13.
2. It is very unfortunate that our authorities are more interested to hand over our powers to the other agencies instead of enhancing the powers of our own officers. Simply conveying the views of the Association on any issue to another authority will solve no purpose until necessary effective steps with full seriousness are taken to resolve the issue. It is also very unfortunate that our Board is not enhancing staff strength & powers as per need while the Ministry of Home Affairs is very much keen to enhance their workforce on the border encroaching our powers & authority. If it is the approach, the days are not far away when whole of our work may be handed over to other agencies or even to private hands. In Customs bonded areas, Customs is understood the supreme authority but, very unfortunately, even International Airports have been handed over to private companies and even the government official passes for entry of our officers are being issued by private hands. Thus, we are on the mercy of other agencies and private hands even in the Customs areas.
3. The need of the time is to intact our statutory powers and withdraw any move to dilute these powers provided to us under the Customs Act. The statutory provisions of Customs Act can never be overruled by any agency. The serious steps are required to be taken to intact the prestige & pride of the organisation in general and Superintendent cadre in particular by stopping the unwarranted interference of the foreign agencies in Customs work. The work of the other agencies (including security agencies) should be limited to their function only without trespassing the powers of Customs officers. Otherwise, our Customs officials should also be granted the powers of the other agencies.
4. In view of the above, it is requested that the necessary step may kindly be taken in the matter particularly for the sake of the protection of the grace of the job as well as department.

 Madam,
Kindly refer to the minutes drawn against point No. 45 of the meeting held with your goodself on 31.01.13 issued vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of CBEC. Your goodself was pleased to agree to the point in the meetings of 02.11.12 and 31.01.13 but there is no change in the scenario.
2. Simply conveying the views of the Association on any issue to another authority will solve no purpose until necessary effective steps with full seriousness are taken to resolve the issue. Almost 84 types of reports are being processed & complied at the Range level over-burdening the Range office. Earlier to 2008, many such works were being carried out by the Preventive wing of the Division offices. Due to the removal of Preventive units from the Division offices, un-bearable loads have been transferred to the Range Officers.
3. The urgent need of the time is to re-instate the Preventive wings at all the Division offices throughout the country to streamline the official work or to take some alternative measures accordingly not to make the Range offices overburdened.
4. In view of the above, it is requested that the serious steps may kindly be taken in the matter at an early date.

            2. It is further submitted with due regards that your goodself was kind enough to ask the concerned worthy Chief Commissioner to take the necessary action as per rules vide your letter F.No. MCEx/Misc/Coambatore (Zone)/2013 Dt. 24.05.13.
            3. But very unfortunately, it is further worth to submit that no rule is being followed in this case. As per rules, the government officers near retirement should not be disturbed from existing station and be placed at their desired station. Sh. Rajaclimax is going to retire within year but DOPT guidelines are not being followed in his case.
4. In view of the above, it is requested that Sh. Rajaclimax may kindly be retained at Tuticorin itself under the jurisdiction of Tirunelveli Commissionerate at any seat and not be transferred to Madurai Commissionerate.

            2. It is further submitted with due regards that Sh. Thandilal Meena, President of Daman/Vapi Unit of Association, has been transferred to Surat out of the jurisdiction of Vapi/Daman Commissionerate.
            3. As per the decades long established practice, the main Association functionaries were never being transferred to outside the jurisdictional area of the concerned Commissionerate. The DOPT clarification ID No. 16/18/2008-JCA Dt. 01.12.09 as well as OM No. 16/18/2008-JCA Dt. 03.09.12 also says that the existing practice should be continued in r/o of the transfer of the Association functionaries, if it is not less favourable in comparison to the DOPT guidelines on the issue.
4. It has again been reiterated latestly by DOPT vide F.No. 16/18/2008-JCA Dt. 17.04.13 that, “In such of the Government departments/offices where a different practice is being followed now, the existing practice, if not less favourable, may continue.”
5. But DOPT guidelines are not being followed in this case. Moreover, this All India Body is having its units throughout India at Commissionerate levels. This body is having its separate units for Daman/Vapi and Surat with different sets of office bearers. Sh. Thandilal Meena is the President of Daman/Vapi Unit. For Surat Unit, the Association is having another officer as President. If Sh. Thandilal Meena is transferred out of Daman/Vapi Commissionerate, there will be no President of Daman/Vapi Unit to look after the Association work and other staff welfare activities. His transfer outside the Daman/Vapi Commissionerate will jeopardise the interest and welfare of the members of the Association. His tenure as the President of Daman/Vapi Unit is yet to be completed and it still remains for more than one year.
6. In view of the above, it is requested that Sh. Thandilal Meena may kindly be retained at Daman/Vapi Commissionerate itself.

Sub: ACP/MACP clarification.
Madam,
            Kindly refer to the Ref. No. 107/OS/13 Dt. 15.05.13 of the Association.
2. It is further submitted with due regards that no response has been received on the matter even after expiry of more than one month showing absolute non-seriousness of the concerned section while recovery from the salaries from our officers has already been started. No clarification has been issued particularly on the following points by the Board-
(a) What grade pay will be paid to those officers on completion of 30 years who have got time scale and then 2nd ACP upgradation between 01.01.06 and 31.08.08? Whether they will be eligible for IIIrd MACP upgradation or will it be offset against the time scale?
(b) What grade pay will be paid to those officers on completion of 20 years or on being eligible for IInd MACP upgradation who have got time scale before completion of 20 years or prior to grant of IInd MACP upgradation? Whether they will be eligible for next MACP upgradation or will it be offset against the time scale?
(c) If MACP upgradation is offset, what will the next upgradation will be called/counted-IInd or IIIrd? How the IIIrd MACP upgradation will be granted to the officers?
The officers falling under the categories (a) and (b) of para 2 above are not being granted the due benefits by the field formations.  
3. Every prudent person knows that any offset of ACP/MACP upgradation with the time scale is not legally sustainable. Moreover, it is also not understood how the time scale granted between 01.01.06 and 31.08.08 (before the origin of MACPS) can be offset with MACP upgradation whereas the MACPS itself came into existence on 01.09.08. Even otherwise, the MACP/ACP upgradation can no way be offset with the time scale because of both having different identity as well as procedure for implementation. The time scale is the part of the pay scale of the post being held by the employee which requires no DPC whereas the ACP/MACP upgradation is not the part of the pay scale of the post and it also requires DPC. The grade pays granted under the ACP/MACP upgradation also belong to the higher post or higher hierarchy.
4.  No MACP upgradation is being offset even by the State governments of Uttar Pradesh etc. One may say that MACP Schemes adopted by the Central governments and State governments have no relation but this notion is not correct because both of the MACP Schemes (for Central and State governments) have been originated from the same source, i.e., 6th CPC. It is also worth to mention that the government was not having any intention to put its employees at loss at the time of the formulation of MACPS as compared to ACPS. Rather, it was formulated to grant additional benefit to the employees. In addition to MACPS, one more additional financial benefit was granted independent of MACPS in the form of time scale.
5. As far as the para 8.1 of MACPS is concerned, it is nowhere (including MACPS notification as well as Govt. resolution) mentioned that the time scale/NFSG would offset one MACP upgradation. Para 8.1 merely says that the grade pays of 5400/- in PB2 and PB3 are separate grade pays for the purpose of MACP upgradation. However, it is nowhere mentioned which is higher one.
6. In view of the above, it is requested that a general clarification may kindly be issued to all field formations clarifying each and every doubt on MACPS to give justice to the officers at an early date without further delay as recovery from the salaries of the officers has already been started in the field formations. It is also requested that the field formations may be directed not to make any recovery until the issue is settled finally.
