We all know that the programme of 29-31.03.13 has only been deferred and the programmes of 12.04.13 AND 30.04.13 ARE AS "IT IS" WITHOUT ANY CHANGE. We have not to be even a little complacent. A few may say why the programme was deferred on last day as we were all prepared. Thanks to all for the extraordinary preparations despite of acute time constraint but we have also to be ready for such type of things without affecting our preparations even a little. No doubt that the notice of any programme is never served only for the sake of service but it is served with the determined intention of following the programme to achieve our goals in the interest of the cadre. Our goal is never "merely to observe the programme or bring a stage to stop the dialogues" with concerned authorities but our goal particularly in r/o any agitational programme is always to mount the required pressure on the authorities to make them serious about us. No doubt also that last hour deferment always place us in very inconvenient position but we have to bear it and be ready as per the demand of the circumstances. A few may not like it but others may appreciate it as a mature and wanted step. But we have never to feel ill, demoralised, disheartened or disappointed. We have instead to be well prepared for the next programme with even more zeal & enthusiasm to show the utmost unity & solidarity in the interest of the cadre.
Accordingly, it is requested that maximum number of officers may kindly gather at Jantar Mantar in Delhi on 12.04.13 in the UNIFORM to proceed to FM's residence at 19, Safdarjung Road, New Delhi-110011. If anybody is not having uniform, he/she may arrange it from somewhere or come even without uniform. All of the participants have to apply for leave on some personal grounds because administration may not grant the leave for this purpose.  
We should also have started the collection of the "resignation letters" from the members to give the clear message to the administration upto top level. This message of collection of the "resignation letters" will certainly have an extra positive impact on administration to make them "really serious" for us.
SO, FRIENDS, KINDLY BE WELL PREPARED FOR THE PROGRAMMES OF 12.04.13 & 30.04.13.

AIACEGEO- DEFRMENT OF AGITATION

Subject: Deferment
Dear friends,

Good evening.
Both of the Associations (Superintendents and Inspectors) were called by the Board today. First meeting was held with the Member (P&V) alongwith DG & ADG of HRD to request the Associations to defer/withdraw the programme. The Associations said that both would sit together before giving any final reply. After it, both Associations sat together and discussed all ‘if & buts’ and decided to defer the programme for the time being as a combined decision. Then again, both sat with Member (P&V) and further with the Chairperson.
Chairperson was of the views that we don’t know how much revenue we would lose by our strike or how much we gain by attending the office but at least this is the time to stand in support of FM to give him the due message to get our work done from him without any adamant attitude. We were intimated by both that the Cadre restructuring file is already on the table of FM after clearance by RS. They assured that the same would be pursued with him and, in all probabilities, a positive decision by him is very much expected after his return from abroad. The Board and RS have recommended the revival of the 4896 posts of AC/DC which were scaled down to 3600 during the 1.3.12 meeting between the then FM and DOPT Minister. After clearance by the FM, the file will go to the DOPT/cadre review committee. They further assured that the FM would also be pursued to get the same cleared by DOPT/cadre review committee by using his influence. It was also clarified by the top brass that the need to send it again to the Expenditure will also expectedly be covered in FM’s clearance. They also expected that the cadre restructuring of both, CBEC & CBDT, would be cleared together by the cabinet.
As regards other demands of the Association, it was assured that all of the issues would be dealt with priority now onward. DG, HRD was directed to write to the UPSC and pursue the matter for holding of the DPC for promotion to the existing vacancies of Asstt. Commissioner at the earliest. The concerned DS was also directed to immediately issue the letter regarding not to offset ACP benefit with time scale. He was also directed to take necessary action on the Board letter issued under the signature of Sh. Dharmvir Gupta for payment of arrears to our officers (then Inspectors) since 1986 at par with the Inspectors of CBI and IB. He was also directed to put up the letter sent by the Expenditure in regard of anti-dating of the pay scale of the Superintendents. It was also assured that the action on the other issues as discussed in the meeting of 31.1.13 would also be taken and a further meeting would be held soon before expiry of 3 months.
Accordingly, both the Associations took the decision to defer the programme of 29-31.3.13 for the time being. As far as the programmes of 12.4.13 (to march to the residence of FM in uniform) and 30.4.13 (mass resignations) are concerned, the same stand as it is if no further change happens in the situation.
The Association appreciates and thanks all of its units and members for the all united and strong message given by them to the concerned authorities. All are requested to kindly keep the morale and spirit ever high and be prepared for every future programme, if all of our grievances are not redressed within due time. Some may not be happy with this deferment and some other may be satisfied & happy considering it a mature step as per the circumstances. Despite of the possible diverse ideologies, all are requested to be ‘all united’ to give them the ‘strongest’ message in future too. The actual aim to mount the required pressure on them was fulfilled in a very remarkable manner, all are thanked very much to show the required spirit despite of the ‘acute time constraint’. All of us, who were active for the cause of cadre, really deserve ‘high kudos’.

THE ALL INDIA FEDERATION OF CENTRAL EXCISE EXECUTIVE OFFICERS


An eight member co-ordination committee of the two Associations representing Superintendents and Inspectors of Central Excise has been formed at a meeting of both Associations at New Delhi on 16.03.2013, as a precursor to the formation of  Federation of  the All India Central Excise Inspectors’ Association and the All India Association of Central Excise Gazetted Executive Officers’ Association.

The Co-ordination Committee shall consist of eight members , four nominated from each Association. The following members have been nominated :

The Secreatries General of  the two Associations shall be the Joint
Convenors  of the Co-ordination Committee.


The following points were  further decided upon:

All decisions  shall be arrived at by the Co-ordination Committee by consensus only.
All communications of the Coordination Committee shall be made jointly under signature of both the Joint Convenors.
A Joint Communiqué shall be issued shortly by the Joint Convenors announcing formation of the Co-ordination Committee, and calling for immediate formation of such Committees immediately at the Zonal and /or Commissionerate levels too.   
The Demands from the Superintendents’ side is already laid down, and the same from the Inspectors’ side shall be specified very shortly. Following this both can be amalgamated and formed into a single common Charter.

The Superintendents’ Association requested the Inspectors’ Association to join in their agitation as per following programme :
  1. Not attending office on the 29th, 30th and 31st of March 2013, defying CBEC’s orders.
  2. Formation of a human chain at Jantar Mantar or any other appropriate venue in New Delhi of more than  a thousand officers in uniform on 12th  April’13 demanding immediate fulfillment of our Demands. Participating officers will take a day’s C L on that day.
  3. Submission of mass resignation by all members on 30th April’13.
The Secretary General of AICEIA replied that he will have to consult other office bearers of his Association and that he  will revert on the matter  at the earliest.

A Drafting Committee has to be constituted latest by March 25th , 2013 to prepare bye-laws for the proposed Federation.  

On 25th and 26th of May’13 an AEC meeting of the AIACEGEO is proposed a Patna. The formation of the Federation can be finalized then, with approval of the bye-laws, and all other necessary formalities.

For the proposed Federation, the Superintendents’ Association has  proposed the name All India Federation of Central Excise Executive Officers.

Good morning.
Hope that all of the units should have served the notice to the respective CCA for 29-31.3.13 programme. If any unit/s is/are yet to serve the notice, the same may kindly be done immediately without any complacence. Any weak message from any of the corners may not serve our purpose. All the units are requested to send the copy of the notice to All India Body as well as the zonal office bearers of their zone immediately. All the zonal office bearers are also requested to monitor the situation and have the copy of the notice from each of the units of respective zone to kindly forward the same to the All India Body.
We have also to understand that mere “serving of notice or issuing circular” would not do but the members are to be contacted “person to person” for wanted result. We have also to be careful of the tactics of the administration of spreading the rumours that we have deferred our programme. They are spreading this rumour with the help of lower formations. So, kindly be careful as we have not deferred the programme. If so happens due to any of the circumstances under consultations with the Inspectors Association, the same will be intimated to all immediately but kindly don’t believe the rumours being spread by the administration.
Every unit is also requested to observe the situation in the neighbouring units and intimate to All India Body accordingly. All the units having weak response (if any) from the members on account of any factor/apprehension/time constraint/circumstance are also requested to intimate to All India Body accordingly without any hesitation because hiding of the factual position may be detrimental to our interests. The notices for agitation are never served only for the “sake of serving” but the same should also be followed with full spirit. If any of the office bearers of any unit is not acting accordingly to follow the programme, he/she has no moral right to be the office bearer. Such posts in the Association are never to be bore only for the sake of “decoration”. To make efforts is in our hands without being worried about the result but not to make efforts is never pardonable.
IT IS AGAIN REQUESTED THAT THE FACTUAL POSITION MAY KINDLY BE INTIMATED TO THE ALL INDIA BODY WITHOUT ANY HESITATION.

Press statement of Mr Ravi Malik, SG , AIACEGEO

New Delhi: About 30,000 officers of Central Excise and Customs will observe a 3-day nationwide strike beginning March 29, protesting against the working conditions and "delayed" promotions.

"The Inspectors and Superintendents of Central Excise will observe a countywide 3-day strike between March 29 and March 31 against the apathetic and indifferent attitude of the concerned authorities," All India Association of Central Excise Gazetted Executive Officers said in a statement.

Ravi Malik Secretary General of the Association said the strike call has been jointly given by Associations consisting Superintendents and Inspectors and work at airports and factories will suffer. He added that about 30,000 officials will go on strike.

The strike call has been given in view of lack of promotional avenues and working conditions.

The decision for the strike was taken during a combined meeting of the All India Association of Central Excise Gazetted Executive Officers and All India Central Excise Inspectors Association, the statement added.

(iii) All of our officers throughout the country will submit their resignations on 30.04.13 under protest.

Charter of demands
1. Immediate implementation of the cadre restructuring without any cut as already approved by the Expenditure. All proposed posts to be approved permanently and be filled-up by promotions only alongwith all posts likely  to be lied  vacant  within 5 years of implementation of cadre restructuring without any direct recruitment in group ‘A’ during the period.
2. Parity with other counterparts of CSS, CBDT etc. either in the cadre restructuring or independent of it to retire our officers also in PB-4.
3. Immediate fulfilment of the commitments like “creation of separate service for group ‘B’ executive officers”, “promotion of group ‘B’ gazetted executive officer directly to STS like CSS”, “all Inspectors, PO’s & Examiners of same year should be brought to same level of promotion”, ‘all the vacancies of cadre restructuring to be filled up by promotions & extend this benefit for more than 1 years”, ‘minimum qualifying service for promotion to gazetted post should be uniform for Inspector, PO & Examiner” etc. etc. made during the presentation on cadre restructuring proposal on 18.01.11 in consonance of the submissions made by the Association vide its Ref. No. 13/11 Dt. 27.01.11.           
4. At least four functional promotions in the service career.            
5. Immediate implementation of the Supreme Court verdict dt. 03.08.11 by framing “just, fair & equitable” recruitment rules and abiding all the ad hoc promotions with the same duly granting notional promotions to the seniors of Central Excise whose juniors of Customs have already been promoted.
6. Initial grade pay of Rs. 5,400/- in PB3 w.e.f. the date of the grant of this grade pay/equivalent pay scale to the other analogous counterparts of IB, CBI etc.            
7. Time-scale in PB3 instead of PB2 to the Superintendents completing 4 years of service and next promotions to all Superintendents directly to the post of Deputy Commissioner (STS post) to maintain parity between the officers of headquarters organisations & field offices. Also counting of regular service in non-discriminatory manner as compared to CSS etc.            
8. At least a grade pay of Rs. 6,600-/ & 7,600/- on IInd & IIIrd MACP upgradation without offsetting with time scale on the lines of MACPS adopted by the State Governments like Uttar Pradesh etc. or even on better lines on account of the originating source (i.e., 6th CPC) being the same.             
9. Finalisation of in-situ promotion scheme under consultation of the Association.
10. Holding of regular minuted meetings under employee grievances redressal mechanism.
