Consumer price index numbers for industrial workers (CPI-IW) March 2013
According to a press release issued today by the Labour Bureau, Ministry of Labour & Employment the All-India CPI-IW for March, 2013 rose by 1 point and pegged at 224 (two hundred and twentyfour). On 1-month percentage change, it increased by 0.45 per cent between February and March compared with 1.01 per cent between the same two months a year ago.
The largest upward contribution to the change in current index came from Food group which increased by 0.84 per cent, contributing 0.82 percentage points to the total change. This was followed by Miscellaneous group with 0.53 per cent increase contributing 0.26 percentage points to the change. At item level, largest upward pressure came from Rice, Wheat & Wheat Atta, Fish Fresh, Goat Meat, Vegetable Green & non-Leafy, Apple, Tea (Readymade), Firewood, Medicine (Allopathic), Private Tuition Fee, Bus Fare, Petrol, etc. However, this was compensated by Mustard Oil, Eggs (Hen), Poultry (Chicken), Onion, Potato and Sugar putting downward pressure on the index.
The year-on-year inflation measured by monthly CPI-IW stood at 11.44 per cent for February, 2013 as compared to 12.06 per cent for the previous month and 8.65 per cent during the corresponding month of the previous year. Similarly, the Food inflation stood at 13.21 per cent against 14.98 per cent of the previous month and 8.16 per cent during the corresponding month of the previous year.
At centre level, Salem recorded the largest increase of 7 points followed by Sholapur and Quilon (6 points each). Among others, 5 points rise was registered in 4 centres, 4 points in 2 centres, 3 points in 4 centres, 2 points in 12 centres and 1 point in 18 centres. On the contrary, a decline of 2 points was reported in Jharia, Chennai, Siliguri, Mariani-Jorhat, Asansol and Kodarma and 1 point in 10 centres. Rest of the 19 centres’ indices remained stationary.
The indices of 34 centres are above All-India Index and other 43 centres’ indices are below national average. The index of Ajmer centre remained at par with all-India index. The next index of CPI-IW for the month of April, 2013 will be released on Friday, 31 May, 2013. The same will also be available on the office website www.labourbureau.gov.in.

FINANCE BILL

New Delhi, April 30 -- The Lok Sabha Tuesday passed the Finance Bill for the 2013-14 fiscal with minor amendments, even as the main opposition Bharatiya Janata Party (BJP) walked out of the house protesting against Coalgate.
The bill was passed with 12 minor amendments.
The passage of the bill effectively brought to an end the budgetary process that started with the budget speech by the Finance Minister P Chidambaram Feb 28.
The bill will now go to the Rajya Sabha and then to the president for his assent.

Ministerial panel okays hiring of 800 IRS and 18k income tax officials

New Delhi, April 30, 2013(TNN): Paving the way for launching a massive recruitment drive to hire around 19,000 tax officials across the country in the next couple of years, the group of ministers on cadre restructuring of income tax department on Monday gave its nod to the proposal of substantially increasing the strength of revenue officials.
Minister of Personnel V Narayanasamy argued that other departments may ask for increasing the strength of their respective cadres once the government allows it for income tax department.
These recruitments will take place in a phased manner. While 800 of them will be recruited as Indian Revenue Service (IRS) officers in Group A, remaining over 18,000 will be employed as Group B and Group C officials.
“The proposal will now go to the Cabinet. The recruitment drive will be launched after getting Cabinet approval,” an official said.
Sources said the GoM — comprising finance minister P Chidambaram, home minister Sushilkumar Shinde, environment and forests minister Jayanthi Natarajan and minister of personnel V Narayanasamy – also decided to extend the rank and pay of special secretaries to chief commissioners of large income tax zones and to chiefs of various directorates under the Central Board of Direct Taxes (CBDT).
It is learnt that the group of ministers gave its nod to increase the strength of IRS and other income tax officials despite opposition to it from Narayanasamy who argued that other departments may ask for increasing the strength of their respective cadres once the government allows it for income tax department.
The proposal was, however, cleared when the finance minister convincingly spoke on the merit of the decision. Ministers, during a brief meeting, agreed that the move will significantly increase the efficiency of tax administration at the time when the government is committed to increase its tax collection besides providing better and faster delivery of services.
The finance minister is learnt to have dismissed the argument that creating a higher number of senior positions would lead to problems pointing out that even states such as Andhra Pradesh had several chief secretary rank officials and there were more director general of police in place than the number of states.
He noted that his ministry was going to undertake a restructuring of roles of the officials in order to ensure a greater mopping up of taxes.
It was pointed out in the meeting that the move would not only help tax payers in getting quicker refunds, but would also detect the high net worth individuals who, at times, either escape the tax net or just end up under-paying taxes.

WHEN DA WILL REACH TO 100%---------------WHAT WILL BE HAPPENED?

At present DA is  80% level. We can expect that it will reach to 100% level near future.
The  aiacegeo  opined that the Dearness allowance which the cg employees are receiving now is not enough to meet the price rise of essential commodities. 
The retail price of those commodities which go into making of minimum wage have risen by about 160% between 1.1.2006 to 2011 in comparison to D.A. compensation, which on the date had been just 51%
The sixth pay commission recommended that Whenever the DA reaches 50% level , Some allowances have to be increased by 25 % . Where as in Fifth CPC , it had been recommended when the DA reaches 50 % it should be merged with Basic Pay. It has been implemented with effect from 2004. And the fifth cpc also recommended that the Pay and Allowance should be revised after every five years. But it was not accepted by the Government. The objectives of increasing Allowances by 25% as per the 6 CPC or merging DA with Basic pay as in the case of 5CPC, when ever DA reaches 50%, is to make the central government employees to balance the financial burden caused by Price Rise through increasing their pay package.
According to fifth CPC the 50 % DA had been merged with Basic Pay and in 6CPC , some allowances have been increased by 25%. But 5CPC didn’t say anything about what should be done when DA touch 100% level. Because the govt servants receiving their pay as per pre revised pay were not granted merging of another 50% of DA in 5CPC scale.
Even after the rate of DA is increased to 50% level it is not enough to increase some allowance by 25% as it will not help to handle the expenses caused by inflation. So AIACEGEO is likely to  demand that Govt.  should constitute 7th pay commission immediately.

Merge 50% Dearness Allowance with Basic Pay or Constitute 7th Pay commission .

Somehow, the most eagerly awaited dearness allowance has been announced on Thursday, last week. The Finance Ministry’s order for granting dearness allowance has to be issued soon. Generally the announcement of dearness allowance has been made in the month of March every year. But this year this has been declared in the month of April. Though it was announced after some delay, it won’t cause any loss, as the dearness allowance hike has to be paid with effect from 01-01-2013. Before this announcement, there was a rumor that 50% dearness allowance will be merged with basic pay or otherwise dearness allowance will not be hiked, but the cabinet committee decision cleared these doubts.
Even the National anomaly committee, after six years it was formed, has not solved all the problems raised due to the implementation of 6 CPC.
So, to find the solution to all these financial problems of govt servants,  All India  Association of Central Excise Gazetted Executive Officers   is likely to  demand to merge the 50% DA with basic pay and to constitute the 7th pay commission at the earliest. Through this, the problems which are arising out of implementation pay commission can be solved without any delay. After the implementation of 6CPC in 2008 with effect from 01.01.2006 , arrears had to be paid to govt servants. To avoid the additional financial burden , the govt decided to pay the arrears’ in two installments in 2008 and 2009. For this, government had to allocate more fund from budget. It can be avoided by constituting  7th pay commission  at the earliest and implementing it in time.

2. One more meeting was held with the Member (P&V) on 18.04.13. Discussions were also held with DG, HRD. Keeping in view the positive developments in cadre restructuring and maintain positive atmosphere, the mass resignation programme of 30.04.13 is now being deferred. However, it is not the end of the road. Our ultimate aim is parity with common entry counterparts. We may have discussions on agitational programme in the forthcoming AEC meeting.
3. The new sanction strength from AC/DC to Principal CC level has already been communicated to all. The increase (in addition to existing strength) at Superintendent and Inspector level is as follows-

Subject: Consolidated guidelines on cadre review of Central Group ‘A’ Services.

The undersigned is directed to say that provisions governing the process
of cadre review of Central Group ‘A’ Services are contained in various Office Memoranda issued by the Department of Personnel and Training and the Department of Expenditure. As a part of this Department’s endeavour to keep the personnel policies relevant to current and future needs, these provisions have been reviewed in consultation with various stakeholders and it has been decided to issue a consolidated and revised set of guidelines on cadre review. The revised guidelines are given below. Besides, the broad issues concerning cadre review have been elaborated in the revised Monograph on Cadre Review of Central Group
‘A’ Services enclosed herewith. The list of existing Central Group ‘A’ Services is at Annex-I.

2. Formulation of Proposal
(i) The proposal would be formulated, to the extent possible, in consultation with the representatives of service association (s). While drafting the proposal, all issues like expected changes in the Organization’s activities, automation, amendment in the business processes, recruitment planning, plugging the skill gaps, cadre structure, career progression, financial implications etc. must be analyzed and made part of the proposal. These issues and their impact on cadre
structure have been discussed in Section-5 and Section-6 of the Monograph.

(ii) Full functional justification for each creation of post/upgradation should be given. A job evaluation exercise may be undertaken for each category of posts so as to ensure that different grades are assigned corresponding level of functions and responsibilities.

(iii) It may be ensured that the cadre review would not have an adverse impact on the feeder grade.

3. Reference to Department of Personnel and Training/Department of Expenditure

(i) The proposal should be referred to Department of Personnel and Training with the approval of Integrated Finance Division and the Minister in charge.
(ii) The Cadre Controlling Authority would also give a certificate that there is no Court Case pending having a bearing on the cadre review.
(iii) The name (s) of contact officer (s) for further/additional information may be clearly indicated in the reference.
(iv) The proposal should be examined vis-à-vis the checklist given in Section-6 of the Monograph to ensure that the proposal is complete in all respect.

4. Financial Implications
(i) The proposal having additional financial implications would be entertained strictly on functional considerations like consistent increase in workload, horizontal expansion in activities etc.
(ii) While calculating the additional expenditure, the impact of Non-Functional Upgradation may be taken into account. The calculation sheet must be enclosed with the proposal.

5. Procedure for cadre review
(i) Every cadre should be reviewed once every five years. The review should be first carried out by the Cadre Controlling Authority, preferably in consultation with the representatives of the service/cadre in question. However, if it is convinced after such a review that no change in the cadre structure is required, the decision should be conveyed to DoPT with the approval of Minister in charge.
(ii) The cadre review proposal would be prepared by the Cadre Controlling Authority in the form of a Note for Committee of Secretaries. DoPT would obtain the approval of Secretary (P) and then refer it to Department of Expenditure for approval of Secretary (Expenditure).
(iii) The Note would then be placed before the Cadre Review Committee by DoPT.
(iv) Based on the recommendation of Cadre Review Committee, the proposal would be submitted for MOS (PP)’s approval. It would then be referred to the Department of Expenditure for Finance Minister’s approval.
(v) The Cadre Controlling Authority would then take approval of Cabinet. The Note for Cabinet should ideally be prepared within a month of the Cadre Review Committee’s approval.

6. Composition of Cadre Review Committee-T The Cadre Review Committee would comprise the following functionaries:

(i) Cabinet Secretary Chairman
(ii) Secretary of the Ministry controlling the cadre Member
(iii) Secretary, Department of Personnel and Training Member
(iv) Secretary, Ministry of Finance, Department of Expenditure Member
(v) The senior most member of the service/cadre concerned Member

7. Restriction on direct recruitment-

There is a restriction on direct recruitment to the extent that it should not exceed 3% of the total cadre strength.

The authority to relax the condition rests with DoPT. It has now been decided to do away with this restriction. The Cadre Controlling Authorities are, however, advised not to resort to any bulk recruitment as it would create a bulge in the structure leading to stagnation at later stage. This may be kept in view while projecting recruitment planning.

Existing cadre strength of total GR-A posts ( Organised) in CBEC is at present  2485. FM proposed for 6104 , thus there is an increase of total 3619 posts.   FM accepted the cuts made by DOPT in respect of JC/ADC, Commissioner +/ CC+,
but inrespect of AC/DC (initially Board proposed for 4896, DOPT suggested for 3600)    FM proposed for 4668, thus there is an increase of 3118 posts.   ... The most important issue is during the next 5 years the nos of DR    is to be restricated to 150 (2. 5 % of the total cadre strength)    This is applicable to new posts to be created and vacncies
within 5 years of implementation of CR.

CADRER RESTRUCTURING PROPOSALS OF CBEC

Now, all should have been aware of the approval of the cadre restructuring proposal by the FM yesterday on 12.04.13 in the evening. The problem on the issue was the requirement of the functional justification for the posts/vacancies above the level of 3600 (AC+DC) (in r/o our case) after the agreement of 01.03.12 between the then FM and DOPT Minister. The change in the scenario of functional requirement after 01.03.12 was to be depicted in emphatic manner.  
As a result, it is being listened that the approval for the following numbers has been done-

Sub- ‘Agitation against delay in Approval of Cadre Restructuring, &  other related issues’.



The All India Association of Central Excise  Gazetted  Executive Officers , the organization representing about 11,800 Gazetted Executive  Officers of the Central Excise, Customs and Service Tax   Department, has embarked upon an agitation programme from 25/09/2012, demanding immediate approval of Cadre Restructuring proposal of CBEC without any cut as cleared by the D/O Expenditure, granting of GP-5400 in PB-3 to the grade of Superintendent of Central Excise w.e.f 01.01.2006 , introduction of in situ scheme to remove stagnation etc etc.. The department is already facing acute shortage of manpower both at the staff and officers level, especially at the cutting edge level i.e. Assistant Commissioners who are playing a very crucial role in revenue collection.
The Public Accounts Committee in its 79th Report has interalia stated that “. The Committee feel that the staff requirement be examined on priority basis by the  Finance Minister  in order to ensure that the Service Tax collections, which have increased phenomenally from Rs. 407 crore in 1994-95 to Rs. 97,389 crore in 2011-12 does not suffer for want of human resource.
Near about 8000 nos. of Superintendents  have completed 30 year of services as Inspectors and Superintendents combinedly at present  and waiting for their promotion to Gr-A. The Inspectors who are joining in the department as direct recruit  are retiring by getting one promotion to the grade of Superintendent  in their service career. Whereas those similar placed employees who are joining in Income Tax department or in CSS or as Examiner in Customs are getting almost 5 to 6 promotions in their service career, While 1992 batch Examiners are being promoted to the grade of Asst. Commissioner, the 1975 batch Inspectors are still Superintendents and are being forced to work under the 1992 batch of Examiners who are quite juniors  to them in service. The parity is the basic concept of our Constitution, parity in promotion is required to be maintained amongst the similar placed employees of same department, but till date the Govt. of India have not initiated any action to maintain parity in promotion amongst the Examiners/Preventive Officers and Inspectors of CBEC. The educational qualification, mode of recruitment and Grade Pay for these post are similar. The Examiner, Preventive Officers and Inspectors are being recruited by the same examination conducted by SSC. The Honourable Apex Court have decided that one should at least get 3 promotions in his service career. But Govt have not allowed two promotions to the cadre of Inspector of CBEC.. Major revenue of Govt. of India are being collected  through CBEC. Inspectors and  Superintendents are basically responsible for collection of such major revenue. But these officers are not being awarded at least two promotions in their service career and are not being granted with appropriate pay as has been granted to similar placed employees of Central Govt.
           
            Considering the utter frustration of  Superintendents  who are languishing without any promotion for around 18/20 years and being forced to work under  their natural juniors by 17 years, AIACEGEO had served a notice dated 02.04.13 , on the Finance Minister of India  informing about the proposed agitation  to be held  on  12.04.13 , if  all the 10 points charter of demands are not accepted  immediately.
  The copy of  Notice  served upon the Finance Minister of India on 02.04.13 by Secretary General  relating to such proposed agitation is  reproduced below for your perusal.

2. It is submitted with due regards that our officers are retiring in PB2 after getting only one promotion in the service career while other common entry counterparts of ours are retiring in PB4 after getting 5-6 promotions. We are deprived of the appropriate pay scale/pay band & grade pay and facing the worst career prospects. Our officers are getting promotion (if any) merely to Junior Time Scale while other counterparts of CPWD, CSS etc. are getting to Senior Time Scale. The employee grievance redressal mechanism has totally failed. We are forced to work under the extreme juniors of Customs belonging to the same cadre. All of our officers are totally demoralised and have nothing to be job-satisfied or motivated. If career prospects were disclosed in the recruitment advertisement, we would have never joined this job. The rights to grow, make progress and live with dignity have been snatched from us. There is no change in the scenario till date despite of the decades-long representations, pleadings and requests of the Association and also our duties being performed by us like the most obedient & responsible employees. It is, therefore, intimated that-
 (i) The officers from all over India will gather at Jantar Mantar in Delhi on 12.04.13 at 11 a.m. in their uniform and proceed to gather around the residence of your goodself to submit the Memorandum. 
(iii) All of our officers throughout the country will submit their resignations on 30.04.13 under protest.

Charter of demands
1. Immediate implementation of the cadre restructuring without any cut as already approved by the Expenditure. All proposed posts to be approved permanently and be filled-up by promotions only alongwith all posts likely  to be lied  vacant  within 5 years of implementation of cadre restructuring without any direct recruitment in group ‘A’ during the period.
2. Parity with other counterparts of CSS, CBDT etc. either in the cadre restructuring or independent of it to retire our officers also in PB-4.
3. Immediate fulfilment of the commitments like “creation of separate service for group ‘B’ executive officers”, “promotion of group ‘B’ gazetted executive officer directly to STS like CSS”, “all Inspectors, PO’s & Examiners of same year should be brought to same level of promotion”, ‘all the vacancies of cadre restructuring to be filled up by promotions & extend this benefit for more than 1 years”, ‘minimum qualifying service for promotion to gazetted post should be uniform for Inspector, PO & Examiner” etc. etc. made during the presentation on cadre restructuring proposal on 18.01.11 in consonance of the submissions made by the Association vide its Ref. No. 13/11 Dt. 27.01.11.           
4. At least four functional promotions in the service career.            
5. Immediate implementation of the Supreme Court verdict dt. 03.08.11 by framing “just, fair & equitable” recruitment rules and abiding all the ad hoc promotions with the same duly granting notional promotions to the seniors of Central Excise whose juniors of Customs have already been promoted.
6. Initial grade pay of Rs. 5,400/- in PB3 w.e.f. the date of the grant of this grade pay/equivalent pay scale to the other analogous counterparts of IB, CBI etc.            
7. Time-scale in PB3 instead of PB2 to the Superintendents completing 4 years of service and next promotions to all Superintendents directly to the post of Deputy Commissioner (STS post) to maintain parity between the officers of headquarters organisations & field offices. Also counting of regular service in non-discriminatory manner as compared to CSS etc.            
8. At least a grade pay of Rs. 6,600-/ & 7,600/- on IInd & IIIrd MACP upgradation without offsetting with time scale on the lines of MACPS adopted by the State Governments like Uttar Pradesh etc. or even on better lines on account of the originating source (i.e., 6th CPC) being the same.             
9. Finalisation of in-situ promotion scheme under consultation of the Association.
10. Holding of regular minuted meetings under employee grievances redressal mechanism.

Dear friends,
good morning.
 We all know that the programme of 29-31.03.13 has only been deferred and the programmes of 12.04.13 AND 30.04.13 ARE AS "IT IS" WITHOUT ANY CHANGE. We have not to be even a little complacent. A few may say why the programme was deferred on last day as we were all prepared. Thanks to all for the extraordinary preparations despite of acute time constraint but we have also to be ready for such type of things without affecting our preparations even a little. No doubt that the notice of any programme is never served only for the sake of service but it is served with the determined intention of following the programme to achieve our goals in the interest of the cadre. Our goal is never "merely to observe the programme or bring a stage to stop the dialogues" with concerned authorities but our goal particularly in r/o any agitational programme is always to mount the required pressure on the authorities to make them serious about us. No doubt also that last hour deferment always place us in very inconvenient position but we have to bear it and be ready as per the demand of the circumstances. A few may not like it but others may appreciate it as a mature and wanted step. But we have never to feel ill, demoralised, disheartened or disappointed. We have instead to be well prepared for the next programme with even more zeal & enthusiasm to show the utmost unity & solidarity in the interest of the cadre.
 Accordingly, it is requested that maximum number of officers may kindly gather at Jantar Mantar in Delhi on 12.04.13 in the UNIFORM to proceed to FM's residence at 19, Safdarjung Road, New Delhi-110011. If anybody is not having uniform, he/she may arrange it from somewhere or come even without uniform. All of the participants have to apply for leave on some personal grounds because administration may not grant the leave for this purpose.  
 We should also have started the collection of the "resignation letters" from the members to give the clear message to the administration upto top level. This message of collection of the "resignation letters" will certainly have an extra positive impact on administration to make them "really serious" for us.
 SO, FRIENDS, KINDLY BE WELL PREPARED FOR THE PROGRAMMES OF 12.04.13 & 30.04.13.

Dear Comrades,
           As the  Cadre Review & Restructuring will provide adequate staff & officers, moreover if all the demands as raised by AIACEGEO will be accepted then all most all  employees of CBEC  will be benefited . Further these demands will surely boost the Revenue, which is primary for sustaining the developmental work undertaken by the Government.
Therefore,  I request  all the employees of Central Excise, Customs and Service Tax Department to join in the agitation and join in march to FM house from Jantra Mantra , New Delhi on 12.04.13 to submit representation and make such agitation a grand success.
