The Central  Government is likely to notify the the pay commission within the next two months The timing is in such a way that it is well before the model code of conduct for the general elections comes into force. Such a move will bring a positive mood for the central government employees towards the government. Additionally the Center is expected to give the panel enough time to prepare its report in the hope that the government would be a lot more comfortable vis-a-vis the fiscal deficit by the time the panel submits its report.Government employees have also asked the Center to consider merging dearness allowance with their pay, arguing that the Sixth Pay Commission, like the Centre, could not have anticipated the high inflation that has eroded real wages over the last decade. The demand was made at a preliminary meeting held between the department of personnel and the employee representatives to discuss the proposed Seventh Pay Commission. It is learnt that the present Secretary Expenditure, R S Gujral, is likely to be appointed Member-Secretary of the 7th Pay Commission. The 1976 batch IAS officer of Haryana cadre Gujral is retiring on November 30th  2013. Shri Gujral was also Secretary ( Revenue) and having sufficient experience on functioning of CBEC & CBDT.

IMMEDIATE APPROVAL OF CR OF CBEC.

  • AIACEGEO today urged Prime Minister Dr.  Manmohan Singh again  to immediately approve the CR proposals of CBEC  at the next cabinet meeting.The All India Association of Central Excise  Gazetted  Executive Officers , the organization representing about 11,800 Gazetted Executive  Officers of the Central Excise, Customs and Service Tax   Department, demands for  immediate approval of Cadre Restructuring proposal of CBEC  in the next cabinet meeting  of Govt. of India without any further delay. The Central Excise and Customs Department was created during pre Independent era, whereas only one cadre restructuring was approved by the Union Cabinet during 2001 for this department. As per Cadre Restructuring procedures it is mandatory for approval of CR in every five years block.  The CR which is due since 2006 is yet to be approved by Union Cabinet. Due to non approval of CR, the level of stagnation including inter cadre and intra cadre disparity in promotion has been increased drastically.   The Inspectors who are joining in the department as direct recruit  are retiring by getting one promotion to the grade of Superintendent  in their service career. Whereas those similar placed employees who are joining in Income Tax department or in CSS or as Examiner in Customs are getting almost 5 to 6 promotions in their service career, While 1992 batch Examiners are being promoted to the grade of Asst. Commissioner, the 1975 batch Inspectors are still Superintendents and are being forced to work under the 1992 batch of Examiners who are quite juniors  to them in service. The parity is the basic concept of our Constitution, parity in promotion is required to be maintained amongst the similar placed employees of same department, but till date the Govt. of India have not initiated any action to maintain parity in promotion amongst the Examiners/Preventive Officers and Inspectors of CBEC.  The educational qualification, mode of recruitment and Grade Pay for these posts are similar. The Examiner, Preventive Officers and Inspectors are being recruited by the same examination conducted by SSC. The Honourable Apex Court have decided that one should at least get 3 promotions in his service career. But Govt have not allowed two promotions to the cadre of Inspector of CBEC.  Major revenue of Govt. of India is being collected  through CBEC. Inspectors and Superintendents are basically responsible for collection of such major revenue. But these officers are not being awarded at least two promotions in their service career and are not being granted with appropriate pay as has been granted to similar placed employees of Central Govt.
 Finance Minister P Chidambaram and Chairperson CBEC Praveen Mahajan

Lokanath Mishra President AIACEGEO,  therefore  issued one press statement again  on today and  appealed to the Prime Minister of India and the Union  Finance Minister to take an early decision for approval of CR of CBEC  in the next cabinet meeting without any further delay.

EARLY APPROVAL OF CR OF CBEC & APPOINTMENT OF CHAIRMAN AND OTHER MEMBERS OF 7TH CPC.

AIACEGEO today urged Prime Minister Mr.  Manmohan Singh to immediately approve the CR proposals of CBEC and  appoint chairman and other members of the recently-announced 7th Pay Commission at the next cabinet meeting.

The AIACEGEO President said early notification for approval of CR of CBEC and  appointing chairman and other members of the commission is the need of the hour, which is bound to have bearing on about  65,000 employees of Central Excise and Customs Department.

Sub:Regularisation of ad hoc promotions.
Madam,
            Kindly refer to your D.O. letter No. A-32012/16/2013-Ad.II Dt. 21.10.13 addressed to the Chief Commissioners of field formations.
2. As gone through the enclosures to above D.O. letter, it is submitted with due regards that all of the officers mentioned in the list have already retired. It is doubtful that their ACR’s & other related documents would be available with the concerned Chief Commissioners. Moreover, their ACR’s & other related documents/record were also sent to the concerned section of the CBEC at the time of their promotion to group ‘A’. All of these ACR’s and other related documents/record should be available with the concerned section which may kindly be used for long pending regularisation without further delay. It is also worth to mention that the process has already delayed in very terrible manner.
3. Year-wise DPC will further delay the process. Therefore, the DPC may kindly be conducted in a single lot as a special case.
4. No regular DPC was conducted for the said promotions. Therefore, the RR’s existing as on the date of the regular DPC may kindly be made applicable because the earlier RR’s have already been repealed.
5. The provisions of the extended panel were not implemented at the time ad hoc promotions. Therefore, these provisions may also kindly be implemented to the DPC to be held in the single lot on the basis of the RR’s existing as on the date of the regular DPC.
6. In view of the above, it is requested that the DPC for regularisation may kindly be conducted immediately without further delayin the single lot in accordance of the RR’s existing as on the date of the regular DPC duly applying the provisions of extended panel on the basis of the ACR’s & other related documents/record already available with the concerned section.
Thanking you,
Yours faithfully,

Sub: Promotions against the existing vacancies of Asstt.Commissioner.
Madam,
            As you know, it is submitted with due regards that the current process of the DPC against the existing vacancies of Asstt. Commissioner was initiated in July, 2013. But it is very unfortunate that we are unable to grant the much awaited rare of rarest IInd promotion in the career of our officers (Central Excise Superintendents) at the fag end of the career and they are forced to retire without being promoted. Even more unfortunate is that the last DPC for the said post was held in June, 2012, i.e., around one & half years ago and we are unable to hold the DPCat the prescribed interval after it. Only Central Excise executive officers are being preyed by this delayed process on account of being close to the fag end of their career. The matter was first delayed by the inaction of the concerned section and then by field formations and now it is pending with the UPSC.
2. In terms of consolidated RR guidelines issued vide DOPT OM No. AB 14017/48/2010- Estt (RR) Dt. 31.12.10, the UPSC needs not be associated in r/o the posts where the promotion is based on non-selection method (Para 3.13.4), i.e., as per the seniority with reference to the benchmark ‘not below good’ {DOPT OM No. 35034/7/97-Estt(D) Dt.08.02.02}. The said OM dated 08.02.02 also makes it clear that promotion by selection method is to be made with reference to the benchmark ‘good’ and a person is not to be superseded unless found unfit by virtue of‘below good’ benchmark.Thus the distinction between selection and non-selection method for promotion has been done away as both seek promotion based on benchmark of ‘good’.
3. Apart from aforesaid DOPT guidelines dt. 31.12.10 providing exemption from consultation with UPSC, the UPSC (Exemption from Consultation) Regulations, 1958 as amended seeks to provide exemption from UPSC associationfor promotion/recruitment to various posts & services (all group A promotions within group A, all group B & C posts among others) includinggroup B officers of CSS for promotion to groupA posts by selection method (no distinction between the two methods as above).
4. In CBEC(Department of Revenue), 50% posts in group A (JTS) or as fixed under RR’s are to be filled by promotion from group B (Gazetted) officers (Superintendent of Central Excise etc.) by the selection method, i.e., based on ‘good’ benchmark. The association of UPSC has been made mandatory by CBEC for DPC for promotion from group B to group A (JTS) as per the RR’s despite of the fact that there exists no difference between selection and non-selection criteria of promotion and that the counterparts of CSS have been exempted from UPSC association vide DOPT OM dt. 30.07.08 (GSR dt.07.10.09). It takes months to get the dates from UPSC for DPC and the Central Excise Superintendents retire before getting rare of rarest IInd promotion in the life.
5. It is, therefore, requested that the DPC for promotion from group B to group A may kindly be exempted from consultation with UPSC and the current DPC may be conducted in expeditious manner.Either the UPSC may be urged to grant exemption under S. No. 22 of the Schedule-I to the said regulations or DOPT may grant it specifically as granted to CSS & others so that the eligible group B officers of CBEC

may get timely promotions without waiting for months or getting retired without promotion due to unavailability of dates from the UPSC. It will also lower the burden of UPSC. It is worth to mention that 50% of the officers from the list of the Central Excise Superintendents to be considered for the current DPC have already retired and some more will retire in the end of this month without promotion.
Thanking you,
Yours faithfully,

Sub: Specific amendment in the RR’s in r/o cadre restructuring.
Madam,
As you know, it is submitted with due regards that the Central Excise Superintendents are forced to retire only after one promotion in the career after joining the job as Inspector on account of extraordinarily acute stagnation. It is worth to mention that the Customs side officer, i.e., Appraiser of 2002 has already entered into group A while the Central Excise Superintendent of 1992 is still waiting for the same. It is further submitted that 2118 posts of Asstt. Commissioner are going to be created on temporary basis under the ensuing cadre restructuring. The officers promoted to these posts will not get further promotion on account of temporary nature of the posts.
2. The names of such officers may also not figure in the seniority list on account of temporary status. So, all of these temporary posts may be used for the acutely stagnated category of employees, i.e., Central Excise Superintendents to give some consolation to them at the fag end of the career because they will neither be eligible for further promotion nor their names will figure in the seniority list of group A officers. All of these temporary posts may be utilised only for the Central Excise Superintendents until 2002 Central Excise Superintendents also enter into group A. For this purpose of all of the proposed temporary posts of Asstt. Commissioner to be utilised fully for the promotion of the acutely stagnated Central Excise Superintendents, due amendment will have to be made to the RR’s.
3. In view of the above, it is requested that the specific amendments may kindly be made in the relevant RR’s to utilise all of the temporary posts of the Asstt. Commissioner only for the promotion of Central Excise Superintendents.
Thanking you,
Yours faithfully,

 (RAVI MALIK),
Secretary General.

Deputy Secretary (JCA)

Record Note of the meeting held Qn 24.10.2013 at 3.00 PM to discuss the possible Terms of Reference (ToR) for the 7th CPC with the representatives of the Staff Side of JCM

A meeting was held on 24.10.2013 at 3.00 PM in Committee Room No 190, North Block under the chairmanship of Dr S.K.Sarkar, Secretary DOP&T to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission, which is going to be set up by the Government, with the representatives of the Staff Side of JCM. List of Participants to this meeting is at Annexure I.

At the outset, Secretary (P) welcomed the Staff side representatives and thanked them for attending this meeting on a short notice. He indicated that since this meeting has been convened to discuss the possible Terms of Reference (ToR) for the 7th Central Pay Commission, he hoped that the discussions would remain so focused.

Sh Umraomal Purohit, Secretary, Staff Side, in his opening remarks stated that it would have been preferable that there was a proposal from the official side on this issue to the Staff Side and then the same could have been discussed further in a meeting where the Finance Secretary could also be invited. He then pointed out that the new concept of Pay Bands and Grade Pay structure as per the 6th CPC, which changed the pay structure in Government, had resulted in a new experience which was mixed. He stated that though the 6th CPC did not recommend merger of DA with Pay, they could not have anticipated such a high rate of inflation which resulted in such high rate of DA; the rate of Dearness Allowance presently was 90% and due to high inflation there was a need to consider merger of a part of DA with Pay. He also raised the question of Interim Relief pending finalisation of 7th CPC recommendations. Shri Purohit further mentioned that anomalies of 6th CPC should be resolved on priority before 7th CPC. He also suggested that there must be some machinery which should resolve anomalies within one year of implementation of CPC report.

M.Raghavaiah, while thanking the Chairman raised the issue of anomalous situations which had arisen due to the new concept of Pay Bands and Grade Pay structure as per the 6th CPC. He suggested that the Finance Ministry should look into this aspect as to how anomalies cropped up due to this and how these can be avoided in future. He was of the view that the anomalies cases which stand referred to the Ministry of Finance need to be cleared. He referred to anomalies relating to MACP scheme vis a vis ACP scheme and resolution pending thereon required to be resolved as already discussed in the Joint Committee meetings on MACPS. He also demanded that there should be merger of DA with Pay as was agreed to in 2004. He also
pointed out that the Railway Ministry’s proposals on 6th CPC related matters presently pending with Ministry of Finance should be cleared.

The other representatives from Staff Side raised the following issues

1) Entry level pay to promotee employees at par with that admissible to Direct Recruits as was agreed in the National Anomaly Committee;

2) One of the ToR should be to set up a special bilateral mechanism to sort out anomalies arising out of Pay Commission recommendations;

3) Professional approach should be adopted in dealing with peculiarities concerning Railways and Defence civilian employees;

4) There should be parity between pre & Post CPC retirees for the purpose of pension etc.;

5) Cadre review/restructuring proposals should be delinked from the 7th CPC so that these are not delayed;

6) Wage Revision should be effective after every 5 years as in the case of PSUs;

7) If there is going to be separate CPC for the Armed Forces as had been reported in media, or if there is a representative of Armed Forces in the 7th CPC then there should be a representative of Labour in the CPC;

8) CPC should not go by “Central Secretariat” structure to make its recommendations which does not take into account specific complexities in large Government organisations like Railways, Postal Department and Defence establishments.

9) Allowances should be enhanced concurrently with the pay consequent upon Pay commission implementation.

10) Supreme Court has upheld that MACP should be in the hierarchy of the Post and also for grant of NDA in 7th CPC rates w.e.f. 1/4/2007. These judgments should be implemented to all similarly placed employees.

11) The Secretary Staff side in the end requested that a copy of Terms of Reference as proposed by the Ministry of Finance may be circulated and then another meeting with Secretary, Department of Expenditure and Department of Personnel & Training be arranged to discuss & finalise the Terms of Reference of 7th CPC.

In his concluding remarks, the Chairman thanked the participants for their views and requested the Staff Side that they may send their suggestions in writing also.
