Sub: Promotions vide Office Order No. 74/2014 of the CBEC.
Madam,
Kindly refer to the subject-mentioned order issued vide F. No. A-32012/11/2013-Ad.II Dt. 31.03.14 promoting 110 officers to the post of Asstt. Commissioner.
2. It is submitted with due regards that the promotion orders have been issued on in-situ basis despite of the DPC being conducted by the UPSC against the regular posts. Accordingly, it is being implied by the field formations that the promoted officers would perform the duties of Superintendent as in-situ Asstt. Commissioner despite of the clarification under para 5 saying that the officers have to assume the charge of Asstt. Commissioner only. Thus on account of in-situ term being used in the order, the officers are not being given the charge of the post of Asstt. Commissioner.
3. Actually instead of using the in-situ term, it should have been clearly mentioned in the orders that the officers would assume the charge of Asstt. Commissioner at their present place of posting till the issuance of their transfer orders. 
4. In view of the above, it is very much requested to kindly-
i) ask the field formations to allow the officers to assume the charge of Asstt. Commissioner at their present place of posting till the issuance of the transfer orders and
ii) in-situ term may kindly not be used for the promotion orders to be issued in the future. Instead it may kindly be mentioned in the orders that the officers would assume the charge at their present place of posting till the issuance of transfer orders.
