REORGANISATION FILE IN RESPECT OF CR -2013 OF CBEC IS STILL WITH FM.

Namaste.
                        1. Congrats to all the officers who got today the rare of the rarest IInd promotion in the career. The orders have been issued for less number of the officers perhaps due to the retirement of many of our officers who were considered for the DPC of relevant year (2012-13). Now, the CBEC should immediately conduct the DPC for the year 2013-14 as well as 2014-15 including the vacancies in r/o cadre restructuring. Not only it, the CBEC should also do many things to improve our career prospects, pay matters, working conditions etc. It is reiterated that everything is possible for us provided we are able to observe effective & complete agitation. Only agitation is the key to get our well-deserved dues in every respect.
                        2. Reorganisation file in r/o cadre restructuring has been cleared by MOS today. It reached the FM who couldn’t return to office after his press conference. Now, he is expected to come to office on 09.04.14. So, the file is expected to be approved by him on that day.

The issue now stands settled that eligible employee needs to be given MACP benefits in the promotional hierarchy only.


An affected employee had challenged the Government’s decision on grant of MACP benefit in the hierarchy of promotional grade vide his O.A. No. 1038/CH/2010 in CAT Chandigarh and that the Hon’ble CAT Chandigarh vide its order dated 31.05.2011 granted the prayer of the petitioner and directed the authorities to grant MACP benefit in the hierarchy of promotional grade. Thereafter, the Union of India represented by the Secretary, DoP&T appealed to the Hon’ble High Court of Punjab and Haryana vide CWP No. 19387 of 2011. This appeal of the DoP&T was subsequently dismissed vide order dated 19.10.2011. The Government thereafter approached the Hon’ble Supreme Court vide SLP No. 7467/2013, the Hon’ble Supreme Court dismissed the said SLP.  Recently, CAT Principal Bench has issued direction on 12.03.2014 in OA No. 864/2014 that once an order has been passed by this tribunal and it has also been upheld at the level of the Supreme Court, there is no question of waiting for an approval from any Govt. department for implementation of the same.  In view of the above, the issue now stands settled that eligible employee needs to be given MACP benefits in the promotional hierarchy only.

Subject: Regulation of pay on imposition of a penalty under CCS (CCA) Rules, 1965.

The undersigned is directed to say that the following penalties prescribed in the Rule 11 of CCS (CCA) Rules, 1965, have a bearing on the pay of the officer:

11. Penalties
Minor Penalties –
(iii a) reduction to a lower stage in the time-scale of pay by one stage for a period not exceeding three years, without cumulative effect and not adversely affecting his pension.

(iv) withholding of increments of pay;

Major Penalties –
(v) save as provided for in clause (iii) (a), reduction to a lower stage in the time- scale of pay for a specified period, with further directions as to whether or not the Government servant will earn increments of pay during the period of such reduction and whether on the expiry of such period, the reduction Will or will not have the effect of postponing the future increments of his pay

(vi) reduction to lower time-scale of pay, grade, post or Service for a period to be specified in the order of penalty, which shall be a bar to the promotion of the Government servant during such specified period to the time-scale of pay, grade, post or Service from which he was reduced, with direction as to whether or not, on promotion on the expiry of the said specified period –

(a) the period of reduction to time-scale of pay, grade, post or service shall operate to postpone future increments of his pay, and if so, to what extent; and

(b) the Government servant shall regain his original seniority in the higher time scale of pay , grade, post or service;

2. Consequent upon implementation of the recommendations of 6 th CPC under the CCS (RP) Rules, 2008 pay scale of a post/grade for below HAG level means the Pay Band and Grade Pay specified for that post. Under the CCS (RP) Rules, 2008 a Pay Band may cover Government servants in more than one Grade Pay or posts in the hierarchy. As per Rule 9 of the CCS (Revised Pay) Rules, 2008, the rate of increment in the revised pay structure is 3% of the sum of the pay in the Pay Band arid Grade Pay applicable, which is to be rounded off to the next multiple of 10. Further, as per Rule 10 of the CCS (Revised Pay) Rules, 2008, there is now a uniform date of increment, that is, l st July of the year.

3. The mode of implementation of these penalties has been clarified to individual Ministries/Departments wherever references have been received. It is now proposed to issue detailed guidelines on the issue. The regulation of pay on imposition of these penalties is in the subsequent paras:

A. Reduction to a lower stage of pay by one stage (Rule 11( iii ) all )
On imposition of a penalty under this Rule, the pay would be fixed at the next lower stage in the Pay Band. In other words, in case of reduction by one stage, the revised pay would be the pay drawn in the Pay Band at the stage before the last increment. Grade Pay attached to the post would remain unchanged. The pay will be fixed by reversing the mode of allowing increments given in Rule 9 of the CCS (RP) Rules, 2008. The formula would be:-

Reduced Pay In Pay Band = {(Pay in Pay Band+ Grade Pay) x 100/103} less (Grade Pay) (rounded off to next 10)

Pay would be Pay in Pay Band as above + Grade Pay

B. Withholding of increment {Rule 11(iv)}
As the uniform date of increment now is 1st July, on imposition of a penalty of withholding of increment, the increment(s) due on the 1st of July falling after the date of imposition of the penalty would be withheld. In case where penalty of withholding of more than one increment is imposed, increments due on 1st of July in the subsequent years would similarly be withheld. The increment would be restored at the end of the period for which the penalty is imposed.

This also applies to cases where the penalty is imposed for part of a year. For instance, if the penalty of withholding of the increment for six months is imposed on a Government servant in April 2013, then the increment falling due on 1.7.2013 will be withheld for a period of six months, that is, till 31.12.2013. The increment would be released w.e.f. 1.1.2014. In this case the next increment falling due on 1.7.2014 will also be allowed.

C. Reduction to a lower stage in the time-scale of pay for a specified period Rule 11(v)} The process of imposition of penalty of reduction by one stage under Rule 11(iii a) explained above shall be repeated for every additional stage of reduction by taking the pay arrived at notionally as pay for the second reduction, and so on. Grade Pay shall remain unchanged.

NOTE 1: It is not permissible to impose a penalty under this rule if the pay after imposition of the penalty would fall below the minimum of the Pay Band attached to the post.

NOTE 2: A Pay Band may cover Government servants in different Grade Pays or holding posts at several levels in the hierarchy. It needs to be kept in mind that reduction to lower pay scale or grade is a distinct penalty, under Rule 11(vi).Therefore, while imposing a penalty of reduction to a lower stage in the time-scale of pay under Rule 11(v) of the CCS (CCA) Rules, 1965, Disciplinary Authorities should weigh all factors before deciding upon the quantum of penalty, i.e., the number of stages by which the pay is to be reduced.

D. Reduction to lower time-scale of pay under Rule 11(vi) As a result of imposition of a penalty of reduction to lower time-scale of pay, the pay of the Government servant would be reduced to the stage of pay he /she would have drawn had he/she continued in the lower post for the period of penalty. The mode of fixation of pay in this case is similar to reversing the mode of fixation of pay on promotion. Therefore, both pay in Pay Band and Grade Pay would be reduced.

However, Disciplinary Authority has the power, in terms of FR 28, to indicate the pay which the Government servant on whom a penalty of reduction in rank has been imposed, would draw. The Government servant will be entitled to the Grade Pay of the post to which he has been reduced. Thus, the power of the Disciplinary Authority under FR 28 is limited to indicating the pay in the Pay Band applicable to the lower rank/post.

In some cases imposition of a penalty under Rule 11(vi) may also involve a change in Pay Band. For instance a Government servant holding a post in PB-2 with Grade pay of Rs.4200/- may be reduced to a post in PB-1 with Grade Pay of Rs.2800/-

It may also be noted that a Government servant cannot be reduced in rank to a post not held earlier by him in the cadre. For example, an LDC who qualifies as Assistant as a Direct Recruit and is later promoted as Section Officer cannot be reduced to the rank of LDC but only to that of an Assistant.

The Confederation of Central Government Gazetted Officers Organisations, Tamil Nadu, regional meeting was held on 22nd March 2014 in the 3rd Floor, Conference Hall ,O/o the Central Excise Main building Nungambakkam High Road, Chennai. Representatives from Audit and Accounts officers, CPWD Engineers, Railway Promotee Officers, Central Excise Officers, Pay and Accounts Officers, Defence Officers, Statistical Officers, Postal Accounts Officers, Survey Officers, Postal Officers, Customs Preventive Officers, Zoological Survey officers and Income Tax Officers, attended. Shri.S.Chandra Sekar, President, Chennai Unit & Secretary, South Zone All India Central Excise Gazetted Executive Officers Association welcomed the gathering.

Shri. Bhaskar Bhattacharya, the newly elected, dynamic and committed, Secretary General of Income Tax Gazetted Officers Association was also participated. In his address, he reiterated his as well as his organisation’s commitment to the confederation and he expressed his commitment to build a vibrant united organisation of Gazetted officers of the Central Government.

Shri.S. Mohan, Convenor, briefly explained the situation prevailing in the country in the background of appointment of 7th Pay Commission its constitution, and the developments that had taken place in the Confederation Front. He stressed the urgent need for to organise a national level convention to finalise our charter and our common memorandum to the 7th pay commission and to rejuvenate the confederation. After a detailed discussion it has been decided unanimously as follows.

1. National level one day convention will be held at Delhi on April 17th 2014 to deliberate and to decide about our future pathways and Standard Operating Procedures.

2. It will be arranged by the Income Tax Gazetted Officers Association

3. All the Federations/Associations of Group B and Promotee officers with All India Character would participate in the convention.

4. Minimum one and maximum three of the office bearers of the Each Federation/Association would be eligible to participate

5. Ratification of the decisions taken in the workshop held at Chennai in the presence of Apex level leadership of the confederation would be sought.

6. The Convention would strive for rejuvenating the Confederation by selecting/electing a suitable leadership for the confederation.

Centre issues 100% DA order

The Central government employees are entitled for dearness allowance at the rate of 100% of the basic with effect from 1 January 2014 which was approved by the Union cabinet on February 28, 2014.

Accordingly, the Finance Ministry today issued order of additional instalment of Dearness Allowance (DA) to central government employees at the rate of 10% increase over the existing rate of 90% vide F.No.1/1/2012-E-II(B) dated March 27, 2014 which would be effective from the January 1 this year.
The arrears of dearness allowance shall be paid in cash but not before the date of disbursement of salary of the March 2014. As per practice, the government uses Consumer Price Index — Industrial Workers data of the past 12 months to arrive at a quantum for the purpose of any DA hike.
Thus, the retail inflation for industrial workers between January 1 to December 31, 2013 was used to take a final call on the matter. The merging of 50 percent dearness allowance with basic pay will take place only when the seventh central pay commission submits an interim report in this respect.

Subject: Payment of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2014.
The undersigned is directed to refer to this Ministry’s Office Memorandum No.I-8/2013-E-II (B) dated 25th September, 2013 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 90% to 100% with effect from January, 2014.

2. The provisions contained in paras 3, 4 and 5 of this Ministry’s O.M. No.1(3)/2008-E-11(B) dated 29th August, 2008 shall continue to be applicable while regulating Dearness Allowance under these orders.
3. The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all Central Government employees.
4. The payment of arrears of Dearness Allowance shall not he made before the date of disbursement of salary of March. 2014.
5. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees, separate orders will he issued by the Ministry of Defence and Ministry of Railways, respectively.
6. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Subject: Amendment of Recruitment Rules/Service Rules -regarding. 
The UPSC has undertaken an analysis with respect to the Ministries/Departments from whom RR proposals have either rarely been received or not received at all in the Commission during the last three years. From the aforesaid analysis the following conclusions have been drawn by UPSC: 
i) There are cases where the Ministries were granted approval by the Commission for filling up the post as a one-time measure, pending finalization of recruitment rules. However, the Ministries have not framed the recruitment rules of such posts as a follow up to the same. 

ii) Recruitment Rules are not being amended on a regular basis (every five years) as required as per the norms of DoPT. 
iii) Instances have been noticed where the regular posts are filled up by the Ministries/Departments themselves without consulting the Commission, by appointing consultant or by making ad-hoc appointments. 
iv) Ministries/Departments have not specified the posts which are exempted from consultation with the U.P.S.C. or taken out of the purview of the U.P.S.C. 
2. DoPT instructions contained in O.M. No. 39021/5/83-Estt. (B) dated 9th July, 1985 and OM No. AB 14017/79/2006-Estt.(RR) dated 6th September, 2007 provide that where no Recruitment Rules exist or where the existing Recruitment Rules are repealed as per the prescribed procedure, the option of approaching the UPSC for suggesting one time method for recruitment to the post would be available. Accordingly, Ministries/Departments are advised to ensure that no ad-hoc appointment should be made in the absence of recruitment rules. In case there are overriding compulsions for filling up any Group A or Group B post in the absence of Recruitment Rules, they should make a reference to the UPSC for deciding the mode of recruitment to fill up the post on regular basis. 
3. DoPT guidelines on framing/amendment/ Relaxation of Recruitment Rules dated 31.12.2010 vide Para 3.1.5 provide that the Recruitment Rules should be reviewed once in 5 years with a view to effecting such change as are necessary to bring them in conformity with the changed position, including additions to or reductions in the strength of the lower and higher level posts. Further, consequent upon the implementation of 6th CPC recommendations, DoPT vide OM dated 24.3.2009 issued instructions to all the Ministries/Departments to initiate action to amend the existing Service Rules/Recruitment Rules in view of the revised pay structure/merger of pre-revised pay scales/up-gradation etc.
UPSC has observed that many Ministries/Departments are not adhering to these instructions and requisitions are being received from them to operate recruitment rules notified even twenty five years ago. Ministries/Departments are, therefore, once again directed to effect necessary amendments to the Recruitment Rules/Service Rules after following the due procedure of furnishing proposals to the Department of Personnel & Training and the UPSC. 
4. Ministries/Departments need to ensure that appointment to all posts are effected as per the provisions in the Recruitment Rules which are statutory in nature and adhere to these instructions scrupulously.

Necessary action may be taken for grant of higher scale for the Officers belonging to batches of Organized Group A Services that are senior by two year or more and have not so far been promoted to that particular grade in accordance with the provisions of this Department's OM No. AB.14017/64/2008-Estt.(RR) dated 24.4.2009.

CR-2013 of CBEC & All India Seniority List.


Considering the provisions of FR, RRs, DOPT guidelines and different judgments of Hon’able Apex Court etc., CBEC is totally helpless to issue All India Seniority list for Inspectors who were recruited on the basis of an examination with an All India Merit List w.e.f. 1996/2003. However CBEC is willing to introduce the same only on prospectively (i.e.  for Inspectors joining the Deptt. in 2014 or later ). The issue of removal of regional disparity retrospectively was raised in the AEC meeting of AIACEGEO held at Patna during May, 2013. AIACEGEO had clarified that it can only be settled in court of law. A  case in CAT (PB) New Delhi  has already been filed by All India Association as per resolutions adopted in AC meeting (confirmed in AEC meeting) to maintain base cadre parity in promotions. The issues of the removal of inter cadre as well as intra cadre disparities can only be solved if the verdict in such case will come in our favour. In the AEC meeting, AIACEGEO has requested it members  to wait for the out come of such case. It has been also clarified that  at any circumstances, the case  can not be  withdrawn  and also AIACEGEO  can not change its  stand contrary to the OA filed in CAT.
All Units are once again requested for not to make any correspondence with Board/ Govt directly. If they have any point please forward the same to SG to submit it to Board/Govt by him only. Board has  informed that delegations of different  units  were coming and meeting Board officials and submitting different representations , and that it has become very difficult for Board officials  to differentiate between different delegations, and all issues are getting mixed up. Such type of  activities by some of our own units  have  been created   tremendous amount of damage to our common cause.
The file relating to issue of notification on creation of different establishments as per CR-13 of CBEC may  likely to be approved by FM on 27.03.14 or 28.03.14 along with the notification of CBDT.   The cadre review file is still with Revenue Secretary. It is likely to be placed before F.M on  tomorrow, the 27th March. F.M. is currently out of station and scheduled to return the capital on 27th.

It is further submitted with due regards that the promotion orders may even be issued without waiting for permission from Election Commission because the DPC has been conducted by the UPSC against regular vacancies. It is not understood why the permission of the Election Commission has been sought contrary to the instructions in r/o model code of election conduct.
            3. As per the information gathered by the Association, the Hon’ble Finance Minister will not be available after tomorrow. If our officers retire this month also without promotion despite of their names being cleared in the DPC of 06.03.14, it will be a shame on all of us. It is also worth to mention that 20 days have already expired waiting for the issuance of the orders.
4. In view of the above, it is requested that the promotion orders regarding the subject-mentioned DPC may kindly be issued without further delay.

2. It is again submitted with due regards that the cadre restructuring of CBEC was notified on 18.12.13. The DPC against the post of Asstt. Commissioner was very much expected in the month of January, 14 (if not in December, 13). But nothing has happened till date even after expiry of more than 3 months of notification despite of the relevant list of the concerned officers being forwarded to all of the Cadre Controlling Authorities by the DG, HRD very well in advance.
3. It is further submitted that around 100 of our officers are retiring every month without promotion. Very specific & serious efforts are required to hold the said DPC particularly keeping in view the extraordinarily acute stagnation of Central Excise Superintendents. Till date, only 1% of Central Excise executive officers are being able to get rare of the rarest IInd promotion at the fag end of career. It is also worth to mention again that 2118 posts of Asstt. Commissioner have been created on temporary basis only for a limited period of 5 years. Thus, every day is important for us and even a little delay in the filling-up of these posts is detrimental to the interest of the thousands of our officers retiring regularly without IInd promotion in the career. It is, therefore, required to finish the process in a time bound manner to send the proposal of DPC to the UPSC. 
4. The field formations are not taking the issue seriously. There should be some accountability of the concerned field authorities in this regard to expedite the issue. They should feel their responsibility in serious manner particularly keeping in view that our officers are very eagerly waiting for rare of the rarest IInd promotion at the fag end of the retirement after serving the CBEC for 35 to 40 years with the utmost sincerity. Some very specific efforts (instead of routine administrative efforts) are required to finish the work taking personal interest.
5. In view of the above, it is very much requested that the proposal for DPC against the said posts may kindly be sent to the UPSC at the earliest by fixing a target date for it and the period of 5 years may also be counted w.e.f. the date of the orders of promotion as already agreed in the meeting of 04.03.14.
