Madam,
Kindly refer to the
Ref. No. 87/T&P/13 Dt. 08.05.13 & 90/M/13 Dt. 09.05.13 and also
Ref:CESA/ 21/2013 Dt. 20.05.13 of the Mumbai Unit alongwith various other
communications of the Association on the issue but resulting in vein perhaps
due to the apathetic approach of the top administration not to interfere in the
matters pertaining to the individual pleasure of the privileged & elite IRS
field authorities. It is not understandable why such type of approach is being
applied to the matter of transfer & postings even in the present time of
complete transparency to curb the corruption.
2. Inviting
your kind attention to the subject-mentioned orders, it is further submitted
with due regards that the Association had requested to amend the transfers
& postings policy. Accordingly, a meeting was held on 09.04.13 and the
minutes were issued on 29.04.13. Again the Association gave a representation
for Inter-Zonal transfer from Zone-I to Zone-II and vice versa.
On 28.04.13, a delegation of Superintendents as well as Inspectors Association
met with the then Chief Commissioner and requested to finalize the policy. He agreed
that he would do it on 29.04.13. But unfortunately, the policy was not
amended & finalized and the then Chief Commissioner retired on 30.04.13.
3. The charge of Zone –I was
temporarily given to the CC, Zone-II from 01.05.13 to 10.05.13. The
delegation of the Association met her on 06.05.13 and requested to finalize the
pending transfer & posting policy to take a decision for the apportionment
of staff to LTU/DGST & Service Tax from both the zones and repatriation of
officers on loan basis from Service Tax to Central Excise and roster for IZT. She assured that she would take
care of these issues, if the file was put up to her.
4. On 08.05.13, the All India Body of the Association
requested your goodself vide above
referred Ref. No. 87/T&P/13 Dt. 08.05.13
to intervene and issue instructions to the Mumbai Zone authorities to formulate
the transfers& postings Policy before issuing the ICT order. Your goodself was also tried to talk on
phone repeatedly on 09.05.13, but you were busy. However, the said issue was
not settled till 10.05.13. Thereafter, the charge was headed by DG, Valuation
from 11.05.13 to 16.05.13 and further the CBEC issued the order on 17.05.13
that the charge of CC, Zone-I will be with the DG, ST, Mumbai.
5. Now, it is not understood what
prompted the administration to issue the orders in haste when the finalization
of transfers & postings policy was pending and there was no regular CC and
also the orders of CC charge issued by the Board Dt. 17.05.13 were already
received in the office. On 17.05.13, the regular
cadre controlling Commissioner was on leave and neither the newly posted CC nor
earlier CC (DG, Valuation) was in the office at Churchgate. Inspite
of repeated representations and meetings with recorded minutes in agreement to the
suggestions of the Associations, the orders were issued by the authorities
holding additional charges without amending the policy.
6. It was assured not only in the circulated
minutes of your goodself as well as the earlier Member (P&V) but also in a
circular issued by one of the former chairmen that the policy would be
framed/amended in consultation with the staff Associations. It was also minuted
that the employee grievances redressal mechanism would be revived and meetings
will be conducted under the mechanism at regular intervals at local levels but
nothing happened. If the Board headed by the present administrators is unable
to rein the local field formations not following the directions/instructions of
the Board, what is the purpose of holding meetings with the Association and
giving false assurances?
7. The problem is not being faced in Mumbai
only but it is the scenario of many places including Chandigarh, Bangalore, Tirunelveli, Vadodara etc. and the irregularities cause by the respective administration
are not being rectified anywhere. As on date, no cognizance is being taken on
the issue. All the matters represented by the Association are with you with no
monitoring as to whether your instructions/directions are being
followed/complied by the field formations. No explanation is ever asked from
the erring IRS officers in the fields while our officers are immediately
charge-sheeted even on the petty matters. Perhaps it is happening due to the
fact that the officers in field under your goodself are your batch mates and
ignoring your directions virtually with no administrative control of Board on them.
8. No need to say that the said
subject-mentioned orders are full of manipulations & favouritism having no
criteria, no norms etc. It is really not
understood what was the intention, interest, consideration & motive behind
the issuance of the orders in such haste. It is also not out of place
to mention here that the orders of Zone-II were issued on 01.04.13 only after
the history of postings being made available on the website of the CC,
Zone-II. The officers completing 4 years at a stretch were rotated in
Zone-II, whereas so many combinations have been made in the aforesaid order of
Zone-I to create vacancies in Thane-I and Thane-II and posting of officers from
Excise to Excise and Excise to Service Tax on officer to officer basis. It is beyond all understandings what is the
interest of the administration in issuing the orders in undue haste when the matter was referred to your
goodself regarding the finalization of policy. It seems that we are still
un-vigil & un-attentive in such matters despite of the large scam on
transfer & posting in Railways recently detected by the CBI. It is really
not understood which agency/organisation/Commission to be contacted, if our own
authorities are not serious on the issue.
9. Inspite of the representations in advance, orders were issued in
Mumbai without considering any point submitted in the representations. Mumbai
gives a revenue to the tune of more than Rs. 75000 crores but the state of
affairs in man management is not tuned with the revenue. The members are very
much agitated which is neither in the interest of the revenue nor the
organization. If prompt action is not taken, it is very well possible that the
transfer & posting would become a large ‘unofficial profit gaining industry’
in our CBEC moving in the direction of scam like recently happened in Railways.
10. In view of the above, it is
requested that the matter may kindly be enquired thoroughly to ascertain the reasons of the hasty orders. The said orders may also kindly be withdrawn and a
fair transfer & posting policy be laid down immediately.
