3. It is further submitted with due regards that the
independent staff Associations were functioning under various cadre controlling
authorities in the field formations of Central Board of Excise & Customs
(CBEC) under the Department of Revenue with independent recognitions prior to
Association Recognition Rules of 1993. These Associations were also affiliated
to the All India Federation which was also duly recognised by CBEC. The office
bearers of these Associations were also being granted all the benefits as per
DOPT guidelines including not transferring them out of stations.
4. After the implementation of Association Recognition
Rules of 1993, only one All India Association was granted recognition by the
CBEC and all other Associations under various cadre controlling authorities in
the field formations are affiliated to it as its state level branches. The
office bearers of these branches were being given the due benefits as per DOPT
guidelines including the immunity against the out of headquarters transfer. But
all of a sudden, the practice of posting of these office bearers at
headquarters started to be violated. This was started with the Chandigarh
branch and spread to Bangalore, Tirunelveli, Daman-Vapi etc. branches and very
recently to Nagpur branch of the Association.
5. It is well
pertinent to mention that the main office bearers of Chandigarh and other
branches of the Association were never practiced to be transferred out of
headquarters without their willingness.
6. It has been
clarified by DOPT very clearly vide F.No. 16/18/2008-JCA Dt. 17.04.13 regarding
the transfer of the Association functionaries sent to Sh. Ajit Gambhir, Director,
Ad IV of CBEC-
“In
such of the Government departments/offices where a different practice is being
followed now, the existing practice, if not less favourable, may continue.”
7. The same thing has been
clarified vide ID No. 16/18/2008-JCA Dt. 01.12.09 and OM
No. 16/18/2008-JCA Dt. 03.09.12 of the DOPT. But it is very unfortunate
that the DOPT guidelines/clarifications are not being followed by CBEC.
8. Recently, the General Secretary
of Tirunelveli branch, Sh. M. Rajaclimax, has been transferred to Madurai Commissionerate
where the Association already has its another branch with different officer as
General Secretary. No officer has been transferred without request to Madurai
from Tirunelveli in the history. He has been transferred ignoring all the DOPT
guidelines as he is also going to retire within 1 year. DOPT
guidelines very specifically say that the officer near retirement is not to be
disturbed. Further, he has been re-elected as the General Secretary of
Tirunelveli branch again on 27.06.13.
9. Likewise, the President of Daman-Vapi branch, Sh. Thandilal
Meena, has been transferred
to Surat Commissionerate where also the Association already has its another
branch with different officer as President. He has been transferred ignoring
all the DOPT guidelines as the office bearers of one Commissionerate were never
practiced to be transferred to other Commissionerates. His tenure as the President of Daman-Vapi branch is yet to be completed and it still remains for more
than one year.
10. Likewise very
recently, the General Secretary of Nagpur branch, Sh. K. V.
Shriniwas, has been
transferred to Amrawati out of Nagpur headquarters. He has been transferred
ignoring all the DOPT guidelines as the General Secretary of Nagpur branch was
never practiced to be transferred outside the headquarters. His tenure as the General Secretary of Nagpur branch is yet to be
completed and it still remains for more than one & half years.
11. Above transfers have jeopardised the Association activities in the
said zones/Commissionerates and the
employee grievance redressal mechanism has
totally failed.
12. In view of the above, it is
again requested that the due guidelines may kindly be issued to the CBEC to
grant due protection to the Association functionaries and they may also kindly
be retained in concerned Commissionerates at the headquarters of the Association
branches.
