            AGAIN THANKS A LOT TO CLEAR THE CADRE RESTRUCTURING OF CBEC.
2. It is also requested with due regards, particularly keeping in view the extraordinarily acute stagnation of Central Excise Superintendents/Inspectors, that-
i) Specific measures to grant parity with the common entry counterparts of CSS etc. may kindly be devised independent of cadre restructuring for the officers recruited, whether promotee or direct, as Inspector of Central Excise enabling them also to attain PB4 levels.
ii) The immediate steps may kindly be taken to convert the temporary posts to permanent/regular,
iii) All the posts, whether temporary or permanent/regular, may kindly be filled-up only by promotions like the last cadre restructuring.
iv) All the posts/vacancies (newly created and cascaded downwards on account of promotions on higher posts) may kindly be filled-up in one go like the last cadre restructuring.
v) All the posts at STS (Deputy Commissioner) level may kindly be initially operated at JTS level (Asst. Commissioner) in terms of the provisions of GFR 254 or be converted to JTS level keeping in view that all the officers at JTS level are to be automatically promoted to STS after 4 years of service.
vi) No direct recruitment may also kindly be made to IRS at least for next 5 years after the implementation of cadre restructuring.

Sub: Use of extended panel to grant promotions.
 Madam,
Kindly refer to the various communications of the Association on the above subject made to the administration.
2. It is submitted with due regards that the provisions of extended panel were not implemented at the time of the regularisation of the promotions vide Notification No. 30/2000 issued vide F. No. A. 32012/8/2000-Ad.II(Pt.) Dt. 21.11.2000 of CBEC. The clarificatory DOPT OM No. 22011/4/98-Estt.(D) dt. 12.10.98 to DOPT OM No.22011/5/86-Estt. (D) dt. 10.4.89 says about the procedure to be followed for preparation of extended panel to benefit the serving officers in lieu of the retired/deceased ones. The provisions of extended panel have also not been applied to other DPC’s conducted for the post of Asstt. Commissioner after 21.11.2000 by CBEC.
3. Thus, the provisions of the extended panel are to be implemented in the following cases-
i) Regularisation of the 1979 onward promotions from group ‘B’ to group ‘A’ based on the earlier judgement (originating the ratio formula of 6:1:2) of the Hon’ble Supreme Court because the implementation of the judgement is incomplete for the want of the use of the extended panel.
ii) Much awaited regularisation of the post-1996 ad hoc promotions from group ‘B’ to group ‘A’ as per new RR’s based on the current judgement (dt. 03.08.11 in CWP No. 365/10) of the Hon’ble Supreme Court.
iii) DPC conducted in the month of June, 12 for the promotions from group ‘B’ to group ‘A’.
iv) Forthcoming/future DPC’s for promotion to the post of Asstt. Commissioner, which are always being delayed far behind the schedule.
4. The Association was assured about the conducting of the supplementary DPC in this regard by the Member (P&V) during the meeting of 02.11.12 which is still awaited. Contrary to the assurance given in the meeting, it was only mentioned in the minutes that the work of regularization is being done at high priority and all court judgements & govt. instructions are being honoured in this process.
5. In view of the above, it is requested that the immediate steps may kindly be taken to implement the provisions of extended panel in consonance of para 3 above as per DOPT guidelines.
