Madam,
Kindly refer to the circular of the CBEC issued vide  F. No. A-26017/44/94-Ad II(A) Dt. 08.03.95 circulated to all Principal Collectors & Collectors of Central Excise & Customs and Ref. No. 225/Pay/13 Dt. 06.08.13 alongwith other representations of the Association made to the administration.
2. It is submitted with due regards that the Association has been regularly requesting the CBEC authorities to implement the above mentioned circular but the same is not being implemented. This circular was issued based on the Jabalpur CAT orders in OA No. 541 of 1994 but the implementation of the same is still awaited. The said CAT orders were never challenged by the government. It is also worth to submit that all of the then Inspectors have now become Superintendents.
3. In view of the above, it is requested that the above referred circular of the CBEC may kindly be implemented at the earliest. It is also well pertinent to mention that there was no condition in the CAT orders to consult the Expenditure.

Madam,

  Your kind attention is invited to the verdict given by the Hon’ble Supreme Court in the Special Leave to Appeal No. CC 7467/2013 upholding that the MACP upgradation should be granted in the promotional hierarchy instead of the hierarchy of grade pays in r/o CWP No. 19387/2011 of the Hon’ble High Court of Punjab & Haryana and also the same verdict given by the Principal Bench of the Hon’ble Central Administrative Tribunal in the OA No. 904/2012.   
 It is further submitted with due regards that the Para 8.1 of MACPS instructions stipulates Rs. 5400/- in PB2 and PB3 as separate grade pays. The said para now has no validity and is totally illegal in the light of the above judgement of the Hon’ble Supreme Court.
 Further, one MACP upgradation has been offset with the time scale vide letters F.No.A-23011/29(i)/2010-Ad.IIA, F.No.A-23011/29(ii)/2010-Ad.IIA and F.No.A-23011/29(iii)/2010-Ad.IIA of CBEC, all dated 06.05.13 on the basis of bifurcation of single grade pay of Rs. 5400/- into two (one in PB2 and another in PB3) as per above said para 8.1.
. In view of the above, it is requested that the said para 8.1 of MACPS instructions may kindly be scraped and the financial upgradations under the MACP scheme may be granted in accordance of the promotional hierarchy without offsetting the MACP upgradation with the time scale. Thus, the officers already getting the grade pay of Rs. 5400/- as time scale should get a grade pay of Rs. 6600/- on next MACP upgradation without offsetting with the time scale.

            As you know, it is submitted with due regards that the meeting of Cadre Review Committee for the cadre restructuring of CBEC was held on 27.08.13 under the Chairmanship of the Cabinet Secretary. But the minutes of the meeting are still awaited even after the expiry of more than 3 weeks and our officers have been retiring on regular basis merely after single promotion in the career.
2. It is, therefore, requested that the issuance of the said minutes may kindly be expedited with the office of the Cabinet Secretary.

Namaste.
The details of the pending dues of the units are posted below. All the defaulting units are requested to clear the dues on IMMEDIATE basis. It is the duty of all of us to clear the said dues and donate maximum funds to our Association to make our organisation stronger & stronger.
