Sub: Staff grievances.
Madam,
Kindly refer to the various communications of
the Association made on various issues to the various authorities including
your goodself.
2. It is submitted with due regards that the Association was very
much hopeful with great zeal at the time of your goodself joining as Member and
also as Chairperson of the CBEC that a new miraculous era would start to
redress all grievances of the staffside. But unfortunately perhaps due to the
things not being placed before you by the concerned sections in correct
perspective, the fate of the staffside particularly the Central Excise
Superintendents remained unchanged. As far as the temporary posts of Asstt.
Commissioner created in the cadre restructuring are concerned, these would
serve no good to save the sinking career & existence of these ill-fated officers
because the officers promoted against these posts will not be entitled for
further promotion. This all happened despite of your honest & sympathetic
attitude and also the enthusiasm to work for us. Even the grievances, which could be redressed at the level of CBEC
itself, remained unresolved. Some of the grievances are listed below in the
expectation of being redressed during your remaining tenure as the Chairperson
of the CBEC-
1. Implementation
of the CBEC circular issued vide F. No. A-26017/44/94-Ad II(A) Dt. 08.03.95 under the signature of Sh. Dharmvir Gupta, one of the then
Deputy Secretaries of CBEC, regarding arrears of pay.
2. Posting of Association
functionaries.
3. Merger of three Group ‘B’ Executive Non gazetted categories into one
cadre.
4. Merger of three Group ‘B’ Executive gazetted categories into one
cadre.
5. Removal of acute stagnation of Central Excise Superintendents.
6. Parity
with common entry counterparts of CSS etc. to retire our officers in PB-4.
7. Batch to batch Non Functional Financial Upgradation to the
Central Excise executive officers at par with the best common entry
counterparts like CSS etc.
8. Next promotion of Central Excise Superintendent in STS like many
other group ‘B’ gazetted officers.
9. Initial grade
pay of Rs. 5,400/- in PB3 to Central Excise Superintendents w.e.f. the date of
the grant of this grade pay/equivalent pay scale to the other analogous
counterparts of IB, CBI etc.
10. Implementation of para 7.15.24 of 6th
CPC report.
11. Role of
Inspectors & other hardships in ACES.
12. Implementation of Supreme
Court judgement for stepping up of pay of seniors, if junior is drawing more
pay on account of ACP/MACP upgradation/s.
13. Regularisation of ad hoc promotions based on the rules existing on
the date of regularisation.
14. Stoppage of loan postings in the Board/Directorates etc. against
willingness.
15. Seniority benefit
on promotion to group ‘A’ in lieu of the service rendered in group ‘B’.
16. Revival of special pay of Audit.
17. Removal of transfer &
posting irregularities and stoppage of violation of transfer/posting policy.
18. At least four functional promotions in the service career.

19. Fulfilment of the commitments made during the presentation
on cadre restructuring on 18.01.11.
20. Undoing the
offsetting of MACP upgradation with the time scale.
21. Undoing of para
8.1 of MACPS instructions.
22. Use of extended panel to grant promotions.
23. Re-framing of recruitment
rules granting parity with the common entry counterparts & also for the
sake of “just, fair & equitable representation of each category” as per the
verdict of the Hon’ble Supreme Court.
24. Notional promotions to Central Excise seniors at par
of the juniors of Customs already promoted.
25. Non-functional time scale in PB3 instead of PB2 to Superintendents after
completing 4 years of service.
26. Counting of regular service in consonance of F. No. A/60/13/RTI/2006-Ad.IIIB Dt. 26.05.06 of
CBEC.
27. Finalisation of
in-situ promotions scheme under consultation of the Association.
28. Holding of
regular minuted meetings under the
employee grievances redressal mechanism.
29. Option for purchase of weapons issued on
loan basis.
30. Promotion of all Central Excise Inspectors, PO’s
& Examiners of one particular year to the same level.
31. At least a grade pay of Rs. 6,600/- & 7,600/- on IInd & IIIrd MACP upgradation without offsetting with time
scale after joining as
Inspector.
32. Grant of reward on the lines
of anti-evasion to the officers working in audit branches.
33. Not to count the promotion of
UDC to Inspector as actual promotion for the purpose of grant of ACP/MACP
upgradation on the lines of promotion of UDC to DOS.
34. Issuance of the statutory guidelines for wearing
of uniform.
35. Promoting all
Superintendents who have completed 1.5 times of qualifying service on the lines
of CSS.
36. Health insurance scheme for CBEC employees from welfare fund.
37. Creation of separate service
on the lines of CSS.
38. Parity between the officers of
headquarters organisations & field offices.
39. Upgradation of the posts of
Superintendent based on combined seniority as Inspector+Superintendent.
40. Grant of powers of refund, rebate etc. to
Superintendents.
41. Stoppage of delay in
vigilance/disciplinary cases.
42. Centralised GPF account.
43. Minimisation of litigations with staff.
44. Authorisation of premier private
hospitals for medical care and treatment.
45. Free annual medical health check-ups.
46. Removal of disparities in the pay
structures of Superintendents and Inspectors in the Customs & Central
Excise Settlement Commission on deputation basis.
47. Independent HRD.
48. Undoing of massive reports by
Range offices.
49. Undoing of delegation of powers under Customs
Act to SSB officials/other agencies.
50. Use of welfare fund for staffside.
51. Implementation of various Court orders.
52.
Use of 1% incremental
amount for staffside.
3. The Association
is still hopeful that all of the grievances of the staffside may be redressed
during your tenure. Many of the grievances are very well within the powers of
CBEC itself which may be redressed immediately, if the will power to this
effect is used. These grievances also include the points raised before your
goodself in very first meeting during your stint as the Member (P&V) but
the same remain unredressed till date despite of the positive assurance given
by you. Regarding many other issues also, positive assurances were given by
various authorities including the current Member (P&V) but the same are
still unredressed. Other issues, which are not straightway under the powers of
CBEC, may be strongly recommended to the concerned/nodal department.
