2. It is submitted with due regards that no
heed is being paid to the matter despite of the repeated requests of the
Association and the same is pending for more than two and & years. The issue of stepping up of the pay regarding ACPS has
been linked to pay revision of 2004 by the concerned section instead of issuing
a general & complete clarification based on Supreme Court verdict dt.02.05.11
in SLP(C) No. CC 7278/11. The issue has
already been settled finally by the Hon’ble Supreme Court vide the said verdict
granting the benefit of stepping up of the pay to seniors, if junior is drawing more pay on account of
ACP/MACP upgradation/s.
3. If a complete, exhaustive&
general clarification is not issued based on Supreme
Court verdict, many of our senior officers particularly entered into the job
through Ministerial cadre will suffer with recurring& irreparable loss due
to the inaction of the concerned section on the issue. It is really very unfortunate that even the Apex Court is being given
no importance by the concerned section.This
act of the concerned section merely seems to amount to the contempt of the
Hon’ble Supreme Court because similarly placed officers not need to approach
the legal courts on the similar issue already settled by the Apex Court.On
such issue, the government is required to implement the court orders in
general. Under the principle of res judicata, various courts including the
Hon’ble Supreme Court have already given various verdicts saying that similarly
placed officers not need to approach the legal courts on the similar issue already
settled by the Apex Court. The verdict given by theHon’ble Supreme Court is
always treated as the law of the land.
4. In view of
the above, it is once again requested that the much awaited general
clarification based on the verdict given by the Hon’ble Apex Court may kindly be
issued on the issue at an early date and all of the equally placed officers may
be given the due benefit of the same.

for extra days/hours of work.
Madam,
As you know, it is submitted with due regards that the
officers were forced to work by two days extra (on holidays) per weekin last
financial year.They were also forced to work one hour extra per day in Service
Tax in Delhi. Further, they were forced
to work continuously for 3 holidays in the end of the last financial year. It
is also well pertinent to mention that this forced work was taken from them
without any payment of salary for extra work and also with the threat of penal
action on default. It is further submitted that an emergency situation for a
few hours or a day in the year may be understood but nobody can be forced to
work without wages in routine.
2. Not only it, they are also being forced to work on
holidays in the Service Tax in the current financial year further without
payment of any salary for the extra work being taken from them. This seems like
taking forced labour from them.
3. Your kind
attention is also invited to the fact that the working for fixed hours per day
in the Central Govt. offices was started by a Cabinet decision enabling the
government officers to have due time for required rest, relaxation and look
after their families to dispose of their personal/family related obligations.
The Superintendents of Central Excise are already totally demoralized due to
the lack of promotional avenues, working conditions, basic amenities, required
facilities etc. and also non-grant of requisite pay deals.
4. It is also
worth to mention that the officers are being paid for the calculated hours/days
per month. Forcing them to work for 7 hours extra in the week and at least 8
days extra in the month without paying extra wages is no-way justified and is
unlawful. Such type of practice gives the only message of
living in an undemocratic system instead of the greatest democracy of the world
meant for the people, by the people and of the people.
5. It is, therefore, requested that the officers may
kindly be made the due payment for the extra work done in the last financial
year and being done in the current financial year by them.
