Sub: Immediate implementation of
cadre restructuring of CBEC-request regarding.
Sir,
It is submitted with due regards that the
current restructuring of Central Board of Excise & Customs was started to
be processed sometimes in 2006 but is still pending to be implemented despite
of being approved six months ago by the Union Cabinet and notified accordingly
on 18.12.13.
2. Our
common entry counterparts including CBDT, CSS etc. are already reaching the PB4
levels after getting 5/6 promotions while our officers are retiring merely on a
PB2 post after getting only single promotion in the career of 35-40 years. These
officers expected that they would be able to get the rarest IInd promotion at
the fag end of career as a result of this cadre restructuring. But thousands of our officers have already
retired waiting for the same on account of the delayed process and others have
also been retiring on mass level every month under the hope of immediate
implementation of the cadre restructuring.
3. As far as the regional
disparities are concerned, even the regional disparities in functional
promotions of the officers belonging to All India Services could not be removed
on account of not being supported by any rule because they work under the
different Cadre Controlling Authorities of different State cadres. Your
goodself was also pleased to admit that even the IAS officers of some states
are merely retiring at District Magistrate level whereas others are reaching
the level of Cabinet Secretary. The only way to remove these disparities is ‘on
financial basis’ by the grant of batch to batch Non Functional Financial
Upgradation to all group B officers of the Govt. of India at par with the best
placed common entry group B category (e.g., CSS) based on the precedent of Non
Functional Upgradation granted to group A officers with IAS independent of cadre restructuring.

As already submitted, the current restructuring of CBEC was started sometimes
in 2006 and is merely the IInd one in the CBEC despite of the guidelines of being
happened at every 5 years. What to say
about happening at every 5 years, it is even not being implemented within 5
years of its start. Our officers join the job as Inspector and retire as
Superintendent at PB2 level barring 1% lucky ones who are able to get the rare
of rarest IInd promotion at the fag end in their long career of 35-40 years. At
present, a very good number of our officers are forced to retire every month
without promotion. It was expected to console them a bit on account of IInd
promotion thanks to the temporary posts created at JTS level in the cadre
restructuring. If the implementation of the cadre restructuring is delayed
further by any reason, these poor officers will regularly keep retiring without
promotion. You are the only hope for rescue of the sinking cadre of Central
Excise Superintendents who are regularly instrumental to achieve the revenue
targets well ahead of the set goals despite of facing the worst career
prospects.
5. The
reorganisation file of CBEC was cleared by the then Revenue Secretary as well
as Minister of State (Revenue) on 31.03.14 and sent to the Finance Minister for
final approval. But very disappointingly for the thousands of officers waiting
for IInd promotion at the fag end of their career, the file came back to your
goodself through CBEC without being placed before the Finance Minister for
signature. The members are unable to understand how the file came to
initial administrative level from the
office of the Finance Minister and why it was not placed
before him despite of being marked to him for final approval.
6. In view of the above, it is very much requested that the
reorganisation of CBEC may kindly be approved and
cadre restructuring implemented on immediate basis because the delay in the
matter is regularly increasing the level of demoralization and discontent among
the officers. Other measures may kindly be taken independent of the cadre
restructuring.
