Sub: DPC for panel years 2013-14, 2014-15 and 2015-16 for the promotion to the post of Asstt. Commissioner.
Sir,
It is submitted with due regards that the CBEC is already behind by two modal years in r/o the DPC for the post of Asstt. Commissioner. As per the DOPT provisions vide OM No. 22011/9/98-Estt (D) Dt. 08.09.98 reiterated in OM No. 22011/1/2011-Estt (D) Dt. 11.03.11 and 22011/1/2011-Estt (D) Dt. 13.12.13, the DPC for a financial year should be conducted well in advance latest by the month of January of the preceding year. Thus, the DPC for the year 2014-15 should have been conducted latest by the month of January, 2014 and the process for the year 2015-16 should also have been started in the month of August, 2014 as per the schedule prescribed by the DOPT.
2. The promotions against 200 posts of Central Excise share for the year of 2013-14 are still pending and the names of more than 30 retired or unfortunately expired officers have also been mentioned in the latest promotion Order No. 192/2014 issued vide F. No. 12018/01/2014-AdII dt. 22.10.14. A good number of officers facing no charge sheet or suspension or prosecution have also not been promoted vide above mentioned promotion order with no fault on their part. They have perhaps not been promoted for the want of some ACR/APAR/NRC whereas their juniors have been promoted. It is also worth to submit that the writing of ACR/APAR or providing NRC is noway the responsibility of the individual officer, the same being the sole responsibility of the concerned authority/administration.   
3. Huge number of our officers have already retired and many more have been retiring every month without promotion due to this delayed process. Even the provisions of extended panel are unable to give any relief to the serving officers due to this extraordinary delay.
4. The chain vacancies on account of cascading effect from higher side are also required to be added for the DPC as per the DOPT OM No. 22011/9/98-Estt(D) Dt. 06.10.99. These chain vacancies come to be 498 meant for promotion of Group ‘B’ gazetted executive officers. It is clearly mentioned in the above said OM that the existing and clear anticipated vacancies as well as chain vacancies on account of retirement, promotion etc. in all of the higher grades/hierarchy should be included for the purpose of DPC.
5. Not only it, your kind attention is also invited to the DOPT provisions vide the OM No. 22011/9/98-Estt. (D) Dt. 14.12.2000 to fix the responsibility for the lapse in adherence to the prescribed time frame in holding of DPC’s. But unfortunately, it seems that nobody in CBEC cares for the DOPT provisions and officers have been retiring for years waiting for promotion.
6. In view of the above, it is requested to kindly at the earliest-
i) Conduct the DPC for the post of Asstt. Commissioner for the modal year 2014-15 by duly adding the chain vacancies also.
ii) Also conduct the DPC for the modal year 2015-16 latest by January, 2015.
iii) Issue promotion order against 200 posts of Central Excise share for the year of 2013-14.



iv) Issue promotion order of more than 30 serving officers in lieu of the retired or unfortunately expired officers.
v) Issue promotion order for the officers who have been left for the want of ACR/APAR/NRC despite of facing no charge sheet or suspension or prosecution.
7. It is also requested to kindly treat the matter as IMMEDIATE taking into consideration that our officers are already facing the worst career prospects and forced to retire only with single promotion in the career of 35-40 years after joining the job as Inspector of Central Excise.
