News from CESA (Central Excise Superintendents Association), Mumbai sent by one of our officers  Shri Rajesh Soniis reproduced below for information, suggestions and necessary action-

 OA no. 695/2014 dt. 03.11.2014, has been filed jointly by the 5 units of Mumbai zone & Indore, of Superintendents of Central Excise Association for a relief that: An officer who is senior in the recruitment cadre, i.e. Inspector central excise on the basis of merit or batch (earlier) cannot be placed junior to any officer from any zone/unit while fixing the All India Seniority List of Superintendent – Central Excise for further consideration for promotion to the post of Assistant Commissioner – Central Excise.  Revise both the seniority list of AISL and give other consequential benefits.
         Final hearing is fixed on 16th Feb. 2015.  
COMMENTS OF SHRI RAJESH SONI-----Board at present not in a position to file counter, hence interim order is likely to be  issued by CAT to stay the future DPCs in the cadres of Superintendent and 
Asst. Commissioner. Similarly Board has not filed the counter in the OA filed in 
Principal Bench, Delhi for all India seniority list of Inspectors w.e.f 2003, the 
date of hearing is fixed to 09.12.14 hence interim order is likely to be issued by 
CAT to stay the DPC. 



FILING OF CAT CASES BY CENTRAL EXCISE SUPERINTENDENTS ASSOCIATION , MUMBAI FOR REMOVAL OF REGIONAL DISPARITY IN PROMOTIONS.

            As resolved:-
CESA Mumbai has authorized, Shri. M. K. Mishra, Superintendent of Central Excise and Joint Secretary, Mumbai Associate Unit in the OA, proposed to be filed in Mumbai CAT for protecting the rights of Seniority earned in the cadre of Inspector Central Excise vis-a-vis after promotion as Superintendent of Central Excise at All India level. Effecting promotions without a proper, updated & corrected seniority list and not implementing the decision of the Apex Court in case of N R Parmar Vs UOI.
            CESA Mumbai has also authorized, Shri. M. K. Mishra, Superintendent of Central Excise and Joint Secretary, Mumbai Associate Unit, to be a petitioner with regards to the Seniority as per the Rule prevailing at the time of appointment and advertisement.  The grievance is that till date the Department has not issued any seniority list in accordance with the Rules framed by the DOPT

            Mumbai Unit, intends to file two petitions –
one for appointments made as per OM of 1986, and decision of N R Parmar Vs. UOI, thereon   &
another for appointments made prior to the OM issued in 1986.

        In both the petitions Shri. M. K. Mishra, Supdt, Joint Secretary, Mumbai Unit, will represent the entire Zone alongwith other petitioners who are: S/Shri.  1. L. V. BIST, 2.  V. U. BRAHMAKSHATRI,  3. B. KANNAN,  4. MANOJ RAMAN,   5.   J. D. PATIL, (PUNE), 6.   AJIT KUMAR KARTHIKEYAN, (PUNE), 7. J. G. NAIR,  8. VENKATESH ALWAN, 9.  R S KARNIK, & 10.  RAMESH HANUMANTHA. 

            Both the petitions are on final stage for filing.  The demand for relief will be beneficial for the entire Mumbai cadre controlling Zone, i.e Mumbai, Pune, Nashik, Aurangabad and Goa. 


            Please don’t be misled by any rumor/confusion that only the petitioners will be the beneficiary and no one else.  Keeping this issue in mind, CESA Mumbai has authorised the Joint Secretary of Mumbai unit to be a petitioner, for both the petitions, for relief to one and all.
