Sub: Extra measures in addition to the cadre restructuring to remove the stagnation of group B officers.
Sir,
Kindly refer to the various communications including Ref. No. 141/P/15 Dt. 16.11.15 of the Association on the issue.
2. It is again submitted with due regards that the issue of
extraordinarily acute stagnation being faced by our officers was raised before
the Cabinet Secretary by the Association and he was kind enough to recommend to
the Cabinet of India to take extra measures
in addition to the cadre restructuring to remove the stagnation of group B
executive officers of Central Excise. The Cabinet was also pleased to accept
and approve the same. But unfortunately, no measure has been taken on the issue
till date despite of expiry of more than two years.
3. In view of the above, it is
requested to kindly take due measures on the issue at an early date under
consultation with the Association to enable the Central Excise executive
officers to retire at PB4 levels like their counterparts.

Sub: Request to hold single consolidated DPC for the
post of Asstt. Commissioner for the years 2014-15, 2015-16 and 2016-17
including remaining vacancies of 2013-14.
Sir,
Kindly
refer to the various requests of the Association on the issue.
2. Your kind attention is invited to the para 2.4.1 of the DOPT OM No.
22011/5/86-Estt. D Dt. 10.03.89 as well as para 6.4.1 of the DOPT OM No. 22011/5/86-Estt. (D) Dt. 10.04.89
mandating about holding of single DPC in case of DPC not being held timely for
more than one years. As the concerned section of CBEC is habitual of making
terrible delay in holding the DPCs for the post of Asstt. Commissioner, our
officers are forced to retire without promotion despite of thousands of
promotional posts being in hand.

It is further submitted with due regards that that the DPCs are being delayed
despite of the DOPT instructions to fix the responsibility of the concerned
officer for the lapse in adherence to the prescribed time frame in holding of
DPCs under the DOPT OM No.
22011/9/98-Estt. (D) Dt. 14.12.2000. It seems that the concerned section is
having totally indifferent attitude regarding DOPT provisions. Non-serious
attitude of the concerned section on the issue is very well evident by the
following figures showing tremendous delay in the matter -

2016-17 January, 16 still awaited already 1 month
4. As
per the DOPT OM No.
22011/1/2011-Estt.(D) Dt. 23.04.15, the Appointment Committee of Cabinet has
viewed this matter seriously. But very unfortunately, the matter is not
being taken seriously by the concerned section of CBEC. As per the DOPT provisions vide OM No. 22011/9/98-Estt
(D) Dt. 08.09.98 reiterated in OM No. 22011/1/2011-Estt (D) Dt. 11.03.11 and
22011/1/2011-Estt (D) Dt. 13.12.13, the DPC for a financial year should be
conducted well in advance latest by the month of January of the preceding year.
No need to submit that the prescribed schedule should strictly be followed
whether the DPC is conducted for regular promotions or ad hoc promotions.

It is further submitted that the chain vacancies on account of cascading effect
from higher side are also required to be included for the promotion to the post
of Asstt. Commissioner as per the DOPT
OM No. 22011/9/98-Estt(D) Dt. 06.10.99. It is clearly mentioned in this OM
that the existing and clear anticipated vacancies as well as chain vacancies on
account of retirement, promotion etc. in all the higher grades/hierarchy should
be included for the purpose of DPC.
6. As far as the amendment in RRs is concerned, the para
3.1 of the DOPT OM No.
22011/5/86-Estt. (D) Dt. 10.04.89 also says that the holding of DPC meetings need not
be delayed or postponed on the ground that RRs for a post are being
reviewed/amended. Moreover, the amended RRs are not required to be awaited for
the promotions to be granted on ad hoc basis.
7. It is also worth to mention that 2118 temporary posts
of Asstt. Commissioner were created only for 5 years w.e.f. 18.12.13 to be
filled by promotions, out of which more than 2 years have already expired. Officers
are forced to retire without promotion (only
IInd in the career of 35-40 years) due to delayed process despite of
thousands (more than 1500) of promotional posts being in hand.
8. The Association was told during the meeting of
14.01.16 held under the Chair of the Member (P&V) that the advice from the Attorney General/Solicitor
General had been sought on the issue of reservation in this regard. The
Association is very much hopeful that the said advice would have been reached
CBEC till date.
9. Due to the
delayed process, even the extended panel is unable to give any benefit
to our officers as the officers figuring in the extended panel also retire
before the holding of DPC. Our officers are merely being punished without any
fault of them by snatching their legitimate right of promotion.
10. Around 600 officers have already retired
without promotion due to the want of the DPC after October, 14. This figure of
600 includes around 400 officers from general category and around 200 (33%)
officers from reserved category.
11. If
due to some unavoidable reason the information is not available in r/o retired
officers, the DPC is required be conducted immediately in r/o the working officers without further delay
otherwise many more officers will also be forced to retire without promotion.
12.
In view of the above, it is requested to take immediate measures-
i)
To hold the single consolidated DPC for the years 2014-15, 2015-16 &
2016-17 including the remaining vacancies of 2013-14 in CBEC.
ii)
To fix the responsibility of the concerned nodal officer/s and take necessary
action for habitual delay in holding the DPCs.

Subject: Option for purchase of weapon
issued on loan basis.
Sir,
Kindly refer to the meeting of the Association held on
15.03.12 with the administration under the employee grievance redressal
mechanism and various representations including Ref. No. 79/W/15 Dt. 24.06.15
& 142/W/15 Dt. 16.11.15 submitted by the Association on the issue. The
subject-mentioned point was duly agreed in the meeting but no action has been
taken till date.
2.
It is further submitted with due regards that the scheme to sell the weapons to
the departmental officers by the CBEC was started initially without any
condition of returning the same on retirement. Later on, it was changed to
‘loan basis’ with the condition of return of weapon to the CBEC on retirement
while the politicians are privileged to purchase the same on nominal price. Our
officers are being asked to return the same on retirement whereas the
politicians are privileged to purchase even another one/s after every 3 years.
Presently, many of the departmental officers are in possession of fire arm on
loan basis issued by the department out of seized & confiscated weapons
with the condition to surrender the same on retirement. It is reiterated that
the departmental officers, however, were authorized to purchase these weapons
at the nominal price at the start of the scheme without any condition of
return.

It is further submitted that-
i)
Many of officers are on the verge of retirement who were issued the weapon for
self defence.
ii)
Earlier the department used to sell these fire arms to the departmental
officers as well as the some other categories of the citizens.
iii)
The scheme of selling the weapons to the
departmental officers has been withdrawn while others are still entitled to
purchase the same from the department. Not only it, others can purchase another weapon/s on some specified
frequency after purchase of earlier weapon/s.
iv)
It appears to be gross injustice to the departmental officers that they are
deprived of the facility to purchase the weapon from their own department
despite of being instrumental to seize & confiscate not only the weapons
but also the gold, foreign currency and other prohibited/restricted goods. They
have always to face white collar criminals, chronic economic offenders,
hardcore smugglers, drug traffickers & other criminals during the disposal
of their duties. Despite of this all, the other categories of citizens still
have the facility to purchase these weapons while ours not.
v)
The threat perception to the life of the departmental officers is increased
multifold from the side of the economic offenders and hardcore smugglers etc.
after the retirement due to vanishing of the departmental safety shield as
compared during service.
4.
In view of the above, it is requested that-
i)
The necessary steps may kindly be taken to reinstate the initial scheme of
selling the weapons to departmental officers and
ii)
The officers intending to hold the loaned weapon with them after retirement for
self defence may also kindly be allowed to do so after charging the price of
the weapon from them at par with the officers who were allowed to purchase the
same on permanent basis in the past.
