Kindly
refer to the letter F.No.C.30013/06/2012-Ad IVA Dt. 02.02.16 placed on CBEC
site on 10.03.16.

It is submitted with due regards that the minutes have not been issued
correctly by the concerned section on many points. Even the factual position
has been shown incorrectly on some places. The incorrectness of the minutes and
the factual position is briefed under the forthcoming paras for necessary
action and correctness of the minutes. Not only it, some points are totally
missing in the minutes. The incorrect issuance of the minutes and no mention of
some points merely show the non-serious approach of the CBEC on redressal of staff
grievances.

Para 3.3 of the minutes is totally misplaced. Actual point is something else
having no relation with the matter reflected in the minutes. The point relates to career prospects
whereas the matter of pay scale is reflected in the minutes. No mention has
also been made of the career prospects or letter No.C.30013/6/2012-Ad.IV.A.
Dt. 15.02.13 of CBEC as discussed in the meeting. Immediate
measures may kindly be taken in accordance of the above said communication of
the Association and discussions held in the meeting. As far as para 3.1 and 3.2
of the minutes are concerned, an immediate action is requested to be taken on
the issues as two months have already expired to the holding of the meeting.
4. Regarding para 3.4 of the
minutes, the DOPT has already asked for the proposal from CBEC based on the
meeting of the Association held with the DOPT Minister. The proposal may kindly
be sent to the DOPT by the CBEC at an early date accordingly.
5. The correct recording has also
not been made under para 3.5 of the minutes. Eligibility conditions differ at
the level of Inspector grade instead of group ‘B’ gazetted level. It is
reiterated that the Association was promised to bring the Central Excise
Inspectors, Preventive Officers and Examiners of same year at same promotional
level in the presentation made on 18.01.11 by CBEC regarding cadre
restructuring. Unfortunately, nothing has been done till date. The immediate
measures may kindly be taken accordingly.
6. Para 3.6 of the minutes is also totally misplaced.
Actual point is something else having no relation with the matter reflected in
the minutes. The point relates to time scale whereas matter of pay scale is
reflected in the minutes. The details of the matter taken
up with the Expenditure may kindly be provided to the Association. As far as
taking up the issue with the anomalies committee is concerned, our case is not
covered in it on account of ours being a gazetted cadre. The matter may,
therefore, kindly be taken up with the Expenditure directly through the Hon’ble
Finance Minister.
7. As far as para 3.7 of the minutes
is concerned, an immediate action is requested to be taken on the issue as two
months have already expired to the holding of meeting.
8. The minutes are silent on the
point of ‘Upgradations in accordance of
the residency periods prescribed under DOPT
OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09’. The observations/decision
made on this point may kindly be recorded in the minutes and necessary action
taken accordingly.
9. The minutes are also silent on the point of ‘Uniform promotional hierarchy for all group ‘B’ officers of Govt. of
India’. The observations/decision made on this point may also kindly be
recorded in the minutes and necessary action taken accordingly.
10. As far as para 3.9 of the
minutes is concerned, an immediate action is requested to be taken on the issue
as two months have already expired to the holding of meeting.

As far as para 3.10 of the minutes is concerned, an immediate action is also requested
to be taken on the issue as two months have already expired to the holding of
meeting.
12. Regarding para 3.11 of the
minutes, it is submitted that the Association is totally unaware of any such
proposal sent by the DG, HRD to the Revenue Headquarters or Pay commission. If
so, the details of the proposal may kindly be provided to the Association. An
immediate action is also requested to be taken on the issue in accordance of
the final decision taken in the meeting.
13. Regarding para 3.12 of the
minutes, the decision regarding this point is also mis-recorded. It was decided
to recommend the case to the DOPT in true prospective. An immediate action is requested
to be taken on the issue in accordance of the actual decision taken in the
meeting. It is reiterated that no nodal department is above the legal courts.
14. As far as para 4 of the minutes
is concerned, many relevant points have already submitted in a reoriented
manner vide Ref. No.
11/M/16 Dt. 22.01.16 of the Association for due redressal. Necessary action may
kindly be taken accordingly.
