time scale/NFG with the MACP upgradation.

Kindly
refer to the various representations of the Association on the above matter.
2. Your kind attention is
also invited in the verdict given in OA No’s. 200/00773/2016, 200/00849/2016,
200/00872/2016, 200/00961/2016, 200/01007/2016 and 200/00111/2017 by the Hon’ble
CAT, Jabalpur.
3. In the
verdict given in r/o the above OAs, the Hon’ble CAT has ordered two things as
below-
i) The time scale/NFG of Rs. 5400/- got automatically on the
completion of four years of service is not to be counted as one MACP
upgradation.
ii) The orders of the Hon’ble
CAT are to be implemented in rem.
4. No need to submit that the
issue has also already been finally settled at the level of Hon’ble Apex Court in
the Special Leave to Appeal (C) No. 15396 of 2015 in the Balkrishnan case.
It has also been settled in this case at the level of the Hon’ble Apex Court
that the Grade Pay of Rs. 5400/- in PB3 is no way higher than the Grade Pay
of Rs. 5400/- in PB2. No need also to submit that the matter finally
settled at the level of the Hon’ble Apex Court is always to be treated as the
law of the land.
5. Accordingly, it is
requested that the due circular may kindly be issued-
i) Not to offset the
time scale/NFG with the MACP upgradation.
ii) To quash para 8.1 of
the MACP instructions.
iii) To grant the Grade
Pay of Rs. 6600/- after the Grade Pay of Rs. 5400/- (whether in PB2 or PB3).
