It is really unfortunate that our own officers are
obstacle in the DPC for the post of Asstt. Commissioner. Recently on 23.04.19, one more stay on the DPC has been
given by the Hon’ble High Court of Madras. One of our Superintendents from Chennai
Zone namely Sh. S. Vijaykumar has taken this stay in Contempt Petition No.
745/2019 passed in WP No. 34805/2018.
The concerned bench of the Hon’ble High Court ordered not
to issue promotion order until further orders. The case is to be listed further
as and when the same bench sits and not otherwise. We don’t know when the
same bench would sit and how long the stay would continue. This bench perhaps was not the permanent one but was constituted on temporary basis.
Needless to say that
everybody has right for legal fight for his/her cause. But it is disappointing
that repeated stays are being taken despite the promotions to be ordered merely on ad hoc basis. The issue in this stay seems to be related to "own merit". These repeated stays are really troublesome and stopping the direct promotions not only of Superintendents but also of Inspectors and Ministerial Officers on cascading bais.
One more stay is being listened to be from Mumbai CAT for Customs side stopping DPC for all of three categories and is to be heared on 02.05.19. However, its actual details are yet to be confirmed.
