As we all know that the Apex Court has established the law in the Contempt Petition (C) No. 928 of 2016 on 26.04.19 that any person aggrieved with the violation of general directions issued in a judgement can file contempt petition. Accordingly, it is being planned to file the contempt petition as below-
(1) Hariram case in the Hon'ble Delhi High Court regarding offset of time scale with MACP upgradation. This case has already been finalised, settled and accepted.
(2) Subramaniam case in the Hon'ble Supreme Court/Madras High Court regarding time scale after ACP/MACP upgradation and offset of time scale with MACP upgradation.This case has also already been finalised, settled and accepted.
(3) Balakrishnan case in the Hon'ble Supreme Court/Madras High Court regarding grant of GP of Rs. 6600/- after grant of time scale in GP of Rs. 5400/- as no difference being between GP of Rs. 5400/- in PB2 and PB3. This case has also already been finalised, settled and accepted.
Such contempt petition may also be filed in the Hon'ble Supreme Court for promotion of ad hoc/temporary Asstt. Commissioner to the post of Deputy Commissioner on completion of four years of service in r/o A. K. Chatterjee (AIR 1991 SC 996, 1991 LabIC 478) case.
