Sub: Guidelines for
Uniform.
Sir,
Your kind attention is
invited to the letter F. No. 8 / B/90/ HRD (HRM) / 2011 (Part-I) /4853 Dt.
21.10.14 on the above subject as well as the various letters of the Association
on the issue.
2. It is submitted with due regards that the subject matter was initiated in Directorate
of HRD on the request of the Association. The Association requested to
formulate the statuary provisions to wear the uniform, if its wearing is
necessary in consonance of the nature of the job. If it happens, it was
requested to make it compulsory for all “from top to bottom” and also treat it
in the graceful & respectful manner granting all the required facilities
& amenities to the officers. It is a matter of great concern that the
uniform is being imposed on our officers only for decorative purposes
particularly for protocol duties for personal pleasures of the concerned
authorities which can no way be said to be graceful and respectful either for
the department or the officers. However, the CBIC replied to the Central
Information Commission in r/o some RTI application that there exist no
statutory provisions in the CBIC to wear the uniform. The
Commission also asked the CBIC to issue the detailed and clear guidelines in
this regard but the same are still awaited.
3. It was mentioned in the draft provided by HRD wing that the uniformed
officer has to salute in Naval and Military type. No need to submit that all of
the officers from “top to bottom” wear the uniform in Navy and Military. It is
also mentioned somewhere in the draft that the officer is not to travel in the
public transport when in uniform. In such case, the CBIC will have to provide
the official vehicle to all of the officers as per the entitlement. In the Navy
and Military, they wear the uniform with complete respect and grace at every
level without being forced to
bring the uniform in the bag to office and wear it after standing in some
corner of the office in disrespectful and non-gracious manner. Not only it, they are also
provided with the best pay packages, career prospects and other various
facilities & amenities. The Association expects that the same would also be
provided to our officers, if the uniform is made compulsory.
4. No doubt that the wearing of uniform is a matter of pride in the above
organizations and also in police organizations. Uniform is also given
tremendous social respect everywhere. But side by side, it is also true that it
is worn in the above organizations from top to bottom without any
discrimination or exception to perform uniform-related duties and also with
complete respect and due facilities. But very unfortunately, the officers are
forced to wear the uniform even at the places where it serves no purpose in our
organization. The main purpose of the forced wearing of the uniform
in CBIC has become merely to pacify the ego of the higher authorities by
threatening of ill consequences to subordinate officers, if they don’t wear the
uniform to please the higher authorities. No need to say that this practice is totally
disrespectful, humiliating and non-gracious for all including our officers and
our organization of CBIC. The officers are exploited & harassed
by being asked to come in uniform to office, if authority is not happy with
them.
5. As far as the GST regime is concerned, the officers are not aware whether
uniform is to be worn or not because there is no prescription of uniform under
GST. Even if it is to be worn, there is no prescription of badges and other
standards for uniform under the GST. Accordingly, proper uniform is to be
notified in GST regime for all officers alongwith all facilities and amenities
including vehicles with statutory provisions, if it is made mandatory to wear.
6. If it is made mandatory
to wear the uniform under GST, it is requested to kindly-
i) Issue the statutory provisions for wearing of uniform from top to bottom making
due prescription of uniform as well as badges and other standards etc.
ii) Ask the officers to wear the uniform only for the purpose of disposal
of the official duties.
iii) Make the wearing of uniform compulsory from top to bottom for all like in
Navy & Military under statutory provisions.
iv)
Provide government vehicles as per the entitlement, so that our uniformed officers
are not forced to travel in public transport.
v) Provide the best pay packages,
career prospects and other various facilities & amenities to our officers
like Navy and Military and other uniformed officers.

Sir,
Kindly refer to the
earlier communications of the Association regarding the subject matter.
2. It is submitted with due regards that the DPCs are being delayed despite of
the DOPT instructions to fix the responsibility of the concerned officer for
the lapse in adherence to the prescribed time frame in holding of DPCs under
the DOPT OM No. 22011/9/98-Estt. (D) Dt. 14.12.2000. Non-serious
attitude of the CBIC on the issue is very well evident from the following
figures showing tremendous delay in every DPC -

3. It is also worth to
submit that the repeated legal stays/verdicts are coming in the way of
DPC/promotion perhaps due to the improper presentation of facts before the
courts or inaction/delayed action by the concerned authorities due to which the
officers are forced to retire without promotion despite of thousands of posts
being vacant. Even the final action on the final legal verdicts is awaited from
the CBIC. Due to the lack of timely action on the part of the concerned
authorities in legal cases, the officers are totally demoralized being unable
to get the rarest IInd promotion of the career without any fault on their part.
The officers due for promotion are crying and retiring without promotion every
month for the want of DPCs despite of thousands of promotional posts being in
hands. The DPC was not conducted even during the period when there existed no
stay on DPC due non-serious approach of the CBIC. Now, the final verdicts have
come in all the existing cases due to which the DPC was stayed.
4. As per the DOPT
OM No. 22011/1/2011-Estt.(D) Dt. 23.04.15, the Appointment Committee of
Cabinet has viewed this matter seriously. But very unfortunately, the matter has
never been taken seriously by the CBIC. As per the DOPT provisions vide OM No. 22011/9/98-Estt
(D) Dt. 08.09.98 reiterated in OM No. 22011/1/2011-Estt (D) Dt. 11.03.11 and
22011/1/2011-Estt (D) Dt. 13.12.13, the DPC for a financial year should be
conducted well in advance latest by the month of January of the preceding year.
Further, the DOPT
OM No. 22011/14/2013-Estt(D) Dt.08.05.17 says that the DPC for the calendar year should be
convened latest by the month of October of the preceding year. No need to
submit that the prescribed schedule should strictly be followed whether the DPC
is conducted for regular promotions or ad hoc promotions. Above provisions
have been reiterated by the DOPT time to time.
5. It is further submitted
that the chain vacancies on account of cascading effect from higher side are
also required to be included for the promotion to the post of Asstt.
Commissioner as per the DOPT OM No. 22011/9/98-Estt(D) Dt. 06.10.99.
It is clearly mentioned in this OM that the existing and clear anticipated
vacancies as well as chain vacancies on account of retirements, promotions etc.
in all the higher grades/hierarchy should be included for the purpose of DPC.
6. It is also submitted that there exists no legal stay as on date against
the convening of the said DPC/s. It is also worth to mention that 2118
temporary posts of Asstt. Commissioner would exist only upto 18.12.21, for
which only less than 2 years are remaining. Our officers are forced to retire
without promotion (only IInd in the career of 35-40 years) due to this
indifferent approach and delayed process despite of thousands of promotional
posts being in hand. There exist more than 1839 posts of Asstt. Commissioner
meant for promotion from Group ‘B’ vacant as on 30.11.19 as per the disposition
list placed on the CBIC site for the month of November, 19. The posts for the
year 2020 and the month of December, 2019 are yet to be added in the above
figure. It is also worth to mention that a good number of officers have already
retired without promotion after the DPC of May, 18.
7. Due to the delayed process, even the extended panel is unable to give any
benefit to our officers as the officers figuring in the extended panel also
retire before the holding of the DPC. The concerned authorities are requested
to be quite serious for us remembering that we are the actual tools and are
always instrumental in collecting the revenue for the govt. always above the
targets. Our officers are merely being punished without any fault of them by
snatching their legitimate right of promotion.
8. Giving due
consideration to above submissions alongwith DOPT provisions, it is requested to
hold the immediate DPC against all unfilled/existing/anticipated posts of
Asstt. Commissioner.
