Kindly refer to the CBIC letter F. No. A-23011/25/2015-Ad.IIA Dt. 13.05.20.
2. It is to submit with due regards that a letter of even number Dt. 20.06.16 of the CBIC has been reiterated in the above referred letter Dt. 13.05.20. The letter Dt. 20.06.16 enforces that the Non-Functional Grade Pay of Rs. 5400/- granted to the Superintendents needs to be counted as one financial upgradation for the purpose of MACP Scheme.
3. It is brought to your kind notice that the letter Dt. 20.06.16 of the CBIC has already been quashed and set aside by the Hon’ble CAT of Jabalpur in the OA No. 200/00849/2016, 200/00872/2016, 200/00961/2016, 200/01007/2016 and 200/00111/2017 by a common order. The review petition of the CBIC was also dismissed in the matter. Further, the order of the Hon’ble CAT of Jabalpur was also confirmed by the Hon’ble High Court of Jabalpur ascertaining that-
            (i) The non-functional upgradation can’t be treated as promotion or financial upgradation for the purpose of MACP Scheme.
(ii) The Grade Pay of Rs. 5400/- in PB 2 and Rs. 5400/- in PB 3 is erroneously treated as separate grade pays for the purpose of grant of upgradations under MACPS. 
4. The Hon’ble CAT, PB, New Delhi also directed in OA No. 2806/2016 to review the circular dated 20.06.2016 as a separate exercise and re-issue after incorporating changes as are considered necessary on the basis of the order given by the Hon’ble CAT.
5. In view of the above, the reiteration of the letter Dt. 20.06.16 by the CBIC amounts to be the contempt of the Hon’ble CATs of Jabalpur and New Delhi and also of the Hon’ble High court of Jabalpur.
6. The CBIC is, therefore, requested to obey and implement the orders of the Hon’ble CATs of Jabalpur and New Delhi and also of the Hon’ble High Court of Jabalpur instead of reiterating the letter Dt. 20.06.16.
