Sub: Request for meeting under Employee Grievance Redressal Mechanism.
Sir,
It is to submit with due regards that the minuted meetings under Employee Grievance Redressal Mechanism should be held as per the directions of the CBIC itself at the regular intervals of two months extendable by one month. But these meetings are not being held either at Board level or field formations level for long. Holding of such meetings is very important to redress the grievances of staffside to minimize the litigations.
2. Due to non-holding of such meetings, the grievances of the staffside have been accumulated into an endless list. Even the court verdicts are not being implemented. Not only it, the issues recommended by the CBIC itself are countered by the CBIC. Some of such issues pending for long are as below-
A. DPC for the transition year 2018-19 and calendar years 2019 and 2020 for the post of Asstt. Commissioner.
B. Batch to batch Non Functional Financial Upgradation to grant financial parity to our officers with the best placed counterparts of CSS etc. to compensate the lack of promotions.
C. Implementation of in-situ promotion scheme as approved in Board meeting of 18.02.11 from the date of its approval.
D. Bringing of scheme for the Central Excise executive officers to remove their stagnation independent of cadre restructuring as approved by the Cabinet in the year 2013.
E. Complete implementation of the order given on 24.02.95 in OA No. 541/1994 by Jabalpur CAT regarding arrears of pay.
F. Implementation of the Subramanium verdict in rem.
G. Retrospective implementation of enhanced pay scale of Central Excise/GST Superintendents w.e.f. 01.01.96 at par with the Superintendents of NCB.
H. Promotion of ad hoc Assistant Commissioners promoted against temporary posts to the post of Deputy Commissioner on completion of 4 years of service and counting of temporary service for further promotions.
I. Implementation of para 7.15.24 of 6th CPC report to enhance the pay scale of our Superintendent from the date of the upgradation of the pay scale of the Chief Enforcement Officer/upgraded/redesignated post.
J. Undoing of MACP irregularities (para 8.1, offsetting of MACP upgradation with time scale, and stepping up of pay).
K. Upgradation of posts & scales like state governments under GST.
L. Flexible Complementary/Dynamic Assured Career Progression Scheme for our officers in accordance of the observations of CBIC made under OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16 about the disparities in promotions that it is an alarming anomalous situation.
M. Taking action on DOPT OM issued vide Dy. No. 1173974/16/JS(CPC) of the month of June, 2016.
N. Implementation of the report of the Stagnation Committee headed by Sh. Balesh Kumar, the then ADG, HRM-I.
O. Implementation of the verdicts given in OA No. 2323/2012 by the Principal Bench of CAT.
P. Promotion of our Superintendent to a STS post like the most of the gazetted group B officers in govt. of India as well as state governments (already recommended by CBIC vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16).
Q. Finalisation of cadre restructuring which is still pending with the Board. It was having deadline of 31.01.20 to reach DOPT.
R. Implementation of the DOPT OM No. AB-14017/12/88-Estt. (RR) Dt. 25.03.96.
S. Implementation of the legal verdicts/settled issues.
T. Creation of Separate Service for our officers.
U. Initial pay scale to Central Excise/CGST Superintendent at par with DSP of CBI (already recommended by CBIC vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16) alongwith other perks & allowances etc.
V. Non-functional time scale in PB3 to Central Excise/CGST Superintendents like other counterparts including Section Officers of CSS instead of PB2 after 4 years of service.
W. Merger of Level 9 and 10 (already recommended by CBIC to vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16).
X. Uniform promotional hierarchy for all Group ‘B’ officers across all departments/ministries in Govt. of India as agreed by CBIC vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16.
Y. Scheme to improve the career prospects of Central Excise/CGST Superintendents to grant minimum 5 functional promotions as our officers are retiring with single promotion in the service career of 35-40 years (already recommended by CBIC vide OM F. No.A-26017/154//2015-Ad.IIA Dt. 22.02.16).
Z. Parity in promotions with other counterparts.
AA. Unification of cadre of Inspector, Examiner & Preventive Officer at non-gazetted level and Superintendent of Central Excise/CGST as well as Customs & Appraiser at gazette level.
3. It is worth to submit that our counterparts are getting promotions upto the level of Commissioner/Joint Secretary whereas our officers are getting promotion only upto the level of Asstt. Commissioner or Superintendent (after abolishing temporary posts of Asstt. Commissioner) after common entry into same grade. Not only it, our senior officers are forced to work under junior officers of Customs. 
4. As far as pay matters are concerned, our counterparts have been placed in better positions totally ignoring the importance of work responsibilities and duties being performed by us and also ignoring various recommendations.
5. In view of the above, it is requested to kindly hold a minuted meeting under employee grievance redressal mechanism at an early date. If the meeting is not possible to be held physically in person due to corona conditions, it is requested that the same may kindly be held by video conference to redress the above mentioned issues in the first meeting under your kind control. Other issue will be submitted in next meetings.
