Sub: Renewal of All India Association of Central
Excise Gazetted Executive Officers (AIACEGEO)-claim by two factions for being
the legitimate office bearers of the Association-reg.
Sir,
Kindly refer to
the letter Ref. No. 202/AIB/A/20 Dt. 04.12.20 of the Association and letter Ref.
No: 55/CBIC/2020 Dt. 04.12.20 of one namely Sh. R. Manimohan mentioning himself
as the Secretary General of All India Association of Superintendents of Central
Tax who was earlier impersonating as the Secretary General of this Association.
2. It is to submit with due regards that the
CBIC asked vide F. No. 12017/07/2017-Ad.IV.A Dt. 03.12.20 to resolve the
dispute bilaterally or alternatively, to seek fresh recognition in different
name. The Association has already submitted that it is the original All India
Association of Central Excise Gazetted Executive Officers. Now, there is no
other claimant of the name of this Association as Sh. Manimohan has preferred
to change the name of his association immediately after coming across the above
said letter of the CBIC without
approaching this body to resolve the issue bilaterally.
3. It is further
to submit that the Association has already submitted the DDO certificates to
the tune of at least 5425 on being insisted by the concerned section despite of
the renewal of the recognition not required under the RSA Rules as also replied
by the CBIC under RTI vide F.No. A-12013/05RTI/202020-Ad.IV-A Dt. 25.02.20 that
renewal is merely a practice.
4. Despite of it, on being
insisted by the concerned section, the Association submitted papers for renewal
vide its letter Ref. No. 218/R/14 Dt. 26.11.14. The amended
constitution of the Association was also resubmitted vide letter Ref. No. 112/R/15
Dt.
08.09.15. The letters of the Association were responded by
the
concerned section vide letter F.No.B. 12017/09/2015-AdIVA Dt. 11.12.15. The said
letter of the CBIC was responded by the Association vide its letter Ref. No.
156/R/15 Dt. 27.12.15. After it, the concerned section kept silence on the
issue. It is reiterated that the Association has been complying all the conditions and
Govt. instructions set out in the CCS (RSA) Rules, 1993 and will keep to comply
the same regularly. The Association submitted 5122 DDO certificates vide its letter
Ref. No. 48/AIB/A/18 Dt. 20.02.18 and 303 DDO certificates vide its letter Ref.
No. 178/AIB/A/18 Dt. 17.07.18 on being insisted by the concerned section again.
But unfortunately, the dealing hand kept silence on the DDO certificates
submitted by the Association due to the reasons known to him only.
5. Sh. Manimohan
has also claimed that he has submitted 6251 DDO certificates. In this regard,
it is to submit that all of the DDO certificates submitted by him belong to
this Association because of being issued in its name and may kindly be treated only
as our share instead of being counted as the share of All India Association of
Superintendents of Central Tax of which Sh. Manimohan has claimed to be
Secretary General. As per RSA Rules, he will have to submit fresh DDO
certificates in the new name now, if he is wants to form another association.
6. It is reiterated
that this Association also have promotee officers including Asstt.
Commissioners as its members as per its constitution like all other
associations under the CBIC and also like Income Tax Gazetted Officers
Association as well as Central Secretariat Service Officers Association.
7. In view of the
above, it is requested that a fair and legal decision may kindly be taken on
the issue by adjudicating all points submitted by the Association in the past by
passing a legal speaking order covering all submissions made by the Association.
