Sub: Extension of last date of issuance
of SCN or any other action form 31st December, 2020 to 31st
March, 2021/30th June, 2021.

refer to the letter Ref. No. 205/AIB/A/20 Dt. 09.12.20 of the Association.
2. It
is to submit with due regards that the officers are kept busy in various
non-statutory reports and other works even out of office hours and holidays.
For this work, message has been given that no officer will be granted leave and
the officers have to attend the work even on Saturdays, Sundays and holidays
till March, 21.
3. They
are asked to provide IMMEDITE reports whole day on whatsapp in time
bound manner giving them only a few hours and sometimes even less than hour. Reporting
formats are also kept changing. Some samples of whatsapp messages given by the
higher authorities are as below-
i) I have
changed the format.
ii)
Revised format for daily report.
iii)
Physical verification to be initiated today.
iv)
Suo moto cancellation is to be initiated in all cases.
v)
Please adhere to deadline.
vi)
Please send complete report by 1600 hours (message received in noon).
vii)
Report may be updated by 10 a.m. tomorrow.
viii)
Action must be initiated in 100% cases today.
ix)
Reports may be submitted immediately (out of working hours message).
x)
CCO is pressing hard for report (out of working hours message).
xi)
Submit report by 1700 today positively (after lunch hour message around at
1500).
xii) Submit
report by 1600 today positively (after lunch hour message around at 1500).
xiii)
A meeting will be taken at 4.30 p.m. today (after lunch hour message around at
1500).
xiv) Daily
report should be submitted positively by 5 p.m. (after lunch hour message
around at 1500).
xv) Process
of verification has to be initiated in all cases to be completed by Thursday
evening or Friday morning.
xiv) Cancellation
of registration should be done immediately.
xxi)
Provide the report in attached format by today evening.

The above messages reflect the position of one day (24 hours) only. Officers
are facing such messages every day. The reports are being sought on personal formats
instead of any statutory format. Thus, the officers are indulged 24 hours in
providing the non-statutory reports being asked from them in personal formats
by the authorities without having anytime for statutory work. Due to which,
statutory works are being suffered. For example, third party statutory
notices are to be delivered to the parties within this month. But
unfortunately, this statutory work is hampered due to non-statutory works being
asked from officers every minute for whole day. This is only one example.

Not only it, the officers are being forced to form e-mail and whatsapp groups
with the trade to pursue for filing returns and deposit tax. They are also
being forced to send sms and make telephonic calls with the trade. It is not
understood how this all is possible humanly and practically particularly when
the officers don’t have time even for statutory functions. Question arises
whether there really remains anytime spared with the officers to do this all.
Moreover, the officers are being forced to do this all using their personal
mobile androids phones whether they are able to afford it or not.

The last date of 31st December, 2020 for completion of enquiry and
issuance of SCN for financial year 2015-16 including third party SCNs and any
other actions falling due upto 31st December, 2020 for Central
Excise, Customs & Service Tax matters is approaching very fast. Under the
prevailing circumstances, it is very likely that the SCN and any other action may
fail to be completed within the time limit inspite of the sincere, dedicated
and whole hearted efforts of our officers.
7. Under
the circumstances, the officers are under tremendous tension and pressure which
may result in heart or brain stroke to many. Corona pandemic is also
aggravating the situation multifold. It seems that we are throwing our officers
into deep problems in undue manner. As a result, many officers have opted for
VRS. It is also worth to submit that the Range and Division offices are
functioning even with less than 50% strength due to the shortage of manpower. Corona
pandemic has further lessened the strength significantly. The system is also
not responding properly and more than 50% time is also wasted in it and
officers are put in pity situation because authorities are not ready to listen.
8. In
view of the above, it is requested in the interest of the revenue that the last
date for the issuance of the SCN or time
limit for completion or compliance of any action by any authority in r/o
Service Tax, Central Excise and Customs falling due upto 31st
December, 2020 may kindly further be extended at least upto 31st
March, 2021 or 30th June, 2021 and also the officers may kindly be
saved from undue pressure and tension in r/o various non-statutory reports/functions.
