We filed OA No. 2806/2016 in Delhi CAT for in-rem implementation of Balakrishnan/Chandrasekaran verdict. Chandrasekaran verdict was based on Balakrishnan verdict relating to MACP. SLP and review petition of govt. was dismissed by Supreme Court in Balakrishnan case.
In Balakrishnan case in Madras High Court, it was established that-
1) Time scale/NFS can't be offset with MACP upgradation means that 4 years time scale/non functional scale can't be treated as MACP upgradation.
2) Grade Pay of Rs. 5400/- in PB3 is no way higher than Grade Pay of Rs. 5400/- in PB2 means that both are one and same.
3) Grade Pay of Rs. 6600/- is next higher Grade Pay to Grade Pay of Rs. 5400/- means that Grade Pay of Rs. 6600/- will be granted after 4 years time scale/NFS in Grade Pay of Rs. 5400/- (whether in PB2 or PB3) as MACP upgradation.
Delhi CAT ordered not to offset time scale/NFS with MACP upgradation, if got prior to 01.09.08. When CBIC didn't implement CAT order within given/reasonable time, we filed contempt in CAT. CBIC filed W P(C) No. 3284/2021 in Delhi High Court against our contempt. High Court stayed contempt proceedings till matter is decided in High Court. As per advice of our advocate, maximum number of officers should intervene in said writ from all over country including retired officers.
