Proposal for Cadre Restructuring-2019 of CBIC – regarding.
Sir,
First of all, welcome to
the coveted seat. The Association hopes that a new era would start now to
redress the long pending grievances of the staffside under your kind headship.
2. Inviting your kind
attention to the letters Ref. No. 259/AIB/CR/19 Dt. 30.12.19 and 110/AIB/C/20 Dt.
07.07.20 of the Association, it is to submit with due regards that the cadre
restructuring proposal of the CBIC is yet to be sent to the DOPT whereas it was
to be sent to them upto 28.02.19 (extended date).
3. It is further submitted that a proposal
for separate service (IRS Branch B) for our officers has been recommended on
the pursuance by the Association but the number of posts in this proposed
separate service are required to be enhanced at each level in proportion of the
cadre strength of our officers. This can be done by optimizing
the number of posts at Commissioner level and abolishing the posts above the
level of Commissioner.
4. Under
GST, only one Commissioner is working in the state governments without any post
above this level. In contrary to it, huge number of posts exist at the level of
Commissioner and above in the CBIC under Central Govt. without any functional
requirement under GST. So, immediate
steps are required to minimize the posts at the level of Commissioner in
Central GST and distribute them in the proportion of cadre strength between DR
IRS officers and promotee officers and all posts above the level of
Commissioner are required to be abolished to utilize the same for matching
saving to enhance the posts in IRS Branch B meant for promotee officers.
The ratio in the hierarchy should also be reasonable as per the DOPT norms and
it should not be less than 1:3.
5. The malafide of the CBIC is clear
from the fact that they have proposed the post of Deputy Commissioner more in
number (677) than even the sanctioned strength of the direct recruit Asstt.
Commissioners (624) whereas only 350 posts of Deputy Commissioner have been
proposed for 3092 promotee Asstt. Commissioners. Not only this, the malafide of
the CBIC is also clear from the fact that they have merged the posts at the
level of Joint Commissioner and Additional Commissioner to grant Non Functional
Grade to direct recruit Asstt. Commissioners on Ist day of 14th year
calculated from the year following the year of examination whereas they not
only differentiated the posts at these levels for promotee officers but also
proposed meager number of posts for promotee Asstt. Commissioners to deprive
them from promotions as well as Non Functional Grade. Likewise, they proposed only
nine posts of Commissioner for 3092 promotee Asstt. Commissioners whereas they
proposed 497 posts of Commissioners and above for 624 direct recruit Asstt.
Commissioners instead of proposing the posts in the proportion of the cadre
strength of both categories.
6. It is reiterated that
the number of the posts in IRS Branch B have been proposed neither in the
desired number nor in the desired proportion. It is also worth to submit that
the counterparts of our officers in our department of Revenue itself as well as
other departments are already getting the promotions upto the level of
Commissioner and Joint Secretary. In our sister organization of CBDT also under
the same department of Revenue, our counterparts are already reaching the level
of Commissioner. Not only it, our counterparts are also already reaching the
level of Addl. Commissioner and Commissioner in our own organization of CBIC
despite of being belonged to the same cadre of the Inspector. It is also worth
to mention that the career prospects of the direct IRS officers have been
improved even better than IAS on account of the number of posts created at
various levels in the last cadre reviews and repeated relaxations sought from
the DOPT but nothing has been done for our officers joining the job as Inspector
of Central Excise/CGST, whether direct or promotee.
7. To nullify the stand of
the Association, the CBIC may pretext that the Association has been
de-recognised. In this regard, it is to submit with due regards that this step
of derecognition has been taken by the CBIC again in malafide manner without
any reasoning or valid reason perhaps due to the reason of the grievances of
staffside being raised by the Association continuously and CBIC not intending
to redress the same. On the issue of de-recognition, a legal notice has already
been served upon the CBIC but again without response from their side as usual.
8. In view of the above,
it is requested-
(i)
The ratio for promotions should kindly be identical for
direct Group ‘A’ service and Branch ‘B’ service. Number of promotional posts
and feeder posts should be in the same proportion at each level in both
services.
(ii)
Not to bifurcate the number of the posts of Joint
Commissioner and Addl. Commissioner in IRS Branch ‘B’ and to promote our Inspector to the post of Addl. Commissioner on Ist
January of seventeenth year of service.
(iii)
To merge three Group ‘B’ Executive streams with retrospective
effect to bring the officers of same year to same level of promotion.
(iv)
To abolish extra posts of Commissioner
and all posts above the level of Commissioner.
(v)
To shift
administration of CBIC in the hands of senior IAS officers for smooth, fair and
impartial functioning instead of looking vested interests of a particular
class, if CBIC is unable to do justice to Group ‘B’ executive officers and is
unable to redress their grievances.
(vi)
The cadre restructuring proposal may kindly be sent to the
DOPT at an early date for further action.
