01217-2020 by Hon’ble High Court of Jabalpur (enclosed herewith).
Sir,
It is submitted with due regards
that the CBIC clarification Dt. 20.06.16 for
counting of non-functional Grade Pay/time scale of Rs. 5400/- in Pay Band-2 as
one financial upgradation for the purpose of MACP Scheme has been quashed by
the Hon’ble Court.
2. The Hon’ble Court also observed
under para 31 of its original order for which subject mentioned Revision Petition
was preferred by the Govt.-
“Merely
because of the implementation of Sixth CPC’s recommendation Grade Pay of
Rs.5400/- is in two pay bands viz. PB 2 and PB 3, the Grade Pay of Rs. 5400 in PB 2 and Rs. 5400 in PB 3 is erroneously treated as
separate grade pays for the purpose of grant of upgradations under MACPS.”
3. Thus,
the verdict also established that the Grade Pay of Rs. 5400 in PB 2 and Rs. 5400 in PB 3 is one and same and none is
higher than other.
4. In view
of the above, it is requested to implement the order in its true spirit in-rem
by granting Grade Pay of Rs. 6600/- after time scale of non-functional Grade Pay/time scale of Rs. 5400/- in PB-2 and next
upgradtion in Grade Pay of Rs. 7600/- under MACPS.
