Sub: Parity in promotions with the Examiners.
Sir,
It is submitted with due regards that many of the
officers, who joined the CBEC/CBIC as Examiner, have already become Asstt.
Commissioner/Deputy Commissioner/Joint Commissioner/Addl. Commissioner whereas
the officers joining with them as Central Excise/CGST/Central Tax Inspector are
working on lower posts. In the last many orders issued by the CBIC, many of the
officers joining as Examiner have become Addl. Commissioner/Joint Commissioner
whereas the officers joining with them as Central Excise/CGST/Central Tax
Inspector are still working as Inspector or Superintendent.
2. It is further submitted that that the Inspectors of
Central Excise, Preventive Officers and Examiners have been shown as Inspector
in the recruitment rules and are promoted to the post of Superintendent of
Central Excise, Superintendent of Customs and Appraiser of Customs
respectively. Further, the Inspector of Central Excise has been mentioned as
Inspector of Central Excise and Land Customs in the recruitment rules.
3. The Inspector of Central Excise (now CGST/Central
Tax) not only works in Central Excise/CGST/Central Tax but he/she also works in
Customs including ICDs, airports etc. alongwith Examiners performing the same
set of duties and responsibilities. Likewise, the Examiners have also worked in
Central Excise Zone with the Central Excise Inspectors performing the same set
of duties and responsibilities. Likewise, the Central Excise Superintendents
and Appraisers have also worked together to perform the same set of duties and
responsibilities.
4. All of three posts, i.e., Inspector, Preventive
Officer & Examiner/Central Excise Superintendent, Customs Superintendent
& Appraiser, are merged at the level of Asstt. Commissioner after being
promoted and are further promoted in the same administrative hierarchy
performing same set of duties and responsibilities. All of three categories of
Inspector are recruited through one & same recruitment process in one &
same organization of CBEC/CBIC under one & same Department of Revenue under
one & same Ministry of Finance with one & same administrative
hierarchy.
5. But very unfortunately, the Examiners easily reach
the level of Addl. Commissioner whereas the officers recruited as Inspector of
Central Excise retire at lower levels to face acute humiliation and gross
injustice. Accordingly, many of the Examiners recruited with Inspectors but
lower in all India merit have already become Addl. Commissioner. This fact can
very well be verified from the concerned records including Civil list and
promotion orders etc. available with CBIC. Due to it, senior officers recruited
as Inspector of Central Excise/CGST/Central Tax are forced to work under their
junior officers recruited as Examiner.
6. In view of the above, all of three categories being
belonged to same cadre of Inspector and performing same set of responsibilities
& duties in the same administrative hierarchy under the same organization
of CBEC/CBIC under the same Department of Revenue and same Ministry of Finance
and also being recruited through same process in same pay scale, the Inspectors
of Central Excise may kindly be granted NFSG or pay scale of Addl. Commissioner
prior to a date since when the Examiners recruited with or after them have been
granted after entry into group A with all consequential benefits in accordance
of all India merit list maintaining senior positions. The Inspectors of Central
Excise may also be given the benefits of the promotions upto the level of Addl.
Commissioner or above from the respective dates since when the said Examiners
have been promoted to the respective post with all consequential benefits.
