Sir,

Kindly refer to the order Dt. 09.05.22 of the Hon’ble Central Administrative Tribunal, Allahabad in OA No. 330/00404/2022 (copy enclosed) and various representations submitted by the Association on the subject matter.

2. The Hon’ble Tribunal allowed the OA and ordered to give the benefit of the order within four months. The Hon’ble Tribunal also observed the order to be in-rem and this is 14th or 15th order of same type in a raw by the Hon’ble Tribunal.

3. The matter pertains to the grant of Non Functional Grade (NFG) after completion of four years of service in the pay scale of Superintendent got on account of ACP upgradation. For the want of in rem implementation of the Subramaniam verdict, thousands of officers are forced to approach legal courts regularly throughout the country increasing the needless litigations. The matter is based on the verdict given by the Hon’ble High Court of Madras in W.P. No. 13225/2010 in the case of Sh. M. Subramaniam. The SLP and Review Petition in SLP filed by the Govt. in this matter against the order of the Hon’ble High Court of Madras were also dismissed by the Hon’ble Supreme Court.

4. The Hon’ble Tribunal also directed as below-

“A copy of this order be also served on the Union Finance Secretary by the Registry to consider issuing directions on identical matters such as above for in rem consideration and not in personam. This would avoid needless litigation in the future.”

5. In view of the above, it is again requested to kindly implement the order in-rem.
