02/AIB/C/23 Dt. 02.01.23 of the Association.

It is submitted with due regards that the Association came to know by DOPT
monthly status of cadre review/restructuring that some reply from CCA is
awaited in r/o the ensuing cadre restructuring in CBIC. The Association also
came to know that there is some objection from DOPT to create separate service
for our officers because of not existing any precedent. It is also worth to
mention that this service has been proposed on pursuance by the Association
having posts upto the level of Commissioner for our officers. The creation of this service is very much
required keeping in view that the most of our officers are retiring as
Superintendents after getting one promotion whereas other counterparts are
reaching the level of Additional Commissioner and Commissioner (5/6
promotions).
3. The objection
of the DOPT doesn’t seem valid as no precedent is required to initiate a new
thing. If we do everything based on the precedent, nothing new can ever be
created. Even otherwise, there already exist so many separate services for
Group B officers including the following ones-
(i) Central Secretariat
Service upto level of Joint/Additional Secretary.
(ii) Indian
Foreign Service.
(iii) Indian
Forest Service.
(iv) DANICS.
(v) DANIPS.
4. The officers
recruited in all of above services also enjoy the benefit of Central Staffing
Scheme. The Central Secretariat Service is an ideal example for Group B
officers enjoying the promotions upto the level of Additional Secretary and
also taking benefit of Central Staffing Scheme alongwith the officers of Indian
Administrative Service. This is the best example of separate service for Group
B officers with Group A officers in Indian Administrative Service. It is also
worth to note that our Inspectors and the Assistant Section Officers of Central
Secretariat Service are recruited through common recruitment process.
5. It is further
submitted that the proposal for separate service for our
officers was also mentioned as under consideration during the earlier cadre
restructuring presentation on 18.01.11. The creation of the separate service on
the lines of CSS etc. was also recommended by DOPM in its file F. No.
8/B/4/O&PM/2008 submitted to the Member (P&A) on 17.01.08 (vide letter
F. No. 8/B/33/O&PM/2008 Dt. 06.05.08 of the Commissioner of DOPM). Further,
the creation of the separate service on the lines of CSS etc. was also
recommended by the Member (P&A) in F. No. 11013/67/2007-Ad IV of CBEC on
24.01.08. The direct IRS officers Association also recommended for the same
simultaneously. The creation of the separate service for our officers was also recommended
vide F.No.A.26017/147 /06-Ad.II.A Dt. 04.01.07 as one of the measures to remove
our stagnation. The only need is to enhance the number of posts at each
level in this service in proportion of the basic cadre strength of our
officers. It is very unfortunate that the said service is yet to be created
despite of so many recommendations made even 1.5 decades ago.
6. One may say that required number of eligible
officers would not be available to get promotion upto the level of Commissioner
in this service. But this version doesn’t seem correct as DOPT OM No.
AB-14017/61/2008-Estt.(RR) dt. 24.03.09 clearly stipulates the promotion of our
Inspector level officer to the post of Commissioner on completion of 20 years
of service as below-
(i) 2 years for promotion to a post of Level-8, i.e.,
Superintendent (grade pay of Rs. 4,800/-), after joining as Inspector.
(ii) 7 years for promotion to a post of Level-11, i.e.,
Deputy Commissioner (grade pay of Rs. 6,600/-), after joining as Inspector (There is no justification of promoting an
officer from a grade pay of Rs. 5,400/- on account of time scale after 4 years
of service to a post with same grade pay Rs. 5,400/- only. It is also
submit-worthy that the most of the group ‘B’ gazetted officers including CSS
are being promoted to a post with a grade pay of Rs. 6600/- instead of Rs.
5400/- in Central as well as State governments.).
(iii) 12 years for promotion to a post of Level-12, i.e.,
Joint Commissioner (grade pay of Rs. 7,600/-), after joining as Inspector.
(iv) 17 years for promotion to a post of Level-13, i.e.,
Additional Commissioner (grade pay of Rs. 8,700/-), after joining as Inspector.
(v) 20 years for promotion to a post of Level-14, i.e.,
Commissioner (grade pay of Rs. 10,000/-), after joining as Inspector.
(vi) And so on.
7. We already
have eligible officers for each level completing above residency periods in
abundant. Even otherwise, these posts may also be filled by taking other
measures including following ones for the want of eligible officers-
(a) By taking
relaxation from the nodal department as being done for the want of eligible
officers to fill up the posts above the level of Deputy Commissioner created in
the last cadre restructuring for IRS officers.
(b) By
interchange of the posts between IRS branch A and B officers till eligible
officers in branch B are available.
(c) By
downgrading the posts under GFR 254 to fill up at lower levels till eligible
officers in branch B are available.
8. In view of
the above, it is requested to kindly interfere into the matter to get the reply
sent to the DOPT by the CBIC at an early date to create a separate service for
our officers giving due considerations of all submissions made by the
Association to the administration till date including the above ones and
enhancing the number of posts in this service at each level in proportion of
the basic cadre strength of our officers. It
is also worth to mention that the ensuing cadre restructuring has already been
extraordinarily delayed as it was started in the year 2018.
