CBIC to scrap the ensuing cadre restructuring.

It is submitted with due regards that the Association came to know about the CBIC plan to scrap the ensuing cadre
restructuring proposal instead of replying the queries of DOPT. It was first
time in the history that the CBIC proposed something to remove the acute
stagnation of group B executive officers in actual terms in the form of
separate service consisting the posts upto the level of Commissioner on pursuance
by the Association. However, no doubt that some more amendments including the
enhancement of number of posts at each level in this service are required. It
is also worth to submit that the most of our
officers are forced to retire as Superintendents after getting only one
promotion due to faulty HRD policy of CBIC whereas other counterparts of ours
are reaching the level of Additional Commissioner/Commissioner and
Director/Joint Secretary (5/6 promotions) after joining the job at the same
level with us and being recruited by common process.
3. It is evident
by the approach of CBIC that they are least interested about the career
prospects of GST Group B executive officers. It is also worth to mention that no cadre review has ever been done by
the CBIC exclusively for these poor officers. It seems that the CBIC is
made “for, of and by” Direct Recruit IRS officers only being always worried for
their career prospects. They managed the things in such a way in the last cadre
restructuring that their Assistant Commissioner became Joint Commissioner (two
promotions) and Commissioner (four promotions) within 7 and 17 years of service
respectively whereas the most of GST Group B executive officers are forced to
retire with single promotion even after serving the Govt. for more than 35
years. The promotional posts for the Group A officers were created upto the
level of Principal Director General/Principal Chief Commissioner (7 promotions)
in the last cadre restructuring in such a manner that the eligible Group A officers
were not available for years for promotion and these posts were filled-up by
taking relaxations from the DOPT every year. But very unfortunately, nothing
such was even thought for poor GST Group B executive officers to remove their
acute stagnation despite of the recommendations of the Cabinet.
4. The situation
about the acute stagnation of GST Group B executive officers is so pathetic
that the Cabinet had to recommend in
2013 to bring some scheme for removal of their stagnation independent of cadre
restructuring but unfortunately nothing has been done till date and these
officers are forced to work under total frustration. As far as MACPS (Modified
Assured Career Progress Scheme) is concerned, these officers are now getting
after 30 years of service what they were getting after 24 years of service
under ACPS (Assured Career Progression Scheme).
5. For poor
Group B executive officers of ours, 2118 temporary posts of Asstt. Commissioner
with the discriminatory clause of no further
promotion were created to grant them illusionary promotion without
benefit of even single rupee. These posts will also lapse on 18.12.23 ending
even the illusionary promotion. The separate service for our officers was
proposed with a base of these temporary posts of Asstt. Commissioner at Group A
entry level. But the said proposal is also not being liked by the present set
of authorities of the CBIC perhaps with the mindset that ensuing proposal has
least benefit for the Direct Entry IRS Group A officers. The present authorities
of the CBIC are perhaps of the mind that the earlier authorities were totally incompetent
who prepared the ensuing cadre restructuring proposal. There is a serious need
to give a serious thought to such thinking of the present authorities of the CBIC.
6. The standard
ratio between the feeder and promotional post is treated as 3:1 in the Govt. of
India but actual ratio is remarkably low for Direct Recruit IRS Group A
officers and extraordinarily high for our executive officers in the CBIC. It is
around 2 to 2.5:1 or even less for Direct Recruit IRS Group A officers whereas 31:1
for our Group B gazetted executive officers at Group A entry level due to which
only 1% of our Superintendents are able to get promotion to regular post of
Asstt. Commissioner at the fag end of the career. The ratio for Direct Recruit
IRS Group A officers is even less than 1 at Deputy Commissioner to Joint/Additional
Commissioner level whereas only 507 Group A entry posts are available for our
36164 GST Group B executive officers. In actual terms, at least 12055 Group A
entry posts are required exclusively for GST Group B executive officers and further
at least 4018, 1785 and 595 exclusive posts at Deputy Commissioner, Joint/Additional
Commissioner and Commissioner level, if we talk in terms of the standard
ratio of 1:3.
7. It is also
worth to submit that the ensuing cadre restructuring was started in the year
2018 and being scrapped now after 5 years without any result whereas the cadre
restructuring/review should happen at an interval of every 5 years as per the
existing guidelines. It means that the resources, man power, Govt. working
hours, related expanses etc. made for 5 years on this proposal were totally
waste, unpurposeful and unproductive. The
question arises who is responsible for this waste.
8. In view of
the above, it is requested to kindly-
(i) Continue the
ensuing cadre restructuring at least for the GST Group B executive officers to
create a separate service for them consisting the posts at least upto the level
of Commissioner.
(ii) Enhance the
number of posts in this service at each level in proportion of the cadre
strength of the GST Group B executive officers at least in the standard ratio
of 1:3 at each level for the sake of justice
to these poor officers who are forced to retire with single promotion in
the career of more than 35 years.
(iii) Scrap the
proposal only for Direct Recruit IRS Group A officers, if the present set of the
authorities in CBIC are interested to scrap the proposal.
