Sub: DPC for the post of Asstt. Commissioner for the years 2022 and 2023.

Sir,

It is submitted with due regards that the DPCs for the post of Asstt. Commissioner for two consecutive years 2022 and 2023 are still pending. Our officers are forced to retire every month without promotion with no fault on their part despite of thousands of promotional posts being vacant.         

2. If the posts are kept unfilled, the DOPT and Expenditure Department may also not agree to approve our ensuing cadre restructuring despite of these posts being created on “post to post functional justification” basis under the GST.

3. It is further submitted that no DPC for the post of Asstt. Commissioner is being convened timely due to whatever reason. It is also worth to mention that the existing Asstt. Commissioners are already under tremendous pressure due to huge workload on account of looking after multiple charges and are forced to take VRS on regular basis. We were, actually, expecting the DPC in the month of April itself but the same has already passed. Our Superintendents, who are due for promotion, are also working under tremendous pressure of not being promoted despite of being due.

4. The Association also came to know that some information has been sought from the field formations raising the hope of DPC in the coming time. But the information sought gives the impression that the same would be insufficient to convene the DPC for both years. Only DPC for one year seems possible to be convened with the sought information.

5. In view of the above, it is requested to kindly convene the DPCs for both years at the earliest by filling-up all the vacant posts of Asstt. Commissioner. An advance panel may also kindly be prepared to fill-up the posts as per the DOPT guidelines.

Sub: Consultation with the service associations regarding cadre restructuring.

Sir,

As the Association came to know, it is submitted with due regards that the cadre restructuring proposal of CBIC is being redrafted. Earlier proposal was drafted in the year 2018. All service associations (recognised or non-recognised) were not only consulted before the drafting of the earlier proposal but their views were also taken on the final proposal.

2. But no association has been consulted this time. By not consulting the associations, the views and suggestions of the stake holder will remain non-considered in r/o the cadre restructuring. Needless to submit that the proposal would be one sided, if the stake holders are not consulted. Needless also to submit that the GST Group B executive officers are already retiring with single promotion in the career of more than 35 years after being appointed as Inspector despite of being the backbone of the tax collection. The temporary posts of Asstt. Commissioners merely enable some of them to become Asstt. Commissioner at fag end without further promotion and without increase of even single rupee on promotion on account of already getting MACP upgradation in the pay scale of Asstt. Commissioner before promotion. So, the consultation with the service association for finalisation of the cadre restructuring proposal is very necessary.  

3. In view of above, it is requested to kindly consult all the service associations, whether recognized or non-recognised, before final submission of the proposal to the DOPT.

Sub: Number of posts in the separate service meant for our officers.

Sir,

As the Association came to know, it is submitted with due regards that the cadre restructuring proposal of CBIC is being redrafted. It is also submitted that no cadre restructuring has ever happened independently for Group B or Group C cadres in our CBIC.

2. A separate service namely IRS branch B for Group B executive officers was proposed in the original proposal consisting posts upto the level of Commissioner. 3000+ posts of Asstt. Commissioner were proposed in it as the base of the service keeping in view the acute stagnation being faced by our officers as the Cabinet also recommended to bring additional measures to remove stagnation of Group B executive officers at the time of the approval of the last cadre restructuring in 2013.

3. It is being submitted by the Association since very beginning that the number of the posts proposed in this service are not sufficient to do the good to our officers. As on date, the sanction strength of Group B (gazetted and non-gazetted) executive officers is 44000+. If we talk in terms of standard ratio of 1:3, around 15000 posts of Asstt. Commissioners are required to be base of the said service to do actual good of the Group Executive officers and particularly keeping in view that the service has not been proposed to be started from the cadre of Inspector as its base.

4. As far as the functional justification is concerned, this is the time to strengthen preventive/anti-evasion and audit set-ups alongwith Divisions keeping in view of the increasing trend of the evasion of the tax. It is true that the tax collection is on regular increase but it is also true that the tax evasion percentage is also on regular increase in GST era as evaders have adopted various means to evade the tax. It is very necessary to prevent this tax evasion to strengthen the Nation more which is possible only by sufficient increase of the posts at each level with the multi-functional approach.   

5. In view of above, it is requested to kindly enhance the number of posts in the said service accordingly at each level in the standard ratio of 1:3 with a base of at least 15000 Asstt. Commissioners. Keeping in view the residency periods prescribed by the DOPT, the number of the eligible officers to be promoted against these posts will very well be available every time.
