Sub: Regular charge to Asstt. Commissioners promoted vide Order No. 105/2023 dt. 15.07.23.

It is submitted with due regards that 24 Assistant Commissioners were reverted to post of Superintendent vide Office Order No. 101/2023 dt. 06.07.23 of the CBIC to implement the order given by the Hon’ble Supreme Court in the B. S. Murthy case. These officers were working as Assistant Commissioner on regular charge before reversion.

2. Now, all of eligible officers out of total 24 have again been promoted as Assistant Commissioner (in situ) vide Office Order No. 105/2023 dt. 15.07.23 of the CBIC. But they are being asked to work as Superintendent (because of being re-promoted on in-situ basis) despite of being again promoted and already being worked as Assistant Commissioner on regular charge before reversion. 

3. It is also worth to submit that “in situ” promotion orders have been issued because of transfer/posting orders to be issued later. In situ promotions have not been made with the intention to get them worked as Superintendent as the promotions have been affected against the long term vacancies of Asstt. Commissioner. Moreover, these officers had already been posted in the respective zones and they were looking after the regular charge of Asstt. Commissioner after being promoted on long term vacancies of Asstt. Commissioner.

4. In view of above, it is requested to direct the field formations-

(i) To get the work of regular charge from all re-promoted officers who were reverted or a separate allotment order may kindly be issued for these officers by CBIC treating the matter as most immediate based on their earlier options.

(ii) To get the work of regular charge at the present place of posting from all other officers promoted recently afresh on in-situ basis till their transfer/posting orders are issued.
