Sub: Harassment
and mental torture meted out to the office bearer of the Association.
Sir,
With a heavy
heart, the Association is forced to write that Sh. Ashish Vajpeyi, Asstt.
Commissioner, CGST Audit, Kanpur and General Secretary of Kanpur Unit and also
one of All India Vive Presidents of the Association is being harassed,
maltreated and mentally tortured by your worthiness since your joining the
existing post due to the reason known to you only.
2. You were
pleased to call him in your chamber on 04.08.23 and started shouting on him. He
was nodded on whatever you were pleased to say but you shouted and said,
"Stop nodding your head." He was terribly shocked by such cruel
behaviour as no one ever has talked to him in such humiliating, insulting and
inhumane manner in his service period of more than 33 years. You were further
pleased to say that he was doing work of charges not assigned to him.
3. He explained to
you that he was the only Assistant Commissioner posted in CGST Kanpur at Kanpur
station. Hence, he held the charges of Circle-1 and Circle-2 besides all
branches of Headquarters. The charge of Headquarters was given to him by way of
an administrative order Dt. 03.03.21. He also later sent a copy of the same to your
worthiness through your PS.
4. You kept
accusing him due to the reason known only to you and further said that he kept
holding regular meetings in his chamber. He tried to explain but you silenced him
with utter disrespect treating him like a slave instead of a gazetted Group ‘A’
officer.
5. It is further
to add with due regards that he was Asstt. Commissioner (P&V) holding
charge of two Audit Circles, five groups of Audit Headquarters besides all
branches of Headquarters. So in all, he held charge of fifteen Audit groups and
all charges of Headquarters. Besides also being the General Secretary of
AIACTGEO, Kanpur Unit, people naturally come and meet him till he sits in his
chamber. So, the allegation of holding regular meetings in his chamber is
baseless. The officers come to meet him on the capacity of Asstt. Commissioner
(P&V) and General Secretary of AIACTGEO, Kanpur Unit to discuss their
matters.
6. On 08.09.23,
MCM was conducted. On that day, he was suffering from high fever besides having
visibility problems due to retinal detachment held in August, 2022 followed by
four surgeries. Hence, he could not stress his eyes too much. But despite
knowing this all, you were pleased to publicly humiliate and insult him. The
height is that the work being done by him, which had been appreciated earlier,
was termed to be a non-working performance by your worthiness.
7. In the
presence of six Asstt. Commissioners (all promotees including two in-situ), you
were pleased to say why so much Superintendents are promoted as Asstt. Commissioners
when they have nothing to do. This question of yours is extremely humiliating
and insulting to all promotee Asstt. Commissioners and whole cadre of
Superintendents. Your question made it clear that you are dead against promotee
Asstt. Commissioners and don’t want the Superintendents to be promoted as
Asstt. Commissioners. Such thinking of yours is totally discriminatory and full
of untouchability. Such monarchial and highhanded behavior to treat our cadre
as slaves is noway acceptable in our greatest democracy of the world. Such behavior
of yours will only spoil the working atmosphere in the important GST era. Your question can be answered only by the
concerned authorities which are instrumental to promote the Superintendents to
the post of Asstt. Commissioner and involve levels upto the Cabinet of India
as the proposal was approved by the Cabinet itself. It is also clarified hereby
that no govt. authority is above the Cabinet in our democratic system.
8. Being prey of
your unparliamentary, humiliating and insulting behavior, Sh. Vajpeyi is under
acute depression and hypertension and unable to understand what to do under
such circumstances of public insult. If something bad happens to his person or
his health or to any other officer/s due to your highhanded and cruel behaviour,
it is clarified that your worthiness shall be solely responsible for the same.
9. After so much
humiliation and mental torture, everybody concerned will find no other way
ahead except being willingly removed from your worthy control. With just
about 30 months of service left, he is not finding him in a position to move
ahead and hence has to face the humiliation and insult till your worthiness is his
Principal Commissioner. He gets extremely afraid when he even thinks about
going to office. This explains the degree of mental torture and oppression
applied by you to your subordinate. His depression is on increase day by day which
may force him to take the ultimate step. It is brought to your worthy notice
that you would be the only person responsible, if anything bad happens to him
or any other officer/s due to your humiliating, insulting and highhanded behavior.
10. In view of
above, it is requested to kindly disclose the reason of your anger towards
staffside to enable them to take the corrective measures to get them saved from
public insult and humiliation. It is also requested to kindly not place Sh.
Vajpeyi or any other officer/s to such recurrent humiliation and insult. All
are govt. employees like you and deserve well behaved and respectful treatment.
The concerned authorities are requested and expected to behave like family head
instead of your manner.
