Sir,
Kindly
refer to earlier requests of the Association on the subject matter including
dated 21.04.26 and telephonic ones.
2. As
your goodself knows, it is submitted with due regards that the finalization of
the All India Seniority List of Superintendents of Central Excise/CGST
beyond 2013 is pending for the want of the due list from Vadodara Zone. Due to
which, the DPC for the post of Asstt. Commissioner for the year 2026 is long
pending being overdue and the officers due for promotion are retiring regularly
without promotion with no fault on their part.
3. As
on date, there also exists no legal stay/hindrance in providing the seniority
list in relation of the Vadodara Zone. The promotions are also to be affected
on ad-hoc basis. The matter being pending in the Hon’ble High Court without any
legal stay, the zonal list may be provided subject to final verdict of the Hon’ble
High Court in case of any legal apprehension.

Needless to submit that the Central Excise Superintendents get their rare
second promotion at the fag end. So, it looks very bad if this promotion is
hindered due to any of the reasons. The Association also requested your
goodself in the past to provide the seniority list subject to the court verdict
but the same couldn’t happen. So, now at least when there is no legal stay, the
providing of the due list to the CBIC may be done at the earliest rather on
immediate basis to enable the due officers to get their rare second promotion
of the career at the fag end.
5. In
view of above, it is again requested to kindly do the needful in the matter to
provide the due zonal seniority list to the CBIC treating the matter as “MOST
IMMEDIATE” enabling promotion of the officers retiring this month.
