Madam,
            Kindly refer to the earlier communications of the Association on the subject matter.
2. With due regards, the Association came to know that a few units of this Association are making direct correspondence with the Board on the all India issues. Not only it, they are also being given appointments for meetings on the issues having all India ramifications.
3. Further, there already exist the instructions of the CBEC that neither any unit would make direct correspondence with the Board on all India issue/s nor our Board would entertain or give appointment to them on such issues. In this regard, it is also submitted that only the All India Body has been given recognition on central level by the Board and the units are affiliated to this body as its branches at local levels.
4. The present Chairperson was also agreed to this point during her stint as the Member (P&V) that only this All India Body would be entertained or consulted on the all India issues instead of its units/branches. But unfortunately, the units are being entertained by the Board on such issues and as came to the knowledge of the Association, one of the units has been granted time for the meeting for 27.05.13.
5. In view of the above, it is requested that none of the units of the All India Body or their correspondence may kindly be entertained or given time for the meetings in person particularly on the issues having the all India ramifications. If it is done, the issue may be diluted on account of some different ideology being had by the concerned unit.

Sub: Non-functional time scale in PB3 to the Superintendents after completing 4 years of service.

 Madam,
Kindly refer to the minutes drawn against point No. 8 of the meeting held with your goodself on 31.01.13 vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of CBEC.
2. It is submitted with due regards that the decision on this point has also unfortunately been deviated to dilute the issue as usual saying that the possibilities of granting non-functional time scale in PB3 shall be examined. Actually, the point was agreed during the meeting of 15.03.12. You were also pleased to assure the Association of doing the needful in the matter in both meetings (02.11.12 & 31.01.13) but nothing has been done till date. The time scale has been granted in PB3 to others including CSS while it is merely in PB2 for us. It was granted to CSS officers since 1996 in PB3 (equivalent scale) while since 2006 to us in PB2 in a very discriminatory manner. It is also worth to mention that it was granted to CSS officers during their cadre restructuring but nothing such has been proposed for us in the ongoing cadre restructuring despite of the request of the Association.
3. It is further submitted that the Superintendents of Central Excise were granted a non-functional time scale in PB2 after 4 years of regular service as per the resolution dt. 29.08.08 of the GOI. On the contrary, the most of the other group ‘B’ gazetted officers were granted the said time scale in PB3 after the equal years of service. In our own CBEC, the counterparts of the Superintendents of Central Excise belonging to CSS, CSSS etc. are getting this time scale in PB3.
4. In the Department of Revenue, the Superintendents of Central Excise etc. have been granted the time scale in PB-2 corresponding to the pay scale of Rs.8000-13500/- after completion of four years of service in the grade. They were placed under the pay scale of Rs.7500-12000 w.e.f. 21.04.04 while the officers of CSS & CSSS were placed under the equivalent scale w.e.f. 01.01.06 justifying the stronger claim for Superintendents to be placed under a time scale in PB3 w.e.f. the date since when the officers of CSS & CSSS were placed under the time scale of Rs.8000-13500/-. 
5. This is an anomalous situation giving rise to the disparity.  Officers of equal rank & status of the Department of Revenue working in CBEC have not been treated at par with the officers of equal status & rank belonging to the Central Secretariat Service working in headquarters offices despite of 6th CPC recommendations for the equal treatment to Hqrs and field officers vide chapter 3.1 of its report.
6. Due to this anomalous situation, an officer joining as the Inspector of Central Excise will get the first MACP upgradation in the grade pay of Rs.4800/- (in PB-2). He will get the 2nd MACP upgradation in the grade pay of Rs.5400/- in PB-2 after completion of 20 years of service. After completion of 30 years of service, he will get the 3rd MACP upgradation in the same grade pay of Rs.5400/- in PB-3 without any financial benefit while he was able to get the same only after 24 years of regular service under old scheme of ACP. His common entry counterparts of CSS & other organisations are able to get higher grade pay of Rs. 6600/- under MACPS after completion of 30 years of service under the circumstances and even a grade pay of Rs. 7600/- in many cases.
7. Due to this anomaly, the Central Excise Superintendents/Inspectors will remain in the same grade pay of Rs. 5400/- itself on the grant of 2nd MACP upgradation and 3rd MACP upgradation.  If they are also granted parity with the CSS & other counterparts, they will also be able to get a grade pay of Rs. 6600/- after completion of 30 years of regular service like others. 
8. If the above disparity is undone, the anomalous situation may be rectified upto a certain extent as the officers of CPWD, CSS & CSSS etc. have already got a grade pay of Rs. 7600/- after completion of 30 years of service (clarification point No. 3 in OM No. 35034/3/2008-Estt. (D) Dt. 09.09.10 of DOPT) after getting IInd ACP benefit. The reason of this serious disparity is that the group ‘B’ gazetted officers of CPWD, CSS & CSSS etc. are being promoted directly to a post with the grade pay of Rs. 6600/- while the group ‘B’ gazetted officers of field formations under CBEC are being promoted merely to a post with the grade pay of Rs. 5400/-. This anomaly also needs an immediate remedy by promoting the group ‘B’ gazetted officers of field formations under CBEC directly to a post with the grade pay of Rs. 6600/-.
9. IFU also recognized the anomalous situation and recommended the case to Expenditure for the grant of time scale in PB3 to the Central Excise Superintendents but the same was not exceeded by Expenditure saying that the provisions of time scale in the pay scale of Rs. 8000-13500/- existed even prior to 6th CPC in the case of CSS etc. (vide p-14/n of F. No. A.26017/97/2009-Ad.IIA). The reason shown by the Expenditure for not granting the same benefit to the Central Excise Superintendents does not seem genuine & reasoned particularly after being recommended by IFU. Moreover, other officers have also been granted the time scale in PB3 at par with CSS despite of the fact that they were not having this benefit prior to the 6th CPC.
10. Prior to the implementation of the recommendations of the 6th CPC, a Group ‘B’ gazetted field officer under CBEC holding the post in the pay scale of Rs.7500-12000/- got the promotion in the pay scale of Rs.8000-13500/- which was a Group ‘A’ post.  Further, under the ACP Scheme issued in 1999, 2nd financial up-gradation was also granted in the same pay scale of Rs.8000-13500/-.  There was no distinction between the entitlements due to the grant of higher pay scale of Rs.8000-13500/- granted either due to promotion or due to financial up-gradation under ACP Scheme. 
11. Further, such officers who have got promotion after the grant of 2nd financial up-gradation could not get any financial benefit due to the pay fixation on promotion. The officers who are promoted as Superintendent after 16 years of service are also not getting this benefit on account of being due for IInd MACP upgradation after 20 years of service. Whereas after the 6th CPC, Group ‘B’ gazetted officers are getting time scale in a grade pay of Rs.5400/- in PB-2 after completion of 4 years of regular service and they are also getting one increment at the rate of 3% but they are not eligible for the entitlements allowed to the officers placed in PB-3. 
12. It may also be added here that there was no provisions for grant of time scale in PB-2 prior to 6th CPC. 
13. In view of the above, it is once again requested that the Superintendents of Central Excise may also kindly be granted the non-functional time scale in PB3 (equivalent scale) after completion of 4 years of service since the date of grant of this benefit to the group ‘B’ gazetted officers of CSS etc.

It is submitted with due regards that the decision on this point has also unfortunately been deviated to dilute the issue as usual saying that this matter need to be examined in light of the aforementioned letter. Actually, this point was agreed during the meeting of 15.03.12 too. You were also pleased to assure the Association of doing the needful in the matter in both meetings (02.11.12 & 31.01.13) but nothing has been done till date.  
3. It is further submitted that the regular service of our common entry counterparts of CSS under the same organisation of CBEC is being counted from the following 1st July of the year of the recruitment examination in the case of direct recruit officers and from 1st July of the year of the preparation of the panel in the case of promotee officers. The Association was informed during one of the meetings that the orders to this effect have already been issued. But very unfortunately, the orders for the same have not been implemented till date despite of the decision taken on the issue.
4. In view of the above, it is requested that the necessary steps may kindly be taken in the matter on immediate basis.

Sub: Finalisation of in-situ promotions scheme under consultation of the Association.
 Madam,
Kindly refer to the minutes drawn against point No. 12 of the meeting held with your goodself on 31.01.13 vide No.C.30013/6/2012-Ad.IV.A. Dt. 15.02.13 of CBEC.
2. It is submitted with due regards that the decision on this point has also unfortunately been deviated to dilute the issue as usual. It has been mentioned in some other way in the minutes. Actually, this point was agreed during the meeting of 15.03.12 too. You were also pleased to assure the Association of doing the needful in the matter in both meetings (02.11.12 & 31.01.13) but nothing has been done till date. 
3. As far as the introduction of this scheme with MACPS is concerned, both the benefits may very well be provided simultaneously particularly keeping in view the example of the scheme for staff car drivers. There is no bar to implement both of the schemes simultaneously.
4. In the case of in-situ promotions, no statutory provisions will come in the way because the officer has to work on the lower seat only. No law requires changing the responsibility in the case of in-situ promotion. Under the scheme, the officer would very well be able to perform the task of a Superintendent after being designated as Asstt. Commissioner on in-situ basis and there would arise no need of posting the officers to any Directorate after granting in-situ promotions.
5. The relevant instructions issued by DOPT vide OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 have already been brought up to the HRD wing of CBEC. It is further submitted that even the cadre restructuring would not be able to solve the problem of stagnation of ours. It is also worth to mention that the said scheme is not being finalised & implemented despite of the decision taken in the Board meeting of 12.01.11. The scheme may kindly be formulated & implemented under consultation with the Association immediately. As per DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 (not being followed by CBEC), Inspector should be promoted to the grade of JC, ADC & Commissioner after completing 12, 17 & 20 years of service respectively. During the presentation of cadre restructuring on 18.01.11, CBEC didn’t counter the OM but showed its inability to implement the said OM for the want of required number of vacancies/posts. But in this regard, it is further worth to mention that no vacancies/posts are ever required, if the officers are promoted on ‘in-situ basis’. In our case also, no vacancies/posts will be required, if the officers are granted in-situ basis promotions in consonance of the qualifying services prescribed by the DOPT under above referred OM dt. 24.03.09.
6. In view of the above, it is again requested that our officers may kindly be granted in-situ promotions in consonance of the qualifying services prescribed by DOPT under the OM dt. 24.03.09 independent of cadre restructuring as the same would require no vacancies or creation of any post.
