Sir,
Kindly refer to the Ref. No. 77/12 Dt. 07.06.12 and 192/CR/13 Dt. 02.07.13 etc. of the Association.
2. It is further submitted with due regards that the Cadre restructuring of CBEC is under submission to the Cadre Review Committee (Committee of Secretaries) through DOPT to be headed by your goodself. But its submission to your goodself is still awaited even after already being approved twice by the Hon’ble Finance Minister as well as Expenditure. Due to its pendency, our officers (i.e., Central Excise Superintendents) are forced to retire in PB2 every month without further promotion after entry into the job as Inspector. The position of stagnation of our officers is so horrible that they are forced to retire after only one promotion in the service career of 35-40 years while their common entry counterparts are getting 5/6 promotions attaining the PB4 (Commissioner/Joint Secretary) level, Annexure-I is enclosed herewith. The reason of their counterparts reaching the level of Commissioner in sister concern of CBDT and Joint Secretary in CSS is the happening of timely (5 yearly) cadre restructurings there while the ongoing one is only IInd in CBEC and is already pending even in its 7th year after being started in 2006.
2. Not only it, the most of the group ‘B’ gazetted officers in the Central as well as State governments are promoted to a Senior Time Scale post while Central Excise Superintendents are promoted (if any) merely to a Junior Time Scale post. They are also forced to work under their extreme juniors of Customs belonging to same cadre recruited through same examination in CBEC under same Department of Revenue and same Ministry of Finance. The single cadre of Inspector has been trifurcated into 3 categories in absolutely unjustifiable manner, i.e., Inspector (Central Excise & Land Customs), Preventive Officer (Inspector Customs) & Examiner (Inspector Customs) to be promoted as Superintendent (Central Excise & Land Customs), Superintendent (Customs) & Appraiser (Customs) respectively re-merging at group ‘A’ entry level. This places the Inspector (Central Excise & Land Customs) 20 years behind the Examiner (Inspector Customs) due to the discriminatory rate of promotion and faulty recruitment rules. Even ACPS/MACPS is unable to undo the financial injustice in this regard and the Examiners are keeping to attain the level of Addl. Commissioner. It is also not out of place to submit that the Inspectors/ Superintendents (Central Excise & Land Customs) are already looking after more than 70% of Customs work including 100% of Central Excise & Service Tax work.
3. It is also worth to submit that the IRS officers of CBEC were granted parity with their common entry counterparts of CBDT in last cadre restructuring and they are going to get parity with other better placed common entry group ‘A’ counterparts in the ongoing one. But no parity with common entry counterparts like CBDT, CSS etc. has been considered for Central Excise Superintendents & Inspectors which is very well possible by adopting the measures like time bound promotions/scales, notional promotions, creation of supernumerary posts, creation of separate service, direct promotion to higher post/s, upgradation of posts, in-situ promotions (requiring no creation of posts) or any other specific measure/s including batch to batch non-functional financial upgradation (on the lines of DOPT OM No. AB.14017/64/2008-Estt.(RR) dt. 24.04.09 granting NFFU to other group ‘A’ officers at par with IAS) and re-framing the recruitment rules without trifurcating a single cadre of Inspector/Superintendent prescribing the qualifying service in consonance of the DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09 which stipulates the promotion of the grade of Inspector to the grade of Joint Commissioner, Additional Commissioner & Commissioner after completion of 12, 17 & 20 years of service respectively. The validity


of this OM was also admitted by CBEC during the presentation of cadre restructuring proposal on 18.01.11 but they showed their inability to implement it due to the want of the required number of vacancies/posts. Therefore, the required number of posts may kindly be created to implement the OM or the officers may even be granted in-situ promotions requiring no creation of posts independent of cadre restructuring.
4. It is also well pertinent to submit that the cadre restructuring of CBDT has already been approved & notified despite of them being far behind the revenue target while our cadre restructuring is not being approved despite of us being far far ahead of the revenue target set for the financial year 2012-13. No heed has been paid to remove the stagnation of acutely stagnated Central Excise Superintendents & Inspectors despite of the DOPT communications issued vide D.O.No.5/26/2010-CS.II(A) Dt. 06.10.10, No. 19/1/2008-CS.I(P) Dt. 20.07.10, No. 20/51/2009-CS.II Dt. 27.01.11, No.35034/9/2010-Estt.(D) Dt. 10.02.11, OM No. 35034/9/2010-Estt. (D) Dt. 10.02.11 etc. stipulating very clearly that the cadre restructuring should be viewed to mitigate the stagnation of the stagnated employees. On the other hand, the non-stagnated categories are being given every benefit. Previously, the strength at Asstt,/Deputy Commissioner was proposed to be raised to 4896 from 1550 which was reduced to 3600 only. It was again approved to 4168 by the Hon’ble Finance Minister on 12.04.13 and is now with DOPT after approval from the Expenditure but it seems that the DOPT is adamant to recommend only 3600 to the Cadre Review Committee to be headed by your goodself.
5. In view of above, it is requested that the cadre restructuring of CBEC may kindly be approved immediately in time bound manner without any cut, all the posts of Asstt./Deputy Commissioner may kindly be created on permanent basis & filled by promotions only in one go and some specific measures may also kindly be devised independent of cadre restructuring for acutely stagnated Central Excise Superintendents/Inspectors to grant them parity with their common entry counterparts including no direct recruitment to IRS at least for next 5 years after the implementation of cadre restructuring. The cadre restructuring may kindly be cleared not only by the Cadre Review Committee but also be approved by the Cabinet on immediate basis particularly keeping in view the extraordinary stagnation being faced by the Central Excise Superintendents & Inspectors.
