Subject: Ad hoc promotion to the grade of Asstt. Commissioner of Customs & Central Excise-furnishing of ACR/APAR dossiers, vigilance status etc-reg.
Madam,
            Kindly refer to the letter F.No.32012/21/2009-Ad.II Dt. 13.07.13 of the CBEC circulated to all Chief Commissioners and Director Generals under CBEC.
2. By going through the above communication, it is submitted with due regards that the DPC for promotions is going to be conducted only for the year 2012-13 without giving any heed for the year 2013-14 despite of knowing that our officers are retiring every month without promotion. As your goodself knows very well that the DPC should always be conducted in advance to prepare a panel for the respective year but it has become the habit in the CBEC to delay everything particularly relating to the Central Excise officers. The panel should also be prepared by holding the DPC for the year 2013-14 as per the DOPT guidelines, if we are going to follow the every formality of regular DPC for ad hoc promotions which was never followed prior to the last DPC for the promotions to the post of Asstt. Commissioner except implementation of the provisions of the extended panel.  
3. It is evident from the fact of not conducting the DPC for the year 2013-14 that some more vacancies of Asstt. Commissioner are already existing which would again remain unfilled for unpredictable period. The disposition list of the vacancies and some information under RTI Act given to one of our officers also show the existence of more vacancies in CBEC. As per past practice, the next DPC for these vacancies would again be conducted after the retirement of many of our officers. Around 100 names of retired/just to retire/deceased officers have been mentioned in the above referred letter of the CBEC like last occasion.
4. Despite of the repeated requests as well as the assurance given by the administration, neither the provisions of extended panel have ever been implemented by the CBEC in any of the DPC’s for the post of the Asstt. Commissioner to give the benefit of the promotion to the serving officers in lieu of the retired/deceased ones nor the names of the retired/deceased officers are deleted from the lists. 
5. In view of the above, it is requested that-
i) the DPC for the year 2013-14 may also kindly be conducted immediately to fill up the remaining vacancies of Asstt. Commissioner,
ii) the names of the retired/deceased officers may kindly be deleted from the lists and the names of equal number of serving officers added to it and
iii) the provisions of the extended panel may also kindly be implemented not only for this DPC but also for the earlier DPC’s including the post 1979 regularisation for the post of the Asstt. Commissioner.
