Sub: Gathering before the residences of the authorities and observation of Satyagraha.

Dear friends,
Good morning.
The copy of the notice served upon the concerned authorities is posted hereunder  which is self-explanatory. In Delhi Zone, the officers will gather before the residence of Member (P&V), Chairperson & Revenue Secretary on the specified dates. In other zones, the officers will gather before the residence of the respective Commissioner/Chief Commissioner. A format is also posted here under  which is to be carried by every officer in his/her hands and presented to the concerned authority.
Next dates to gather before the residence of MOS & FM will be communicated very soon for Delhi Zone officers. The officers of other zones will again gather before the residence of the respective Commissioner/Chief Commissioner on these dates carrying the said formats in the hands to present to the concerned authority.
It is again reiterated that a complete, united and effective programme without any fearing/vested interest is the only key for redressal of our grievances. We all only have to be serious for our programme, none else will rescue us. Our aim is not to retire our officers as AC but it is to enter into PB4 like other counterparts.
All of the units are requested to immediately serve the due notice to respective Cadre Control Chief Commissioner/Commisioner and be ready for next programmes.

2. It is again submitted with due regards that nothing is left to be happy in the life of the Central Excise Superintendents in relation of career, pay or any other service matter. Despite of total demoralisation, disappointment, job dissatisfaction, demotivation & frustration, the revenue targets are regularly being achieved above the set goals by the sincere efforts of these officers. Under the present circumstances, these officers are forced to retire at a PB2 post after only one promotion in the service career after joining as Inspector while their common entry counterparts are easily enjoying PB4 levels after getting 5-6 promotions. The Central Excise Superintendents are getting promotion (if any) merely to Junior Time Scale while their counterparts of CPWD, CSS, CSSS, AFHQS, Rajya Sabha Secretariat& many others like Administrative Services, Police Services, Forest Services, Engineering Services, State Services etc. to Senior Time Scale. The employee grievance redressal mechanism has totally failed as the authorities have no time to hold meetings with the staffside under this mechanism. These poor officers are also forced to work under the extreme juniors of Customs belonging to the same cadre. If career prospects were disclosed at the time of the recruitment, these officers would have never joined this job.  
3. It seems that nobody is worried about this actual workforce of CBEC. The direct IRS officers have been ensured upto 9 promotions to upgrade them within the standard residency periods prescribed by DOPT by creating the posts at Apex, HAG+ etc. levels in the higher scales even without availability of the eligible officers but no measures are being taken for the Central Excise Superintendents & Inspectors to promote/upgrade them within the standard residency periods prescribed by DOPT. Their counterparts of Income Tax (CBDT) and the Assistants of CSS under the same Department of Revenue are able to reach the post of Commissioner and Joint Secretary. Many other counterparts of them are also reaching the PB4 levels. The Central Excise Inspector, whether direct or promotee, was also reaching the level of Commissioner or above in the remote past but the things have been distorted now in such a way in the CBEC that he/she is forced to retire merely on the post of Superintendent after one promotion barring 1%. The CBEC is even unable to conduct the DPC for promotions from group B to group A at prescribed intervals for this 1%. No seriousness is being shown to redress any grievance and also to implement the cadre restructuring already notified more than two months ago. 
4. In view of the above, the Central Excise Superintendents will gather peacefully in symbolic manner before the residences of the authoritiesthroughout India to wish them “good morning and request to do something to enter them (Central Excise Superintendents) PB4 like their counterparts”under Satyagraha programme as per the following schedule-
i) Before the residence of the Member (P&V) of CBEC on 09.03.14.
ii) Before the residence of the Chairperson of CBEC on16.03.14.
iii) Before the residence of the Revenue Secretary on 22.03.14.
The above programmes will be observed by the Delhi Central Excise Zone officers.
At the other Central Excise Zones, the officers will gather before the residence of respective Commissioner/Chief Commissioner.

5. As next steps; the programmes will be observed before the residences of the Minister of State (Revenue) and yourself, for which the dates will be intimated in the due course.

Charter of demands
1. Immediate implementation of cadre restructuring andscheme to improve the career prospects of Central Excise Superintendents/Inspectors independent of cadre restructuring to retire them in PB-4 after getting at least five functional promotions.
2. Next promotion of Central Excise Superintendent in STS like many other group ‘B’ gazetted officers and non-functional time scale in PB3 instead of PB2 to Superintendents after 4 years of service.
3. A pay scale equivalent to the Grade Pay of Rs. 5400/- in PB3 to the Superintendent of Central Excise w.e.f. the date of the grant of the same to the counterparts of IB, CBI etc. alongwith other perks as being granted to the analogous counterparts of IB & CBIand implementation of the CBEC circular issued vide F. No. A-26017/44/94-Ad II(A) Dt. 08.03.95 regarding arrears of pay.
4. Fulfilment of the commitments made during the presentation on cadre restructuring on 18.01.11and seniority benefit on promotion to group ‘A’ in lieu of the service rendered in group ‘B’.
5. Promoting all Superintendents completing 1.5 times of qualifying service on the lines of CSS and regularisation of ad hoc promotions based on the rules existing on the date of regularisation.
6. Stop victimization of office bearers & members of Association, posting of Association functionaries at administrative/Association Hqrs office and holding of regular meetings under Employee Grievance Redressal Mechanism.
7. Undoing of the MACP irregularities and counting of regular service as per F. No. A/60/13/RTI/2006-Ad.IIIB Dt. 26.05.06 of CBEC.
8. Merger of group ‘B’ Executive non-gazetted as well as gazetted categories under CBEC into one and parity between the officers of headquarters organisations& field offices. 
                            9. Conversion of temporary posts of Asstt. Commissioner to regular/permanent keeping the same intact for promotee officers forever and deletion of the clause in cadre restructuring notification that the officers promoted against these posts would not be entitled for further promotion.
10. Time scale after every 7 years to the officers after joining the job as Inspector and no senior of Central Excise should work under the junior of Customs or CSS.
11. Minimal (like maximum upto 25%) direct recruitment of group A as also in the Indian Postal Service and share of promotion in group A meant for Central Excise to be kept intact to prevent its distribution among the officers of Customs.
13. Batch to batch Non Functional Upgradation to the Central Excise executive officers at par with the best common entry counterparts like CSS etc. and qualifying service/residency period in accordance of DOPT OM No. AB-14017/61/2008-Estt.(RR) dt.24.03.09.
14. Operation of vacant STS & above posts on account of want of eligible officers at JTS level and creation of reserve pool posts.
15. Filling-up of all newly created/vacant posts alongwith vacancies to be cascaded downwards on account of promotions at higher levels in one go only by promotions like last cadre restructuring and filling-up of all posts of Asstt. Commissioner first from the Central Excise Superintendents only till all of Central Excise Superintendents of 2002 enter group A like Appraisers.
