The following points are submitted
for your kind consideration and due redressal-
A)
The status of the cadre restructuring: Our Superintendents
are retiring every month without getting the rarest IInd promotion in the
career despite of thousands of vacancies of AC being remained unfilled for more
than 7 months after Cabinet approval. We are already two panel years behind the
model calendar of the DPC. The CBDT has already implemented its cadre
restructuring taking minimum time to promote all categories of their officers
whereas our officers are still waiting for the same. The Central Excise
Superintendent is the worst hit category due to the delayed process on account
of being at the fag end of the career. It is, therefore, requested to conduct
the immediate DPC for the post of Asstt. Commissioner for the model years of
2013-14 and 2014-15 including cadre restructuring vacancies.
B)
Time frame to grant the promotions to the officers particularly to the post of AC:
We are totally unaware when the DPC for the post of AC is going to be held.
Neither the prescribed time frame is being followed nor responsibility is being
fixed for the lapse as per the DOPT guidelines. It is requested that a time
frame may kindly be fixed for the issuance of the promotion orders and
responsibility fixed for delay in the DPC’s as per the DOPT guidelines.
C)
Number of the Group ‘A’ entry vacancies for which immediate DPC is to be
conducted: We are also unaware about exact number of vacancies for
which the DPC is to be conducted for the post of AC. It is requested to
calculate total number of the vacancies and conduct DPC against all without a
single vacancy being unfilled particularly keeping in view the extraordinarily
acute stagnation of ours.
D)
Total number of unfilled vacancies at the Group ‘A’ entry level:
The promotion orders are not issued against the total number of the vacancies
for which DPC is held. 41 vacancies are still unfilled in r/o the last DPC for
the post of AC. It is requested to calculate the total number of vacancies
remaining unfilled in r/o of last DPC/s and fill-up the same immediately.
E)
Inclusion of the names of retired officers in the seniority list: CBEC has asked to include the names of the retired
officers in the seniority list of the Superintendents vide the letter
F.No.A-26017/42/2014-Ad.IIA Dt. 30.04.14. It is not understandable why the
names of the retired officers should be included in the seniority list. It is
requested to include the names of only working officers in the seniority list
to give promotion to them because the retired officers have no right for
promotion.

Vetting of consideration zone: The consideration zone for promotion was sent to the
concerned section of the CBEC on 29.04.14 by the concerned committee for
vetting but the same is still pending. It is requested to do the needful
immediately.
G)
Allocation of staff in r/o cadre restructuring:
Staff allocation order has not been issued even after more than 7 months of the
approval of the cadre restructuring. It is requested to issue the said order
immediately without further delay.
H)
Reorganisation Notification in r/o cadre restructuring:
Like allocation order, our Board is unable to issue the reorganization
notification even after more than 7 months of the approval of the cadre
restructuring. The same may also kindly be issued immediately without further
delay.
I) Non Functional Financial Upgradation at par with the best
placed Group ‘B’ counterparts: All organised group ‘A’ officers have been granted
financial parity with the counterparts of IAS in the form of non-functional
financial up-gradation. The CSS officers are the best placed group ‘B’ officers
of Govt. of India like IAS in group ‘A’. The group ‘B’ officers at the level of
Inspector of Central Excise and the Assistant of CSS are recruited in a common scale
of pay through common entry
examination. The officers recruited as Assistant (Group-B, Non Gazetted)
in the Ministries get the benefit of promotions upto the Joint Secretary level.
However, their counterpart Inspectors of Central Excise in CBEC recruited as
Group ‘B’ (Non Gazetted) with them get only one promotion in 35/40 years of
career. Their CSS counterparts are retiring 4-5 grades above them. On account
of this, the CSS counterparts are getting 60% more pay than the officers
recruited as Inspector of Central Excise. Even the pension of CSS counterparts
is more than the salary of the officers recruited as Inspector of Central
Excise. The Inspectors of Central Excise retire on a PB2 post of Superintendent
barring around 1% who are merely able to enter PB3 at the fag end of career
while common entry counterparts of CSS easily reach PB4 levels after being
recruited with them in PB2. The grant of the non-functional financial
upgradation on batch to batch basis at par with common entry counterparts of
CSS etc. after entry into group B Non-Gazetted or equivalent grade may really
be a solace for these poor Central Excise executive officers. It is, therefore,
requested that the officers recruited as Inspector of Central Excise may kindly
be granted at least non-functional financial upgradation to grant financial parity
with their counterparts of CSS on batch to batch basis after entry into group
‘B’ non-gazetted or equivalent grade enabling them also to retire in PB4. The matter
may kindly be taken up with the concerned nodal department/s at the earliest.
J)
Regularisation of ad hoc promotions and its time frame:
All promotions to Group ‘A’ are being made on ad hoc basis since 1997 and have
not been regularized particularly in r/o post of AC even despite of directions
of the Hon’ble Supreme Court. It is requested to regularize the ad hoc
promotions on the basis of the RR’s existing on the date of regular DPC
immediately within a time frame.
K)
Residency periods in accordance of DOPT guidelines:
As per the DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09, the residency
period for the post of Superintendent from Inspector as well as AC from Superintendent
is prescribed to be 2 years. No need to submit that it has been prescribed by
the DOPT with due diligence and application of mind. The CBEC is going to
increase the said residency periods. Any increase in the residency period will
disturb the horizontal as well as vertical relativity in r/o other posts in the
Govt. of India and will amount to gross injustice with our officers. It is,
therefore, requested to have the residency periods strictly as per the DOPT guidelines.
L)
Notification for amendment in reward policy: The minutes
regarding the change in the reward policy were issued F.No.296/03/2012-CX.9 Dt.
28.0313 by CBEC. The notification/OM/official order in this regard is still
awaited even after around 22 months of the decision taken in the Board meeting
on 27.09.12. It is requested to issue the due order/notification/OM without
further delay.
