Sub: Request for redressal of grievances.
Sir,
With due
regards, the following grievances are submitted for kind redressal at your end-
1. No gradation between regular and temporary AC’s: The Association came to know
that the post of temporary Asstt. Commisioner is being placed at lower grade
than regular Asstt. Commissioner in the amended IRS Recruitment Rules in r/o
cadre restructuring despite of no such approval being made by the Cabinet or
any other concerned authority/nodal department. In
the existing IRS RR’s also, there has been shown no difference between the
regular and temporary posts. All posts of Asstt.
Commissioner, whether temporary or regular, have been created on the basis of
the functional requirement of the CBEC without any differentiation between
their function, job or work responsibilities. There
is also no difference between the pay scale or classification of the temporary &
regular posts. Both have been placed in the same pay band & grade pay and
also classified as Group ‘A’ without any clause of subordination. Same
procedure is adopted to conduct the DPC for promotion to both from the common
Group ‘B’ gazetted post. Two grades can’t be created for a single post whether
it is termed as regular or temporary. It is, therefore, requested kindly not to
make any differentiation between the regular and temporary posts of Asstt. Commissioner by bifurcating the same post under two grades.
2. DPC for 2013-14, 2014-15 & 2015-16 for promotion to the
post of Asstt. Commissioner: CBEC is already
behind by two modal years in r/o the said DPC. DPC for a financial year should
be conducted well in advance latest by the month of January of the preceding
year. Thus, the DPC for 2014-15 should have been conducted latest by January,
14 and the process for 2015-16 should have also been started in the month of
August, 14 as per the schedule prescribed by DOPT. The promotions against 200
posts of Central Excise share for 2013-14 are still pending and the names of
more than 30 retired or unfortunately expired officers have also been mentioned
in the latest promotion order. A good number of officers facing no charge sheet
or suspension or prosecution have also not been promoted vide above mentioned
order whereas their juniors have been promoted. The
chain vacancies to the tune of 498 on account of cascading effect from higher
side are also required to be added for the DPC. It is, therefore, requested to
kindly conduct the immediate DPC for the post of Asstt. Commissioner for
2014-15 by duly adding the chain vacancies also, also conduct the DPC 2015-16
latest by January, 15, issue promotion orders against 200 posts of Central Excise share for
2013-14, issue promotion orders of more than 30 serving officers in lieu of the
retired or unfortunately expired officers and issue promotion orders for the
officers whose juniors have been promoted despite of these seniors facing no charge
sheet or suspension or prosecution.
3. Non-availability of infrastructure & staff: After last cadre restructuring, the staffside faced the lack of
even sitting space because their rooms were occupied by the higher authorities.
Like last occasion, our officers entered even into IRS on promotion as a result
of current cadre restructuring are still to be provided with the sitting space.
They are sitting here & there due to want of the office space. Neither they
nor Superintendents have been provided with the prescribed office space, due
amenities and required staff. Superintendents are being forced to perform the
duties of Inspectors by ordering for maintenance & custody the
records/files and also initiate original noting and produce the files to higher
authorities. Superintendent, being a gazetted supervisory officer, is not
supposed to do this. It is, therefore, requested that the Superintendents and
promotee IRS officers may kindly be provided with the prescribed office space,
due amenities & required staff alongwith other basic facilities &
infrastructure for smooth functioning of the Govt. work. The Superintendents
may kindly not be forced to do the work of lower seats and the equal
distribution of Inspectors may be made to provide Assisting Hands to them. If
any lapse occurs due to the want of prescribed infrastructure, it is also requested
not to kindly victimize any officer devoid of due infrastructure including prescribed
office space, due amenities and required staff alongwith other basic
facilities.
4. Transfer & posting policy: On
various places, transfer & posting policy is not being followed. The
authorities are using their individual pleasure in the matter of transfers
instead of following the clear clauses of the transfer & posting policy. It
is requested to ask the field formations to frame the transfer & posting
policy under the consultation of the service Associations of stake holder and
also to follow the same without any discrimination or exception with no room
for individual pleasure considering the genuine compassionate grounds of the
staffside.
5. Grant of MACP upgradation in promotional hierarchy: The
Supreme Court vide order in SLP No. 7467/13 filed against the
judgement of High Court of Chandigarh in CWP No. 19387/11 has already confirmed
the order dt. 31.05.11 of Chandigarh CAT for grant of MACP upgradation in
the promotional hierarchy. The same verdict has also been given by the Principal Bench of CAT in OA
No. 904/12 and 864/14 and by Madras High Court in W.P. No. 11535/14 and M.P. No.
1/14 on 16.10.14 undoing the para 8.1 of MACPS but no relief is being given to
the officers on the issue. The Principal Bench of CAT has
also directed to implement the judgement of Chandigarh High Court vide its
order dt. 15.09.14 in OA No.2553/13. It is, therefore, requested to scrap para 8.1 of MACPS
instructions and grant MACP upgradations in the promotional
hierarchy without offsetting with the time scale.
6.
Allocation of Appraisers to Central Excise Zones: A good number of
Appraisers have been allocated to various Customs formations manned by the
Central Excise personnel under the jurisdiction of Central Excise
Commissioner/Chief Commissioner where the Central Excise Superintendents have
already been working as Customs Officer. It is, therefore, requested not to
allocate the Appraisers to the Central Excise Zones for Customs work. Instead
of it, the equal number of Superintendents may be increased by reverting these
Appraisers to their parent Customs Houses. It will give a bit solace to the
acutely stagnated Central Excise Inspectors in r/o the promotional prospects.
It is also requested that the Customs formations falling under the jurisdiction
of Central Excise Commissioner/Chief Commissioner may kindly be kept continued
to be manned by Central Excise personnel only.
7. Retrospective implementation of
the pay scale revision of Central Excise Superintendents at par with NCB: The Superintendents of Central
Excise and NCB have always been treated at par. Both categories were also the
part of the common seniority list meant for promotion to the AC post under same
RR’s. The NCB was brought under the control of Home Ministry some years ago.
Despite being analogous posts and treated always at par, the Superintendents of
NCB have been placed under the pay scale of Rs. 7500-12000/- w.e.f. 01.01.96
whereas the Superintendents of Central Excise w.e.f. 21.04.04. It is also worth
to submit that the Superintendents of NCB were also granted the time scale at
par with the Superintendents of Central Excise considering their analogous
character to give them equal treatment. It is, therefore, requested that the
Superintendents of Central Excise may also kindly be given the benefit of the
pay revision w.e.f. 01.01.96 like the Superintendents of NCB instead w.e.f.
21.04.04.
8. Implementation of circular issued
vide F. No. A-26017/44/94-Ad II (A) Dt. 08.03.95 regarding arrears of pay: As per the Jabalpur CAT verdict,
above circular regarding payment of
arrears to our Inspectors at par with the Inspectors of CBI etc. was issued by
the CBEC. All of then Inspectors have now become Superintendents but the said
circular still remains unimplemented. It is, therefore, requested to implement
the said circular immediately.

Sub: Pension & retirement benefits to the promotee Asstt.
Commissioners retiring this month.
Madam,
As the message received from some
places and matter already raised before your goodself, it is submitted with due
regards that the PAOs are objecting the pension& retirement benefits of the
promotee Asstt. Commissioners retiring this month saying that the vigilance
clearance/NOC is required from the Board level instead of local level in their
case. As conveyed to the Association, the relevant communications have already
been sent to the CBEC from some zones in this regard. It is also worth to
submit that these officers were recently promoted in the month of October, 14
based on the recent vigilance clearance.
2. In view of the above, it is
requested to kindly take the necessary steps on the issue and direct the PAOs
not to get the officers retired without the grant of the pension &
retirement benefits.
