Sub: DPCs and promotion orders in
r/o the post of Asstt. Commissioner.
Sir,
As
already known to your goodself, it is submitted with due regards that our
officers are retiring on a PB2 post with only single promotion in the career
after joining Inspector grade, whereas their counterparts are easily able to
enjoy PB4 levels with 5/6 promotions. Not only it, our officers are also forced
to work under extreme juniors of Customs belonging to same cadre in our own
organization. No permanent measures have been taken in the current cadre
restructuring to improve the career prospects of these officers except placing
on the temporary posts of AC for a few years at the fag end in the same grade
pay, which (or more) is already being drawn by them on account of their
decades-long service. They are placed on the totally lossful positions in r/o
pay matters, MACPS, working conditions etc.
2. These officers
are totally demoralised, job-dissatisfied and de-motivated. Gross injustice is
being done to them despite of the biggest portion (always above the set targets)
of Govt. revenue being collected by them. The CBEC is
already behind by three panel years in the matter of promotions for the post of
AC despite of the DOPT provisions of fixing responsibility of the concerned
hand, if the due DPC is not conducted timely. The existing panel has also not
been exhausted completely resulting into the retirement of the due officers
without promotion. It is also worth to submit that there exists no legal stay
by any legal court regarding the promotions of the Central Excise
Superintendents to the post of AC.

As per the disposition list, 1016 posts of AC/DC are already vacant. 671 posts are
also vacant in higher grades implying that 336 (50% of 671) more posts of AC
are to be cascaded for promotee officers. Thus, at least 1352 of our Group ‘B’
gazetted officers may be promoted immediately as per the DOPT provisions. It is
also worth to submit that around 150 promotee ACs would retire upto March, 15
from the promotion list of October, 14. Around 250 officers will also retire
upto March, 15 from the remaining part of the All India Seniority List of
Central Excise Superintendents after last promotions to the post of AC.

It is, therefore, requested not only to kindly conduct the subject-mentioned
DPCs but also issue the promotion orders against the existing panel immediately
to grant the justice to the due officers retiring without promotion despite of
thousands of promotional vacancies being in hand. This will also fulfil the
functional requirement of the CBEC in the interest of the revenue.
