Namaste.
1. The programme of 24th was
observed successfully before the residence of Member (P&V) in Delhi. She
talked with us around for 1½ hours discussing on our issues but also with a
standard reply that she is going to retire after 5 days. It is really a
problem with our Members & Chairmans of the Board that they say to be new
on joining, enjoy the seat doing nothing for us and respond like the current
Member (P&V) in the last. She was, however, requested at least to initiate
the process of DPC for the years 2014-15 and 2015-16 before her retirement
paving the way to form a road map for promotion against the existing vacancies
of Asstt. Commissioner by asking for the ACR dossiers & other relevant
information from the field formations which should cover the officers around
upto the S. No. 3500 in the existing seniority list. She at least agreed to it
on the spot. Let us see what she does in the office. She said that Board wants
to do everything in favour of our people but things are always delayed due to
some unforeseen complications particularly due to some court cases. She said
that review DPC would be held soon which includes promotions against doubly
promoted, deceased etc. officers, closed envelopes and promotion of Appraisers
due to stay on their promotions being vacated. Memorandum presented to her and
some photographs of the programme are attached herewith. The officers from
Meerut Zone also participated in the programme. Hope that the programme has
been observed by every unit before the residence of respective authority.
2. One more meeting was
held with the Chairman of the CBEC today on 25.05.15. The agenda points
presented to him are attached herewith. He gave due time to the Association to
discuss the issues. However, a full fledged meeting in the presence of Member
(P&V) and concerned sections couldn’t be happened due to one reason or other,
particularly due to the Member (P&V) being more or less out of office for
last few weeks. He agreed to take immediate initiative against the points No. A
(i), C (ii) and C (iii). Let us see what happens. He said regarding point A
(ii) that the regularization work is under process and it has already been
completed upto 2001-02. Points B (ii), C (i), C (iv), D, E and F will be looked
now by CPC. He was not in the position to give any comments regarding other
points, i.e., B (i), C (iv) & G. He also informed on the lines of Member
(P&V) that review DPC would be held soon. He was also specifically
requested to take immediate initiative to fill up already existing thousands of
vacancies of Asstt. Commissioner already mentioned on the site of HRD under disposition
list as on 01.01.15 which should have been increased more account of
retirements and cascading effect. He assured that he would ask the concerned
section to calculate the exact vacancies accordingly to take further action. He
was requested to use his personal influence in the matter instead of routine
procedure. He was pleased to agree. However, only result will tell the fact.

First of all with due regards, the Association wish the best to your goodself
for your future. A bouquet is also being presented to your goodself alongwith
this Memorandum wishing you everything best in the life.

Further, the following points are submitted to your goodself for kind and early
redressal-
A. Immediate holding of DPCs upto the
modal year 2015-16 to fill-up all group ‘A’ entry posts as our officers are regularly retiring without
promotion despite of thousand of promotional posts being in hand: The DPC
upto 2015-16 should have been conducted in the month of January, 2015.
Immediate steps may kindly be taken to update the DPC as we have conducted the
DPC only upto 2013-14, which was also incomplete. Nobody seems serious in the
matter despite of the provisions of fixing responsibility for the lapse in
timely holding of DPCs.
B.
Scheme to improve the career prospects of Central Excise
Superintendents/Inspectors independent of cadre restructuring to get them
attained PB-4 levels by ensuring at
least 5 functional promotions: Our officers are retiring with single
promotion on a PB2 post whereas their counterparts are getting 5/6 promotions
to attain PB4 levels. The matter was raised before the Cabinet Secretary and he
was pleased to recommend it in our favour to the CRC/Cabinet to bring the
measures to remove the stagnation of our officers independent of cadre
restructuring which was duly approved by the Cabinet but no step has been taken
till date. The immediate steps may kindly be taken accordingly to enable our
officers also attaining PB4 levels.
C (i). Initial pay scale equivalent to
the Grade Pay of Rs. 5400/- in PB3 to the Superintendent of Central Excise
w.e.f. the date of the grant of the same to the analogous counterparts of CBI
etc. alongwith other perks as being granted to the later ones: Our
analogous counterparts of CBI etc. have
been granted the pay scale equivalent to the grade pay of Rs. 5400/- in PB3 by
the orders of 1996 with retrospective effect since 01.01.86 disturbing the well
established parity by the govt. without any increase in their responsibilities
vs. our increased responsibilities. The discrimination may kindly be undone by
giving same or better treatment to us.
(ii) Implementation of the CBEC circular
issued vide F. No. A-26017/44/94-Ad II (A) Dt. 08.03.95 regarding arrears of
pay: This
circular was issued based on the order of Jabalpur CAT but the same is still
unimplemented. Immediate steps may kindly be taken to implement the same.
Nothing has been done in this regard despite of the repeated assurances.
(iii) Retrospective implementation of
the pay scale revision of the Superintendents of Central Excise at par with
NCB: The
Superintendents of NCB and Central Excise were the part & parcel of one
& the same RRs once upon a time having a common seniority list for being
promoted to the same post. Their pay scale has been upgraded and they have also
been granted time scale after 4 years of service based on our precedent. But
they have been granted retrospective benefit since 01.01.1996 whereas we have
been given prospective benefit since 21.04.04. Immediate steps may kindly be
taken to undo the discrimination to grant us the benefit w.e.f. 01.01.96 too..
D (i). Next promotion of Central Excise
Superintendent to STS post like other group ‘B’ gazetted officers of Central as
well as State Governments: The most of the group B gazetted
officers of Central as well as State Governments are directly being promoted to
a STS post including CSS, CPWD, Railway Board,
CSSS, AFHQ, MEA, Rajya Sabha Secretariat, Ministry of Parliamentary Affairs,
CVC, UPSC, Forest services, Police services, Foreign Services, Engineering services,
State Services etc. while Central Excise
Superintendents are being promoted merely to a JTS
post. Immediate steps may kindly be taken to undo the discrimination.
(ii). Qualifying services/residency
periods in accordance of DOPT OM No. AB-14017/61/2008-Estt.(RR) dt. 24.03.09: The
residency periods for promotion of group B executive officers as prescribed by
the said OM are not being followed by CBEC whereas the same are very well being
followed for group A officers. No need to submit that the residency periods
have been prescribed by the DOPT with due diligence and application of mind
instead of fulfilling merely decorative purpose. Even more discriminately,
residency period is only 3 years for next promotion for Examiners of Customs while
it is 8 years for Inspectors of Central Excise despite of both being belonged
to the Inspector cadre. This discrimination further delays the entry of Central
Excise Superintendents into group A. The residency periods, therefore, may
kindly be same for both categories in strict consonance of the said OM.
E
(i). Effect wage revision from 01.01.14: The
pay revisions based on the recommendations of 7th CPC may kindly be
affected from 01.01.14 instead of 01.01.16 keeping in view the high expenses to
lead the life in the very expensive time of today.
(ii).
Ensure 5 years wage revision in future: 10 yearly pay revision is
unable to give the required benefit to the employees in the present time of
today in consonance of regularly increasing expenses to live. It may kindly be
on 5 yearly basis in future to cope-up with the high expenses of life.
(iii). Grant
interim relief: Some interim relief may kindly be granted to the employees
keeping in view the high expenses of life in the time of today.
(iv). Merger
of 100% of DA: The DA has already increased by 100% in 2014. It is the need of
time that 100% increase in DA may kindly be merged with the basic pay in the
expensive time of today to give a bit solace to the employees.
(v). Settle all pre-existing anomalies in r/o CPC: All
of the anomalies in r/o pay, MACP, time scale etc. relating to last CPCs are
unsettled for years. The due representations have already been made on every
issue mentioning the relevant legal verdicts but without any response. All of
such issues may kindly be settled at an early date.
F (i). No privatization, no
outsourcing & no contractorisation of government functions: Privatization, outsourcing and contractorisation of govt. work
has become regular practice in the govt. departments which is against the
interests of the govt. employees. This practice may kindly be stopped and govt.
functions may be run only by the govt. employees.
(ii) No ban on
recruitment/creating of posts: No
ban may kindly be made on recruitment/creating
of posts in the name of austerity measures. It is merely hampering the
career prospects of the govt. employees.
G. Scrap
PFRDA Act and re-introduce the defined benefit statutory pension scheme: PFRDA Act
introducing new pension system may kindly be scrapped and old pension system
giving defined benefits to the employees be reinstated.
H. Revive
the JCM functioning/employee grievance redressal mechanism at all levels as an
effective negotiating forum for settlement of the demands of the employees: Employee grievance redressal mechanism may kindly be
revived at every level and minuted meetings be held at regular intervals to
redress the grievances of employees.
I. Remove the ceiling on compassionate
appointments and bonus: Ceiling on compassionate appointments and bonus may
kindly be removed. Bonus may also be given to gazetted officers irrespective of
any categorisation.
J. If it is
being planned to distribute the units/assesses between the Central and State
governments on the basis of any ceiling, only the units upto the maximum
turn-over of Rs. 10 lacs may be given to the States under GST: Only the units
upto the turn-over of Rs. 10 lac may kindly be given to the State governments
under GST. It is being heard that the Central government intends to hand over
the units upto the turn-over of Rs. 1.5 crore to the State governments. If this
happens, the CBEC will be functionless from the angle of Central Excise and
Service Tax affecting the career prospects of the officers very adversely.

Kindly refer to
the telephonic message received from your office to grant appointment to the
Association. The agenda points of the meeting are submitted as below for the
kind consideration for your goodself -
A (i). Immediate conducting of DPCs upto
2015-16 panel year for the post of Asstt. Commissioner as per DOPT provisions
as our officers are regularly retiring without promotion despite of a huge
number of promotional vacancies being in hand: The DPC upto
2015-16 should have been conducted in the month of January, 2015. Immediate
steps may kindly be taken to update the DPC as we have conducted the DPC only
upto 2013-14, which was also incomplete. The DPCs for the years 2013-14,
2014-15 & 2015-16 should have been conducted in January-13, January-14 &
January-15 respectively.
It is also well to pertinent to
mention that 2118 posts of temporary Asstt. Commissioner have been created
merely for 5 years only for the promotions of the promotee officers, out of
which 1½ years have already expired and our officers are forced to retire
without promotion despite of thousands of promotional posts being in hand.
(ii). Conducting of single DPC to
regularise ad-hoc promotions since 1997 to the post of Asstt. Commissioner in
accordance with the rules existing on the date of regular DPC: The
immediate steps may kindly be taken to complete the work as the regularization
has been done only upto March, 2002 after 1997. As a special case, a single DPC
may kindly be conducted for the purpose instead of conducting the yearly DPCs.
B

with common entry counterparts of CSS etc. to retire our officers also in PB-4:
Our officers are retiring with single promotion on a
PB2 post whereas their counterparts are getting 5/6 promotions to attain PB4
levels. The matter was raised before the Cabinet Secretary and he was pleased
to recommend to the Cabinet to bring the measures to remove the stagnation of
our officers independent of cadre restructuring which was duly approved by the
Cabinet but no step has been taken till date. The immediate steps may kindly be
taken accordingly to enable our officers also attaining PB4 levels.
(ii).
Non-functional time scale in PB3 instead of PB2 to Superintendents after 4 years of service
like other counterparts of CSS etc.: Our officers have been granted the time scale in PB2 whereas other
counterparts in PB3. It is requested to kindly take immediate steps to undo the
discrimination.

based on our precedent. But they have been granted retrospective benefit since
01.01.1996 whereas we have been given prospective benefit since 21.04.04.
Immediate steps may kindly be taken to undo the discrimination.
(iv) Implementation of para 7.15.24 of 6th
CPC report: The Chief Enforcement Officers were placed in the
pay scale of Rs. 8000-13500/- sometimes in the year 2005 and Rs. 7500-12000/-
since 01.01.96 till the relevant period of 2005 but no such benefit was given
to us despite of the very specific recommendations of CPC. Immediate steps may
kindly be taken to undo the discrimination.
D. Next promotion of Central Excise
Superintendent to STS post like other group ‘B’ gazetted officers of Central as
well as State Governments: The most of the group B gazetted
officers of Central as well as State Governments are directly being promoted to
a STS post including CSS, CPWD, Railway Board,
CSSS, AFHQ, MEA, Rajya Sabha Secretariat, Ministry of Parliamentary Affairs,
CVC, UPSC, Forest services, Police services, Foreign Services, Engineering
services, Administrative Services, State Services etc. while Central Excise Superintendents are being promoted
merely to a JTS post. Immediate steps
may kindly be taken to undo the discrimination as also promised during the
presentation made on cadre restructuring on 18.01.11.
E.
Batch to batch Non Functional Financial Upgradation to the Central Excise
executive officers at par with the best placed counterparts of CSS etc. on the
lines of Group ‘A’ vs. IAS: The officers of other group A cadres
have been granted financial parity in the form of NFU with the counterparts of
IAS but no such measures to grant at least financial parity to the Central
Excise Superintendents/Inspectors with the best placed group B counterparts
have been taken despite of the revenue targets being achieved by them always
above the set targets and also being the most stagnated category of the group B
govt. officers. It is requested to take immediate steps to grant them at least
financial parity with the best placed group B counterparts in the form of batch
to batch Non-functional Financial Upgradation (NFU) based on the precedent of
group A for the sake of justice particularly keeping in view the
extraordinarily acute stagnation of our officers.
F. Undoing of MACP irregularities (para 8.1,
upgradation in promotional hierarchy and offsetting of MACP upgradation with
time scale) as our officers were able to get the grade pay of Rs. 5400/- in PB3
after 24 years of service under ACPS while now getting the same after 30 years
of service under MACPS: Immediate
steps may kindly be taken to undo the para 8.1 and offsetting of MACP
upgradation with time scale and also grant the MACP benefit in the hierarchy of
functional promotions particularly based on the various court verdicts. It is worth to mention that our
officers are the worst hit category under MACPS as they were able to get the grade pay of Rs. 5400/- in PB3 after 24
years of service under ACPS while now getting the same after 30 years of
service under MACPS.
G. Taking measures that no senior officer of Central Excise is forced to work
under the junior officer of Customs recruited in the same grade in the same
organization of CBEC: The officers recruited as Central Excise
Inspector are forced to work under the extreme junior officers recruited as
Customs Examiner in the same grade/cadre of Inspector through same process in
the same organization of CBEC with same administrative hierarchy and nature of
job under the same Department of Revenue of the same Ministry of Finance.
Immediate steps may kindly be taken to undo the discrimination as also promised
during the presentation made on cadre restructuring on 18.01.11 by bringing
them at par maintaining the relative seniority in accordance of their initial
recruitment.
