Redressal of the staff grievances under Employee Grievance Redressal Mechanism
vs. achieving revenue target.
Sir,
Kindly
refer to the very first meeting of the Association with your goodself regarding
staff grievances. At the end of the meeting, your goodself was pleased to
appeal the Association asking its members to work for the achievement of the
revenue target for the financial year of 2014-15 because of CBEC being far
behind of the same as compared to previous years. The Association was assured
by you to look into all of the staff grievances as soon as the work of revenue
target achievement is finalised. Accordingly, the Association also promised to
be with you on the issue and communicated your appeal to its members further
appealing them to work for the achievement of the revenue target.
2. It is further
submitted with due regards that the revenue has already been achieved like
always above the target by the committed efforts done by our officers and you
have also shown your happiness vide DO letter dt. 08.04.15 in this regard
congratulating the officers working throughout the country. But very
unfortunately, no steps seem to be taken to redress the staff grievances
despite of the work done by the staff to achieve the revenue target as per your
appeal made to the Association. As a result, the staffside has been suffering
miserably like ever being neglected in toto and all of their grievences being
unredressed. A minuted meeting for the same, therefore, is much awaited.
3.
In view of the above, it is requested that the immediate steps may kindly be
taken to redress all of the staff grievances under the employee grievance
redressal mechanism. Association requests and expects for the disposal of all
of the grievances during your kind tenure as Chairman of the CBEC. No need to
submit that all of the grievances have already been submitted to the concerned
authorities including your goodself. If required and asked, all of the
grievances shall be submitted again.

Sir,
Kindly refer to the meeting of
the Association held with your goodself on 25.05.15 and the points submitted by
the Association vide its Ref. No. 58/A/15 Dt. 25.05.15.
2. It is submitted with due
regards that you were kind enough to give patient hearing to the Association.
You were also pleased to assure the Association to take necessary action at
least regarding the following points on the immediate basis having personal
supervision-
A.
Immediate conducting of DPCs upto 2015-16 panel year for the post of Asstt.
Commissioner as per DOPT provisions as our officers are regularly retiring
without promotion despite of a huge number of promotional vacancies being in
hand: The
DPC upto 2015-16 should have been conducted in the month of January, 2015.
Immediate steps may kindly be taken to update the DPC as we have conducted the
DPC only upto 2013-14, which was also incomplete. The DPCs for the years
2013-14, 2014-15 & 2015-16 should have been conducted in January-13,
January-14 & January-15 respectively. It is also well pertinent to mention
that 2118 posts of temporary Asstt. Commissioner have been created merely for 5
years only for the promotions of the promotee officers, out of which 1½ years
have already expired and our officers are forced to retire without promotion
despite of thousands of promotional posts being in hand.
B.
Implementation of the CBEC circular issued vide F. No. A-26017/44/94-Ad II (A)
Dt. 08.03.95 regarding arrears of pay: This circular was issued based on
the order of Jabalpur CAT but the same is still unimplemented. Immediate steps
may kindly be taken to implement the same. Unfortunately, no action is being
taken despite of repeated assurances.
C.
Retrospective implementation of the pay scale revision of the Superintendents
at par with NCB: The
Superintendents of NCB and Central Excise were the part & parcel of one
& the same RRs once upon a time having a common seniority list for being
promoted to the same post. The pay scale of the Superintendents of NCB has been
upgraded and they have also been granted time scale after 4 years of service
based on our precedent. But they have been granted retrospective benefit since
01.01.1996 whereas we have been given prospective benefit since 21.04.04.
Immediate steps may kindly be taken to undo the discrimination.
3. It is also submitted that we were
very much hopeful and enthusiastic to get some positive result at an early date
at least regarding the above points but anything is still awaited even after
around one month.
4. It is, therefore, once more
requested to your goodself to take necessary action in the matter at the
earliest possible date. We expect some relief regarding these points in your
kind tenure itself.

Report of the B. B. Agrawal study group on stagnation of group B officers.
Sir,
Kindly
refer to the Ref. No. 19/P/15 Dt. 13.02.15 of the Association.
2. It is again submitted with due regards that
the issue of extraordinarily acute stagnation being faced by our officers was
raised before the Cabinet Secretary by the Association and he was kind enough
to recommend to the Cabinet of India to take extra measures in addition to the cadre restructuring to remove the
stagnation of group B executive officers of Central Excise. The Cabinet was
also pleased to accept and approve the same. As a result, the subject mentioned
study group was formed. The time granted to the said study group to submit its
report has already expired but the report is still awaited.
3. In view of the above, it is
requested to kindly ask the study group to submit its report at an early date
and take due measures to enable the Central Excise executive officers to enter
into PB4 levels like their counterparts. Even otherwise, it is requested to
take due measures on immediate basis for group B executive officers of Central
Excise as per the approval by the Cabinet.

A-23011/23/2015-Ad.IIA Dt. 26.05.15 of CBEC addressed to the Chief Commissioner
of Central Excise Chennai Zone and copy endorsed to the Pr Chief Controller of
Accounts, New Delhi as well as various representations of the Association
requesting for the general implementation of various court orders.
2.
It is submitted with due regards that the legal verdicts are not being
implemented in general by the CBEC/Govt. even after being finalized by the
various legal courts whether relating to MACP upgradation or stepping-up in the
case of ACP/MACP upgradation or time scale or any other issue. The benefit of
the verdicts is being granted only to the applicant forcing other similarly
situated officers to adopt the legal recourse which wastes the time, resources
and money not only of the individuals but also of the Govt. as well as Courts.
3.
The benefit of the court verdicts at least in the following matters has not
been granted to all similarly situated officers in general except the
applicants despite of being finalized at the level of the Apex Court/High
Court-
A.
MACP upgradation in the promotional hierarchy quashing the para 8.1 of MACPS.
B.
Stepping-up of pay of seniors, if junior is getting higher pay on account of
ACP/MACPS.
C.
Grade pay of Rs. 5400/- to the officers after completion of 4 years in the pay
scale of Superintendent on account of ACP/MACP upgradation at the time of
working as Inspector.
D.
Not offsetting of time scale with the MACP upgradation in case of IInd ACP
holders etc. etc.

The Hon'ble Supreme Court in the judgment dt. 17.10.14 in the Civil Appeal No.
9849 of 2014 in the matter of State of Uttar Pradesh & Ors Vs. Arvind Kumar
Srivastava & Ors has held as under:
“Normal
rule is that when a particular set of employees is given relief by the
Court, all other identically situated persons need to be treated alike by
extending that benefit. Not doing so would amount to discrimination and would
be violative of Article 14 of the Constitution of India. This
principle needs to be applied in service matters more emphatically as the
service jurisprudence evolved by this Court from time to time postulates that
all similarly situated persons should be treated similarly. Therefore, the
normal rule would be that merely because other similarly situated persons did
not approach the Court earlier, they are not to be treated differently.”
5. In
spite of various such decisions of Apex Court and various other courts already
brought to the kind knowledge of the administration, the benefit is not being
extended to all other similarly situated employees. If any matter on service
issue/policy is implemented based on the verdict given by the legal court, the
Govt. is bound to give its benefit to all similarly situated employees. No need
to say that no Govt. organization/department/ministry is above the courts and
it seems contemptuous, if the benefit of the court orders is not given to the
similarly situated employees.
6. As per the discriminatory
practice, the orders for general implementation benefitting all equally placed
officers have also not been issued in the subject-mentioned matter to force
other concerned officers to go to the legal courts. It will not only increase
the unwarranted litigations but is also against the policy of the govt. to
minimize the litigations. But it seems that none in the administration side is
worried to implement the govt. policy of minimum litigations.
7. In view of the above, it is requested
that the benefit of all of the court orders deciding the general issue relating
to any matter including the ones mentioned in para 3 above as well as
subject-mentioned matter may kindly be granted to all similarly situated
employees at an early date through a general order without forcing them to go
for legal recourse.

grade of Asstt./ Deputy Commissioners-regarding.
Sir,
Kindly refer to letter F. No. A-22013/5/2015-Ad.II
Dt. 17.06.15 of CBEC addressed to all Chief Commissioners and Director Generals
under CBEC on the above subject.
2. It is submitted with due regards that the newly promoted
2118 Asstt. Commissioners were kept at the existing stations as per the request
of the Association as well as the established past practice barring those who
were willing to get their station changed or cases where the vacancies were not
existing at the existing station. In case of non-existence of vacancies at the
existing/requested station and also keeping in view the connectivity with the
parent station/zone, the youngest officers were transferred to other nearest
stations/zones with the intention to call them back to the parent station/zone
at the earliest possible opportunity on existence of vacancies.
3. Now vide above referred letter of the CBEC, it
has been forced to change the existing stations of all of the promotee Asstt.
Commissioners promoted against temporary posts. The reason of this decision is
no way understood. They got their promotions at the fag end after having
suffered with the gross injustice for decades. It will again be the gross
injustice with them, if they are transferred to outstations in their old age as
nobody will be able to shift the all-settled family to new station. Nobody will
also be able to have double establishments, one at old station and another at
new station. It will only place them under unwarranted and unbearable financial
burden.
4. Moreover, there seems no administrative
inconvenience in placing them at their existing stations. The displacement from their existing station will also place the govt.
under unnecessary financial burden to give them transfer grant, transfer
allowance etc. in the present time of controlling the govt. expenditure for
which our present Prime Minister is also very serious.
5. In view of the above, it is requested not to
displace the promotee Asstt./Deputy Commissioners from their existing station
without any valid reason and merely as a matter of pleasure barring the willing
ones.
