MEETING WITH SECRETARY REVENUE AND MOS/DOPT.

Dear friends,
Namaste.
1. A meeting of JAC was held today on 29.07.15 with the Revenue Secretary. The agenda of the meeting is attached herewith. He was pleased to listen us cordially, interacting & making due queries during our submissions and noting relevant things on our representation. Seemingly, he was positive on every point but couldn’t give any assurance on the spot intending to get report from the CBEC on our submissions. He, however, looked very serious about our grievances and gave no negative impression. Seemingly, he was agreed to all of our points. Let us see what happens and what will be the final outcome.
2. One more meeting is expected with the DOPT Minister on 03.08.15 as asked by AIACEGEO and IRSITOA. Both letters are attached herewith. Sh. A. K. Sharma (President of IRSITOA) & myself are in regular touch of the staff of the DOPT Minister and are ready to attend the meeting even on shortest confirmation.

It is submitted with due regards that our oficers are forced to retire on a PB2 post with  single promotion in the career after joining as Inspector barring 1% whereas their common entry counterparts are easily enjoying PB4 levels after getting 5-6 promotions. They are also forced to work under the extreme juniors of Customs belonging to the same cadre. Their counterparts of Income Tax (CBDT) and the Assistants of CSS under the same Department of Revenue are able to reach the post of Commissioner and Joint Secretary. Almost all other counterparts of them are also reaching the PB4 levels. All of other cadres below Group ‘A’ except Inspectors & Superintendents are also already getting 5 to 6 promotions in CBEC.
2. In view of the above, your goodself is requested to give an appointment to the Association as per your convenience enabling us to make submissions in person relating to the following points-
(A) DIRECT PROMOTION TO STS POST:The most of group ‘B’ gazetted officers in the Central as well as State governments are being promoted directly to a Senior Time Scale (STS) post with Grade Pay of Rs. 6600/- including CSS, CPWD, Railway Board, CSSS, AFHQ, MEA, RajyaSabha Secretariat, Ministry of Parliamentary Affairs, CVC, UPSC, Directorate of Enforcement in Revenue Department itself, Forest services, Police services, Foreign Services, Engineering services, State Services etc. while Central Excise Superintendents are being promoted merely to a Junior Time Scale (JTS) post with Grade Pay of Rs. 5400/-. Central Excise Superintendents (Group ‘B’ Gazetted post) may also kindly be granted promotion directly to a Senior Time Scale post with Grade Pay of Rs. 6600/- to maintain parity with similarly placed employees of other departments.
 (B) UNIFORM PROMOTIONAL HIERARCHY:Thepromotional hierarchy is varying department to department.  
(i) Somewhere Group ‘B’ Gazetted Officers are promoted to a post carrying a Grade Pay of Rs. 5400/- in PB3 (in CBEC, CBDT, Department of Post etc.) whereas to a post carrying a Grade Pay of Rs. 6600/- at other places (CSS, RajyaSabha Secretariat, CSSS, AFHQ, MEA, MPA, CVC, UPSC, Enforcement Directorate in Revenue Department itself, Railway Board, Administrative services, Forest services, Police services, DANICS, DANIPS, CPWD, State services etc.).
(ii) Like it, somewhere Group ‘B’ Non-Gazetted Officers are promoted to a post carrying a Grade Pay of Rs. 5400/- in PB3 (CBI, IB, Hindi departments etc.) whereas they are being promoted to a post carrying a Grade Pay of Rs. 4800/- (CBEC, CBDT etc.) or Rs. 4600/- (CPWD etc.) at other places.  
(iii) (a) Somewhere promotional hierarchy is 4600à6600à8700 (CPWD etc.).
                   (b) Somewhere 4600à4800à6600à7600à8700 (CSS, CSSS, AFHQ, MEA, MPA, CVC, UPSC, Railway Board etc.).
                   (c) Somewhere 4600à5400à6600à7600à8700 (Hindi departments, CBI, IB etc.)     (d) Somewhere it is 4600à4800à5400à6600à7600à8700 (CBEC, CBDT, Department of Posts etc.).
So, the promotional hierarchy after entry into group ‘B’ is required to be made uniform for the sake of justice to all. The posts under the grade pays of Rs. 5400/- & 6600/- and also Rs. 7600/- & 8700/- being functionally same, the ideal promotional hierarchy for all after entry into Group ‘B’ seems only to be 4600à6600à8700à10000. It is, therefore, requested to make the promotional hierarchy uniform for all Group ‘B’ officers as 4600à6600à8700à10000 on the pattern of CPWD.



(C) BATCH TO BATCH NON FUNCTIONAL FINANCIAL UPGRADATION TO THE CENTRAL EXCISE EXECUTIVE OFFICERS AT PAR WITH THE BEST PLACED COUNTERPARTS OF CSS ETC.All organised group ‘A’ officers recruited with IAS, the best placed group ‘A’ service, in the same pay scale through common examination have been granted financial parity with counterparts of IAS. They have been granted non-functional financial up-gradation vide DOPT OM No. AB.14017/64/2008-Estt.(RR) dt. 24.04.09 to compensate the lack of promotions as compared to IAS. As far as group ‘B’ officers are concerned, the CSS and RajyaSabha Secretariat etc. officers are the best placed group ‘B’ officers like IAS in group ‘A’. The group ‘B’ officers at Central Excise Inspector and Assistant of CSS level are recruited in a common scale of pay through common examination conducted by SSC. The officers recruited as Assistant (Group-B, Non Gazetted) in the Ministries get the benefit of promotions upto the Joint Secretary or above level. However, their counterpart Central Excise Inspectors recruited also as Group-B (Non Gazetted) through same common All India competitive examination get only one functional promotion in 35/40 years of service despite of working on more important seats of revenue collection. Thus, the CSS counterparts are retiring 4-5 grades above the officers recruited as the Central Excise Inspector. On account of this, the CSS counterparts are getting 60% more pay than the officers recruited as Central Excise Inspector. Even the pension of CSS counterparts is more than the salary of the officers recruited as Central Excise Inspector.It is requested that the officers recruited as Central Excise Inspector be granted at least non-functional financial upgradation at par with their counterparts of CSS on batch to batch.
(D)INTRODUCTION OF FLEXIBLE/DYNAMICPROMOTION / COMPLEMENTING SCHEME:The problem of acute stagnation in the cadre of Superintendent can be solved, if a flexible/dynamic promotional scheme is introduced for them after joining as Inspector. The flexible promotional scheme was introduced in the Department of Science and Technology. The DOPT vide Notification No. 2/41/97-Plc dated 9.11.98 made the regulation of in-situ promotion under such Flexible Promotional Scheme. It has been further reviewed by DOPT and modified Flexible Complementing Scheme guidelines issued vide OM No. AB/4017/37/2008-Esst(R) dated 10.09.10. FCS and MACPS both are also applicable simultaneously. In the same manner, dynamic promotions scheme was adopted for other categories including drivers. It is requested to kindly introduce a Flexible/Dynamic promotional/complementing scheme on completion of qualifying years of service as prescribed by DOPT under OM dated 24.03.2009 for granting in-situ promotions after every 5 years in the service career of the officer in the hierarchy of functional promotions after joining as Inspector.
3. It is further submitted that the detailed submissions would be made at the time of personal discussions.

Sub: Submissions under Employee Grievances Redressal Mechanism by the staffside under CBEC.
Sir,
            First of all, many many thanks to call us for the meeting. The points in brief for your kind consideration and due redressal are submitted as below-
1. Consultation with staffside on pay matters regarding 7th CPC: It is requested to form an implementation cell having Staff Associations/JAC as member to implement the CPC report after duly considering the submissions/views of the staffside.
2. Timely DPCs:It is requested to conduct immediate DPCs for all vacant posts as officers are retiring without promotion despite of promotional vacancies being in hand. DPC may kindly be conducted immediately for serving officers, if there is any problem to collect the information in r/o retired officers. Decentralised vigilance clearance and maintenance of ACR dossiers etc. may kindly be made centralized to avoid the delays. 
3. GFR 254:It is requested to grant ad hoc promotions to the lower officers by operating the posts being vacant at higher levels (for the want of eligible officers) by downgrading to lower levels under GFR 254 till eligible officers are available at higher levels.
4. GST:It is requested to give units only uptoRs. 10 lacturnover to states,otherwise it mayresult in no work left for usmaking our career prospects ‘the bleakest to bleakest’.
5. Recruitments Rules:It is requested to finalise the RRs immediately under consultation with the staffside. No DPC may kindly be delayed for the want of pending RRs keeping in view the DOPT provisions not to delay any DPC waiting for pending RRs.
6. Minimum five functional promotions:It is requested to grant minimum five functional promotions to our officers like counterparts of other departments. If functional promotions are not possible due to some unavoidable technicalities, organization specific flexible/dynamic promotion scheme may kindly be adopted to grant at least five in-situ promotions or even non-functional upgradations in uniform promotional hierarchy. Promotional hierarchy differs department to department in discriminatory manner, e.g., (i) à4600à6600à8700à (CPWD etc.) (ii) à4800à6600à7600à8700à (CSS, CSSS, MPA, MEA, AFHQ, CVC, Ministry of Railways etc.) (iii) à4600à5400à6600à7600à8700à (IB, CBI, Hindi departments etc.) (iv) à4600à4800à5400à6600à7600à8700à (CBEC, CBDT, department of Posts etc.) etc. which needs to be made uniform for the sake of justice to all. It is worth to submit that the grades under 5400 & 6600 as well as 7600 & 8700 are functionally same. It is also worth to submit that the Cabinet also recommended bringing specific measures for our stagnated employees independent of cadre restructuring. No need to submit that promotional posts even in new higher grades with higher pay scales have been created for group A in cadre restructuring despite of eligible officers not being available but no measures have been taken to reach stagnated group B and C officers to higher levels.
7. MACP anomalies:It is requested to kindly undo the MACP anomaliesimmediately. Para 8.1 and offsetting of time scale against MACP upgradationmay kindly be undone particularly keeping in view the legal verdicts to grant MACP upgradations in promotional hierarchy and also stepping up the pay of seniors, if getting less pay than juniors under ACPS/MACPS. The court verdicts may kindly be implemented in general instead of forcing equally placed officers to go to the courts to get relief.
8. Vigilance matters:It is requested to follow the time bound schedule in vigilance matters. If prolonged, the observation period after finalization of the case may kindly be shortened accordingly.
9. Infrastructure & prescribed office space: It is requested to take immediate steps to provide infrastructure & prescribed office space to staffside and promotee group A officers.Staffside is being discriminated in the matter since 2002 by getting their rooms vacated for group A officers.
10. Employee Grievance Redressal Mechanism:It is requested to follow the mechanism at centre (including Revenue headquarters) as well as field formations at regular intervals (two months extendable by one month) for all categories of officers by holding minuted meetings.
11. 1% incremental Incentive:It is requested to grant the benefit to all categories of officers instead of only group A without any exception or discrimination.
12. Comprehensive Health Insurance Scheme:It is requested to implement the scheme already initiated by the HRD of CBEC.
