Sub: Meeting
under Employee Grievance Redressal Mechanism-request regarding.
Madam,
Kindly refer to
the discussions held on 09.07.15 with your goodself in person.
2. It is
submitted with due regards that the meeting under the Employee Grievance
Redressal Mechanism is long awaited in CBEC. The grievances of the employees are unredressed for the want of the
said meetings. Such meetings are required to be held as per the CBEC circular issued vide No. B.
12017/05/2008-Ad.IV.A Dt.
18.01.10 and reiterated vide even number Dt. 02.03.12. The last four
meetings were held on the following dates -
i) 14.03.12 under the Chair of Member (P&V),
36 points were discussed during the meeting.
ii) 02.11.12 under the Chair of Member
(P&V), 17 points were discussed during the meeting.
iii) 31.01.13 under the Chair of Member (P&V), 45 points were
discussed during the meeting.
iv) 04.03.14 under the Chair of Chairperson, 14 points were discussed during the meeting.
3. Despite of
very good number of grievances being pending due to the want of holding of
regular meetings, only limited points are being submitted as below as asked by
your goodself on being new on the seat and also being busy in many other works.
Further as asked by your goodself, other points will be submitted in the
meetings to be held at regular intervals in future alongwith reviewing the
former points.
A) Immediate holding of DPCs upto the year 2015-16
(due in January, 2015) for the post of Asstt. Commissioner as our officers are
forced to retire without promotion despite of thousands of promotional posts
being in hand and also preparation for the DPC for 2016-17 (due in January,
2016): It is requested
to kindly take immediate steps to update the DPCs as the CBEC has conducted the
DPC only upto 2013-14 for the post of Asstt. Commissioner. The DPCs for the
years 2014-15 and 2015-16 should have been conducted in the month of January-14
and January-15 respectively. It is also well pertinent to submit that 2118
posts of temporary Asstt. Commissioner have been created merely for 5 years
only for the promotions of the promotee officers, out of which more than 1½
years have already expired and our officers are forced to retire without
promotion despite of thousands of promotional posts being in hand. The DPC for
the year 2014-15 was expected to be held on 23.06.15 and for 2015-16 in the
month of August, 15. It is requested that the DPC for the year 2014-15 may
kindly be conducted at least in the month of July, 15 itself and for 2015-16 in
the month of August, 15 immediately preparing at least tentative eligibility
lists and circulating to the field formations asking the required information
without further delay.
B) Scheme to
improve the career prospects of acutely stagnated Central Excise
Superintendents/Inspectors independent of cadre restructuring as recommended by
the Cabinet to grant parity with common entry counterparts of CSS etc. to
retire our officers also in PB-4: Our officers are retiring with single promotion on a
PB2 post whereas their counterparts are easily attaining PB4 levels. Our Superintendents join the job as Inspector and
retire as Superintendent after getting only one promotion during the entire
service career of 35-40 years barring 1%.Their common entry counterparts of
other organizations including CSS and CBDT
under the same Department of Revenue of same Ministry of Finance are getting 5 to 6 promotions upto the level
of Joint Secretary/Commissioner after being recruited
through one and the same process in the same grade. Even the Examiners
of Customs belonging to the same cadre, their intra-organisational counterparts,
are reaching PB4 levels and heading their seniors of Central Excise. The matter was raised before the Cabinet Secretary
and he was pleased to recommend to the Cabinet to bring the measures to remove
the stagnation of our officers independent of cadre restructuring which was
duly approved by the Cabinet but no step has been taken till date even after
expiry of more than 1½ years. Our officers are totally demoralised having nothing to be job-satisfied
or motivated. The rights to grow, make progress and live with dignity have
totally been snatched from them. There is no change in the scenario regarding
their career prospects despite of the repeated requests and representations
made to the administration. Gross injustice is being done to these officers
despite of being instrumental with full dedication & commitment to collect
the biggest portion of Govt. revenues always above the set targets. It
is requested to kindly take immediate steps accordingly to enable our officers also attaining PB4 levels. Temporary
posts of Asstt. Commissioner created in the cadre restructuring are also unable
to do the desired good for our officers, that’s why the Cabinet approved to
bring measures independent of cadre restructuring on the issue of stagnation.
These temporary posts will only enable to get around 4% of our officers get JTS
post for a limited period without any right for further promotions.
C)Implementation
of para 7.15.24 of 6th CPC report: The Chief Enforcement
Officers under our own Department of Revenue were placed in the pay scale of
Rs. 8000-13500/-without recommendations by CPC vide Order F. No.
1612612004-Ad.I.C dt. 04.10.05. The 6th CPC under para 7.14.25
recommended to maintain parity
between the post of Chief Enforcement Officer and our Superintendent etc. which is unimplemented till
date. Subsequently, the post of Chief Enforcement Officer was
re-designated as Assistant Director. The duties and responsibilities of
Assistant Director (re-designated) of Enforcement Directorate are at par with
the duties and responsibilities of the post of Central Excise Superintendent.
The Central Excise Superintendents join in Enforcement Directorate as Assistant
Director on deputation basis also. The Govt. (Department of Expenditure) has,
however, approved an initial grade pay of Rs. 5400/- in PB2 for Central Excise
Superintendents on 21.11.14 considering
para 7.15.24 of the report of VIth CPC but the lower authorities in
Expenditure wrote finally vide UO No. 6/37/98-IC Dt. 24.11.14 to send the case
to 7th CPC against the approval by the competent authority. It
merely shows the wilful hostile discrimination against Central Excise
Superintendents by the lower rung authorities of Expenditure. It is requested to kindly take immediate
steps to undo the discrimination.
D)Implementation of the CBEC circular issued vide F.
No. A-26017/44/94-Ad II (A) Dt. 08.03.95 regarding arrears of pay: This
circular was issued under the signature of Sh. Dharmvir Gupta, the then Deputy
Secretary of CBEC based on the orders of Jabalpur CAT for the payment of
arrears of pay to our officers at par with the CBI Inspectors w.e.f. 01.01.86
but the same is still unimplemented. It is requested to kindly take immediate
steps to implement the same. Unfortunately, no action is being taken despite of
repeated assurances given by the administration..
E)
Retrospective implementation of the pay scale revision of the Superintendents
of Central Excise at par with Superintendents of NCB: The Superintendents
of NCB and Central Excise were the part & parcel of one & the same RRs
once upon a time having a common seniority list for being promoted to the same
post. The pay scale of the Superintendents of NCB has been upgraded and they
have also been granted time scale after 4 years of service based on our
precedent. But they have been granted retrospective benefit since 01.01.1996
whereas we have been given prospective benefit since 21.04.04. It is requested to kindly take immediate
steps to undo the discrimination by granting the benefit to our officers also
at least w.e.f. 01.01.96.
4. It is very much requested to
conduct a minuted meeting at the earliest possible date to redress the above
submitted grievances.

Sir,
It is submitted with due regards that
the details of conducting last 5 consecutive DPCs for the post of Asstt.
Commissioner in CBEC are as under-
i) Year 2011-12 in June, 12 (delayed
by 1½ years being due in January, 11).
ii) Year 2012-13 in March, 14 (delayed
by 2¼ years being due in January, 12).
iii) Year 2013-14 in October, 14 and
June, 15 (delayed by 1¾ and 2½ years being due in January, 13).
iv)
Year 2014-15 is still awaited (already delayed by more than 1½ years being due
in January, 14).
v) Year 2015-16 is still awaited
(already delayed by more than ½ year being due in January, 15).
2. It is also interesting to submit that
the said DPCs are being delayed habitually despite of the DOPT instructions to
fix the responsibility of the concerned officer responsible for the delay. It
is also worth to mention that 2118 temporary posts of Asstt. Commissioner were
created only for 5 years w.e.f. 18.12.13 to be filled by promotions, out of
which around 1½ years have already expired.
3. It is also submitted that there
is no legal stay to conduct the said DPCs. Officers are forced to retire
without promotion (only IInd in the career of 35-40 years) due to this
indifferent approach (perhaps wilful) and delayed process despite of thousands
of promotional posts being in hand. As far as RRs are concerned, DOPT
instructions are very clear that DPC can’t be delayed for the want of pending
RRs.
4. It seems that the concerned section is totally indifferent in holding
the DPCs for the said post. They don't care even for the DOPT instructions
& rules. DPC for the year 2014-15 is expected for 450+ posts for Central
Excise stream with a consideration zone of around 700 officers. Out of these,
200+ have already retired till July, 15 and 100+ are facing vigilance cases.
Thus, all of 450+ posts will not be filled even after use of extended panel and
be carried forward to next year of 2015-16 due to the delayed process. We don't
know when the DPCs would be conducted and till when our officers will keep
retiring without promotion due to delayed DPCsdespite of being due for
promotion. If DPCs were conducted timely, none of due officers would have
retired without promotion. Due to this delayed process, even the extended panel
is exhausted without giving any benefit to our officers. CBEC authorities are
requested to be quite serious for us remembering that we are their actual tools
and are always instrumental in collecting the revenue for them always above the
targets without any return. Thus, our officers are being punished without any
fault by snatching their legitimate right of promotion.
5. Our officers are retiring on a PB2
post with only single promotion in the career after joining Inspector grade,
whereas their counterparts are easily enjoying PB4 levels with 5/6 promotions.
Not only it, our officers are also forced to work under extreme juniors of
Customs belonging to same cadre in our own organization. No permanent measures
have been taken in the current cadre restructuring to improve the career
prospects of these officers except placing them on the temporary posts of
Asstt. Commissioner for a few years at the fag end. They are also placed on the
totally lossful positions in r/o pay matters, MACPS, working conditions etc.
and are already totally demoralised, job-dissatisfied
and de-motivated.
6. As per the disposition list of
April-15, 1037 posts of AC/DC are already vacant. 701 posts are also vacant in
higher grades implying that 351 (50% of 701) more posts of Asstt. Commissioner
are to be cascaded for promotee officers. Thus, at least 1388 of our Group ‘B’
gazetted officers may be promoted immediately as possibility of retirement of
many more Group ‘A’ officers can’t be ruled out after April-15.
7. The DPC for the year 2014-15 was
expected to be held on 23.06.15 and for 2015-16 in the month of August, 15. The
DPC for the year 2014-15 may now kindly be conducted at least in the month of
July, 15 itself and for 2015-16 in the month of August, 15 immediately
preparing at least tentative eligibility lists and circulating to the field
formations asking the required information without further delay.
8. In view of the above, it is
requested -
i) To take the immediate steps not only
to conduct the DPCs for the years 2014-15 & 2015-16 but also to make due
preparation for the DPC for the year 2016-17 (due in January, 16) as per DOPT
rules and
ii) To fix the responsibility of the concerned
officer and take necessary action for habitual delay in conducting the DPCs.
