Went to Chennai regarding vacation of stay granted by the Chennai CAT against the DPC for the post of Asstt. Commissioner. The Board sent comments to CC Chennai just on 04.11.16 in the evening. Met the CC Chennai requesting her to hire ASG for the case and do the needful to vacate the stay. She was kind enough to open the office for this purpose on Saturday and assured to do the best. She was, however, doubtful whether ASG would be available on such a short notice. No need to say that regular govt. counsel would ascertain to attend the hearing, if ASG is not available.
One more petition (in addition to the one filed by Bangalore officers) was finalised by sitting with the advocate which will be filed on 07.11.16 to get the stay vacated. Customs officers are also going to file another petition to get the stay vacated on the same day. Advocate of both sides will appear on same day before the Hon'ble CAT requesting to vacate the stay without questioning the merits of the case of original petitioners as a good number of our officers are retiring every month without promotion. Let us hope for the best.
